On October 7, 2015, you sent a letter to Stephen and Diana Nuccion, Trustees of the
Nuccion Family Trust (the "Nuccions"), the owners and residents of 18 Portuguese Bend Road
(the "Property") in the City of Rolling Hills (the "City"). In that letter, you indicated that a
neighbor complained that (a) the pool equipment located on the Property encroached into a side
yard setback and (b) the noise from the pump was "disturbing the peace" of the neighbors. You
recently followed up with a second letter dated February 8, 2016.
The noise from the pump has not changed in several years. The sounds created by the
pool equipment are at a decibel level that is consistent with the manufacturer's specifications and
is generally at or below the ambient noise decibel level in the area. Moreover, the alleged
complaint cannot be accurate, because the neighboring house at 15 Portuguese Bend Road is not
occupied and is under construction. Thus, there are no residents who could have been disturbed
in October 2015.
Nonetheless, please be advised that the pool equipment is screened by a thick hedge
located between the pool equipment and the neighboring house at 15 Portuguese Bend Road.
This hedge is shown in the overhead view picture attached to this letter. The hedge acts as
additional noise dampening for the pool equipment, which we believe does not make a sound
that can be heard above the ambient noise level on the neighboring property.

The pool equipment is properly located on the concrete pad, where it was installed when
the home was first constructed in 2007. Attached to this letter is a copy of the relevant portion of
the approved site plan for the construction of the residence on the Property. One can see on the
approved site plan that the pool equipment pad is shown as the rectangle marked "PE." The
actual pad was constructed in accordance with the approved site plan and in substantially the
same location as shown on the site plan. Also attached to this letter is a copy of the recent
survey from Bolton Engineering, showing the as -built pool equipment pad. For your reference,
we also attach a copy of the Corner Record for the property, filed by the Los Angeles County
surveyor on February 4, 2016. The Corner record confirms that accuracy of the boundary lines
shown on the Bolton survey.
It is true that one corner of the pool equipment pad extends less than two feet into the 10-
foot side yard setback. However, the pad is located in substantially the same location as shown
on the approved site plan. Thus, any minor side -yard encroachment was approved as part of the
site plan approval. Also, Municipal Code Section 17.46.100 provides that the City will not issue
a certificate of occupancy unless the City inspections confirm that the construction complies with
the approved site plan. Thus, when the City issued the certificate of occupancy for the residence
at 18 Portuguese Bend Road, they must have confirmed that the location and dimensions of the
pool equipment pad were in substantial compliance with the approved site plan. Moreover,
Municipal Code Section 17.16.150 allows walkways, steps, and rubble walls to be located in any
setback, and the pool equipment pad can be considered in the nature of a walkway or step in that
the pad is also a flat concrete object upon which one can and should walk.
We trust that this letter adequately responds to the complaint that was received by the
City, and that you can now close the file on this matter.

This is to follow up on a letter mailed to you on October 7, 2015 regarding a
complaint received by the City claiming the presence of a loud swimming pool pump
and encroachment with the pool equipment into the side yard setback on your
property at 18 Portuguese Bend Road.
The City requested that you immediately reduce the noise from the pump and
provide a site location of the equipment in relationship to the north property line,
utilizing a professionally drawn survey or site plan.
To date we have not received a plan from you showing the location of the pool
equipment area nor a statement whether any action was taken to reduce the pool
pump sound. In addition, Section 17.16.200 (G) of the Zoning Ordinance requires
that pool equipment area be screened from other properties.
Please call me or provide a written statement whether you reduced the sound from
the pool pump or screened it. If you have not, then please install such a dampening
system and install landscaping to screen the pool equipment area by March 10,
2016. In addition, by the same date please submit a plan showing the location of
the pool equipment in relationship to your north property line. Once the location is
determined, staff will advise you accordingly.

As per your previous request that all communication with you be in writing, I would
like to inform you that the City has been advised that the pool pump on your
property at 18 Portuguese Bend Road is very loud and is disturbing the peace of
your neighbors and that the pool equipment encroaches into the north side yard
setback.
To immediately reduce the noise from the pump, please dampen the sound of the
pool pump by screening it or utilizing other sound attenuation methods. As for the
location of the pool equipment, please provide a site location of the equipment in
relationship to the north property line, utilizing a professionally drawn survey or
site plan.
I could also be available to meet with you on your property to observe the location
of the pool equipment, if the property line is staked, and verify the sound of the pool
pump.
Please contact me by October 12. 2015 to acknowledge the receipt of this letter
and to arrange for a visit or to inform me of your planned action to address this
complaint. We'll then proceed accordingly.

