The California Department of Fish and Game has received and reviewed the final
monitoring report for the mitigation site at 5 and 6 Sagebrush Lane per
Streambed Alteration Agreement Notification #1600-2003-0077-R5. A site visit
was conducted on August 26, 2009 to review the site to ensure the construction
was completed as described in the streambed alteration agreement and to
determine if the mitigation, as defined within the streambed alteration agreement,
has met the success criteria, as well as the terms and conditions of our
agreement. The Department has determined, based upon this Final Monitoring
Report and the site visit, that the terms and conditions were met and that the
Department deems the mitigation to be successful.
The Department is closing Streambed Alteration Agreement #1600-2003-0077-
R5. We thank you for your cooperation in this matter. If you have any questions,

Dear Mr. Calhoun:
In a letter to you dated November 16, 2001, which is enclosed, the City required that
within two weeks of the letter winterization plans be submitted to Los Angeles County
Public Works Department for review and approval and all necessary permits be secured
and work commenced within thirty days of the County's approval.
On December 13, 2001 you submitted winterization plans to Los Angeles County, which
were returned to your representative for corrections on December 27, 2001. As per the
November 16, 2001 letter you were given five days from the receipts of the corrections to
re -submit corrected plans.
On several occasions your representative was in contact with the City staff pertaining to
these corrections. We had arranged for the District Engineer, Lata Thakar, to review the
required corrections with your representative and we have asked the County to expedite
this application.
Your representative met with Mrs. Thakar and obtained all the information necessary for
re -submittal. However, to date, the required information and corrections were not
submitted to the County.
On Friday, March 1, 2002 staff spoke to Douglas McHattie of Bolton Engineering
regarding if any progress had been made. Staff was informed that the plans have been

completed and the necessary survey done and that the corrected plans will be submitted
to the County the week of March 4, 2002.
Please submit the necessary plans and corrections to the County by Friday. March 22,
2002. In addition, within five days of the County's approval of the plans for
winterization, secure all necessary permits and commence work within fifteen days of
receipt of the permits.
Should you fail to comply with the above schedule, a public hearing will be scheduled
before the City Council. It is our hope that such a hearing will be unnecessary, and that
you will work cooperatively to expedite this matter.

showing signs of distress, most notably large fissures, loose soil and vertical
displacement. The enclosed letter from the County Department of Public Works, the
City's public works office, more completely describes the condition of the property.
The letter observes that in its current state the property will experience accelerated
movement.with the infiltration of stormwater runoff from rain events. The letter
recommends that a winterization plan be professionally prepared, approved and
implemented in anticipation of the coming rainy season.
Section 8.28.010 of the Rolling Hills Municipal Code provides as follows:
"Any condition on property within the City which has in the recent past
or may in the future aggravate, enlarge or accelerate an active landslide is declared to
be a public nuisance. For the purposes of this chapter, an active landslide is defined as
land which is sliding or moving on its own accord."
Section 8.28.020 of the Code further provides:
"Any condition declared to be a public nuisance by Section 8.28.010 shall
be abated or corrected in accordance with the provisions of Chapter 8.24."
The landslide condition on the subject property constitutes a public
nuisance within the meaning of Section 8.28.010. Accordingly, in accordance with the
provisions of Section 8.24.030, this letter constitutes official notice directing you to abate
the nuisance in the following manner:

Dear Mr. Hoerning:
In accordance with your request, I visited the subject site with Mr. Doug McHattie of
Bolton Engineering Corporation on December 5, 2001 for the purpose of assisting in
development of a winterization plan for the subject site. The subject site has been
affected by a landslide. We understand that the City of Rolling Hills requires that a
winterization plan be submitted to the County of Los Angeles Department of Public
Works for review. The plan is to be designed to inhibit the infiltration of storm water
into the slide area on the site.
Scope of Work
The scope of our work is to assist Bolton Engineering Corporation in the development
of a winterization plan for the subject site. The conditions of the existing landslide;
the stabilization of the landslide; the gross stability of the site and the effects of
infiltration of storm water into the slide area are beyond the scope of our work.
Subsurface exploration, acquisition of soil samples, laboratory testing, engineering
analysis, and preparation of plans and cross sections are beyond the scope of this
study.
Site Conditions
The subject site is located to the northerly end of Sagebrush Lane, and at a short
distance north of the intersection of upper Blackwater Canyon Road and Portuguese
Bend Road, in the City of Rolling Hills, California.

