Thank you for your August 12, 2015 letter communicating your continued objection to
Sprint's application to upgrade its existing equipment located on a wooden utility pole
located at 111/2 Wagon Lane.
Unfortunately, cities have a very limited ability to regulate projects like the proposed
equipment upgrade on Wagon Lane. The Federal Communications Commission's
regulation of wireless telecommunications facilities generally preempts local regulation,
and the California Legislature has recently introduced a bill that would further limit
cities' authority (Assembly Bill 57, Quirk). Nevertheless, you can rest assured that the
City of Rolling Hills has done everything within its powers to ensure that the proposed
upgrade on Wagon Lane complies with federal standards. As you know, I have
attempted to convey your concerns to representatives of Sprint, but was unable to
persuade Sprint to pursue an alternative project. The City requires applications for
wireless telecommunications facilities to contain detailed information confirming
among other things that the facility is necessary and will comply with federal
regulations and standards for construction, maintenance and operations. Sprint has
provided all of the required information. Therefore, while I understand your concern
and frustration, the City has no authority to prevent Sprint's proposed upgrade.

At its meeting of March 28, 2011, the City Council approved your request for a new
driveway at 11 Wagon Lane subject to the following conditions:
1. Rolling Hills Community Association review and approval is required.
2. The new driveway apron shall be in compliance with the submitted plan, dated
March 24, 2011.
3. The first 20 feet of the driveway apron shall have a maximum slope of 7%.
4. The driveway apron shall be roughened.
5. There shall be no grading for the driveway.
6. The existing driveway approach shall be closed off and landscaped.
Please be aware that a permit will be required for the disposal of the construction debris
generated from the old driveway and, it can be obtained at City Hall. For more
information with regard to the permit or if you have any questions, please don't hesitate

This is to inform you that at the March 24, 2011 Traffic Commission meeting, the
Commission reviewed your request for a new driveway at the above address. Based on
their review of the driveway approach, visibility of oncoming traffic and compliance
with the City's zoning regulations, the Traffic Commission recommends approval of the
new driveway approach subject to the following conditions:
1. Rolling Hills Community Association review and approval is required.
2. The new driveway apron shall be in compliance with the submitted plan, dated
March 24, 2011.
3. The first 20 feet of the driveway apron shall have a maximum slope of 7%.
4. The driveway apron shall be roughened.
5. There shall be no grading for the driveway.
6. The existing driveway approach shall be closed off and landscaped.
Please have the driveway apron staked according to the plan submitted to the Traffic
Commission on March 24, 2011 on or before March 25, 2011. The Traffic Commission's
recommendation will be forward to the City Council for their consideration at the City
Council meeting scheduled for Monday, March 28, 2011 beginning at 7:30 p.m. Should

At its meeting of March 24, 2011, the Rolling Hills Traffic Commission is scheduled to
address the application submitted by you on behalf of the property owners of 11 Wagon
Lane for relocating their existing driveway on Wagon Lane approximately 64 feet to the
south.
On or before March 10, 2011, it is requested that the proposed driveway apron be
staked to adequately illustrate its location and size. Please maintain the stakes through
the Traffic Commission's meeting in case a field trip is desired and thereafter until the
City Council hears the application.