F. Satellite Antennas. The review of the appli-
cation shall be limited to assuring compliance with the
following criteria:
1. The satellite antenna shall not be lo-
cated in the front yard or in any setback and shall be hid-
den or screened from view from surrounding properties and
any roadway easement;
2. Colors of the installation shall blend
with adjacent environment and vegetation;
3. All satellite antennas installations
that are more than three feet in diameter shall be ground -
mounted and not affixed to a residential or permitted acces-
sory structure;
4. No more than one satellite antenna may
be installed on any legal building site;
5. All wiring and cables emanating from a
satellite antenna shall be installed in compliance with ap-
plicable installation requirements;
6. A building and/or electrical permit, as
applicable, shall be obtained prior to installation;
7. The installation shall not exceed a to-
tal overall height of fifteen feet from finished grade at to-
tal extension.
Notwithstanding the provisions of Section 17.08.050 of
this code, deviations from the above criteria may be
granted by the City Manager or designee for satellite an-
tennas three feet or less in diameter, if necessary to al-
low the applicant to obtain reasonable reception.
G. Swimming pool, pool equipment, spa and simi-
lar water features shall comply with the following crite-
ria:
1. No swimming pool, pool equipment, spa
or water feature shall be located in the front yard or in
any setback, except that a decorative fountain and a deco-
rative pond, if constructed as part of landscaping features
may be located in the front yard;
2. Where a swimming pool, pool equipment
or spa are submitted as part of a discretionary or nondis-
cretionary review, such structures shall be counted towards
building pad coverage, structural and total lot coverage
and the disturbed area of the lot;
3. Where the size of the swimming pool/spa
is eight hundred square feet or greater, a site plan review

approval shall be required. For the purpose of this section
the size of the pool/spa shall include the area of the wa-
ter surface only;
4. Where the construction of a swimming
pool/spa of less than eight hundred square feet is submit-
ted for an administrative approval, the applicant shall
show a site for a corral and stable pursuant to Section
17.16.170 of this chapter, and provide calculations regard-
ing the gross and net lot area, structural and total lot
coverage and disturbed area of the lot;
5. The pool equipment shall be screened
from view from other properties;
vcner conditions may be imposed as nec-
essary through the discretionary or administrative review
process.
H. Freestanding storage shed, detached trellis,
freestanding covered patio having a solid roof, gazebo,
outdoor bar, barbeque or fireplace, roofed playhouses or
forts, fountains, ponds and similar structures. Such struc-
tures shall not require a discretionary review and shall
not be counted towards building pad coverage, structural,
total lot coverage and disturbed area of the lot unless:
1. Any one of such structures exceed one
hundred twenty square feet in area or exceed twelve feet in
height, (fifteen feet for a roofed playhouse or fort), or
when any combination of such structures exceed a total of
eight hundred square feet, except that freestanding trel-
lises or covered patios may be larger than one hundred
twenty square feet, provided that the combined total of
such structures does not exceed eight hundred square feet.
2. There is more than an aggregate of five
of such structures on a lot, or where the total of such
structures exceed eight hundred square feet, including not
more than two storage sheds.
Such structures shall not be located in any setback or
in the front yard, except that a decorative fountain and a
decorative pond, if constructed as part of landscaping fea-
tures may be located in the front yard.
Such structures shall be screened from public right-
of-way, easements and adjacent properties with appropriate
landscaping.