The site consists of a relatively level pad overlooking slopes descending to the
northwest and east to natural drainage swales. The slopes are up to approximately 90
feet high and have average slope gradients of about 2:1 (Horizontal to Vertical), but
locally as steep as 1:1.
A landslide has occurred on the slope descending to the northwest. Numerous
fissures are present on the slope. The landslide is active at the time of this writing.
Recommendations
I recommend the following:
• Fill the fissures with soils;
• Cover the slope and fissures with plastic sheets;
• Secure the plastic sheets on the slope with anchors;
• Install a drainage inlet on the pad;
• Grade the pad to drain to the inlet;
• Extend a drain pipe from the inlet to the natural drainage swale at the toe of the
east -facing slope; and
• Inspect the system periodically to evaluate its effectiveness and correct any
deficiency.
Remarks
The purpose of this report is to present my recommendations for the proposed
winterization plan. This report presents my professional opinion resulting from my
brief site observation. The recommendations presented herein are intended to reduce
the amount of moisture infiltration into the slide area. Infiltration of some moisture
into the slide area and further movements of the slide are possible. Not all possible
problems can be foreseen, due to the absence of subsurface data, laboratory testing
and engineering analysis. This report is advisory in intent and content. No warranty
of any kind, expressed or implied, is made.

Section 8.28.010 of the Rolling Hills Municipal Code provides as follows:
"Any condition on property within the City which has in the recent past
or may in the future aggravate, enlarge or accelerate an active landslide is declared to
be a public nuisance. For the purposes of this chapter, an active landslide is defined as
land which is sliding or moving on its own accord."
Section 8.28.020 of the Code further provides:
"Any condition declared to be a public nuisance by Section 8,28.010 shall
be abated or corrected in accordance with the provisions of Chapter 8.24."
The landslide condition on the subject property constitutes a public
nuisance within the meaning of Section 8.28.010. Accordingly, in accordance with the
provisions of Section 8.24.030, this letter constitutes official notice directing you to abate
the nuisance in the following manner:

• Within fifteen days of the date of this letter, secure from a
geotechnical and civil engineer and submit to the County
Department of Public Works a winterization plan designed to
inhibit the infiltration of storm water into the slide area on the
• property.
• If the Department of Public Works requires corrections to the
plan, submit corrections within 5 days of notice from the
Department.
• Secure necessary permits and implement the winterization plan
within 30 days of the Department's approval of same.
Should you fail to comply with the above schedule, a public hearing will
be scheduled before the City Council. It is my hope, however, that such a hearing will
be unnecessary, and that you will work cooperatively with this office in protecting your
and neighboring properties now that the rainy season is upon us.
Please call me should you have any questions or concerns about this letter.
The City is available to assist you as necessary in this process and looks forward to your

Dear Mr. Calhoun:
In a letter to you dated November 16, 2001, which is enclosed, the City required that
within two weeks of the letter winterization plans be submitted to Los Angeles County
Public Works Department for review and approval and all necessary permits be secured
and work commenced within thirty days of the County's approval.
On December 13, 2001 you submitted winterization plans to Los Angeles County, which
were returned to your representative for corrections on December 27, 2001. As per the
November 16, 2001 letter you were given five days from the receipts of the corrections to
re -submit corrected plans.
On several occasions your representative was in contact with the City staff pertaining to
these corrections. We had arranged for the District Engineer, Lata Thakar, to review the
required corrections with your representative and we have asked the County to expedite
this application.
Your representative met with Mrs. Thakar and obtained all the information necessary for
re -submittal. However, to date, the required information and corrections were not
submitted to the County.
On Friday, March 1, 2002 staff spoke to Douglas McHattie of Bolton Engineering
regarding if any progress had been made. Staff was informed that the plans have been

As requested a field investigation was conducted on September 20, 2001 of the landslide
area currently affecting the subject property. The scope of the investigation was limited to
a review of the surface conditions of the properties affected by the slide. The investigation
did not include any subsurface exploration. As stated in previous meetings, a full geologic
investigation is required to understand the mechanics and scope of the slide.
The recent slope failure at the subject property is a reactivation of a portion of an ancient
landslide. The first signs of the failure were noted at # 5 Sagebrush and have progressed
over several months to widen and extend to the subject property. Currently, large fissures
and vertical displacements on the order of several feet are present at the subject property.
The fissures caused by the deep seated movement of the landslide have caused the
surface soils to breakup into a loosened state. The ground movement has altered the
original drainage pattern of the lot and the loosened soils are prone to erosion. During rain
events, surface runoff from the upstream contributory areas may be conveyed to the failure
by the altered drainage pattern and potentially accelerate the ongoing ground movement.
Therefore, it is recommended that the property owner prepare and immediately implement
a winterization plan which includes provisions for storm water and erosion control. The plan
should be prepared by a professional civil engineer and submitted to Building and Safety
Divison for review and approval. If you should have any questions regarding this matter

Re: Canyon Drainage on Hao & Calhoun properties — Sagebrush
Lane
The RHCA is very concerned about the large amount of landslide debris
that has blocked the canyon passage that serves as an important natural
drainage course for water flowing from Crest Road downhill to Palos
Verdes Drive North.
As you know, the riding trail from the Appaloosa Lane curve is
destroyed and hopefully will be restored when the properties are
regraded. ' z
In the meantime, we hope that before the onset of the rainy season,
mitigation measures will be taken to allow the flow to continue
downhill. If the canyon remains blocked, the drainage could possibly
back up and accumulate, thereby damaging other properties not now
involved in the landslide.
