Unfortunately, cities have a very limited ability to regulate projects like the proposed equipment upgrade on Wagon Lane. The Federal Communications Commission's regulation of wireless telecommunications facilities generally preempts local regulation, and the California Legislature has recently introduced a bill that would further limit cities' authority (Assembly Bill 57, Quirk). Nevertheless, you can rest assured that the City of Rolling Hills has done everything within its powers to ensure that the proposed upgrade on Wagon Lane complies with federal standards. As you know, I have attempted to convey your concerns to representatives of Sprint, but was unable to persuade Sprint to pursue an alternative project. The City requires applications for wireless telecommunications facilities to contain detailed information confirming among other things that the facility is necessary and will comply with federal regulations and standards for construction, maintenance and operations. Sprint has provided all of the required information. Therefore, while I understand your concern and frustration, the City has no authority to prevent Sprint's proposed upgrade. Thank you for your understanding. Sincerely, Raymond R.