You are aware of the utility pole problem at No: 18 Portuguese Bend Road as well as the power
line issues at No: 15 Portuguese Bend Road. I have personally sent you communications
regarding these problems and had no response from Southern California Edison.
The owners of these two properties have moved forward and met with the Rolling Hills
Community Association regarding our safety as well as the issues we have raised with
Southern California Edison regarding our easements. The Rolling Hills Community
Association directors have jurisdictions over these easements.
At their request we were told to reach an agreement and attitude of co-operation. We were
told to bring that agreement to the Association for their review. This letter serves as a notice
to the Rolling Hills Community Association and Edison that there is an agreement of purpose.
The Nuccions and the Hassoldt's have agreed to work with the Association to resolve the pole
and power line violations.
After speaking with the Board of Directors and receiving a positive commitment from them to
take their easement oversight powers and work with Southern California Edison , these
problems must be resolved. The easement violations that exist on these two properties may
not continue. They are the trustee of all the easements in Rolling Hills and make the
decisions that best serve our community long term. They are not interested in what short
cuts work for Edison!
The board requires a copy of the existing plan that provides information on the present
condition of Edison's equipment. This must include pole placement, easements, location of
overhead power lines, vaults and transformers. The plan must include and identify individual
properties being served by this equipment. The recent plan you have submitted does not
fulfill the above, rather it includes further burdens being placed on their properties.
After reviewing the existing conditions the board of directors want to see a new plan. This
should be a schematically accurate plan including concerns with pole placement,
transformers, overhead power lines, vaults and under grounding. This plan should include
the properties in the area showing how they receive service from Edison.. Their message
and ours is Edison must correct the installation that violates personal properties as well as
easements.

The goal is to recover the easements for the use and visual pleasure of the community.
Certainly the most recent plan from Edison shows no sign of co-operation. Reducing the
Impact of # i5 Portuguese Bend Road was a lost concept on your map. Placing a power pole
on each side of this property, leaving the utility lines in place dissecting their property, and
not under grounding the lines to the street vault definitely is not a solution acceptable to
anyone.

I have been provided with a copy of your April 24, 2013 email to the City Council
regarding the current disposition of the utility pole on your property at 18 Portuguese
Bend Road and would like to take this opportunity to clarify some matters.
As you know, your predecessors in interest devoted a decade to satisfying the utility
undergrounding requirement associated with the subdivision that created your parcel.
The physical topographic conditions, the lack of cooperation among neighbors and
other similarly challenging circumstances surrounding satisfaction of the subdivision
condition were the cause of many complications and delays. At the time you and your
husband entered into escrow for the acquisition of the property from Saridakis, you
were both well aware of the complex history associated with the undergrounding issue,
and were specifically aware that the utility pole in question was not required by the
City to be removed as part of satisfaction of the subdivision requirements.
At your request and as a courtesy to your family, the City convened a meeting on April
16, 2009 in order to facilitate communications between you and the various utility
companies involved with the undergrounding. You were aware then, as now, that the
condition, location and access to the subject utility pole is a private matter between you
and Southern California Edison (Edison) and that the City does not have any
responsibility for the disposition of the pole. Indeed, Edison is regulated by the Public
Utilities Commission and the City is never in a position to know, comment on or
predicate issuance of a certificate of occupancy on the condition of a utility pole. I
specifically recall convening this meeting in order to be as helpful as possible to your
family and to address the frustrations you were experiencing by using my influence to
bring all of the relevant parties to the table.
While it is true that the City Attorney and I attended the April 16, 2009 meeting in order
to facilitate communications between you and the utilities, the issues at hand did not
directly involve the City but was strictly a private matter between you and Edison.
Neither he nor I have notes from that meeting. I regret that you find this frustrating,

notes from that meeting exist.

We would like to request time to address the Council regarding our purchase of 18
Portuguese Bend Road. My wife Diana, and I have recently completed a lengthy escrow
to purchase this home. Diana was raised in Rolling Hills and we have lived here with our
young children since 2006.
We entered escrow for 18 Portuguese Bend Road in December 2008, with little
knowledge of the complex subdivision improvement agreement. As you are all aware,
the house itself and the subdivision improvement project are incomplete. On April 16,
2009, we met with the Rolling Hills City Manager, City Attorney, and Planning
Commissioner as well as a representative from each of the parties involved in the
undergrounding project for 17 and 18 Portuguese Bend Road. At that meeting, we were
informed that the project is very near to completion. All the structures have been
installed for the undergrounding of the utilities. The representatives from Verizon,
NextG, SCEdison, and Cox all confirmed that they had been paid in full and were not
anticipating any additional costs. The project appears to be on schedule to be completed
by June 15, 2009. At present time, there is surplus of $19,042.73 in the escrow holding
account after all invoices have been paid. Both Ken Allen, the project manager, and
Victoria Kraft, the escrow officer, has confirmed this number.
We are requesting that the provision in the third amendment regarding the subdivision
improvement project for 17 and 18 Portuguese Bend Road requiring $150,000.00 ,be
placed in an escrow account after the sale of 18 Portuguese Bend Road be waived. At
present time, the project appears to have a surplus and there are no outstanding invoices.
We need the funds to complete the interior electrical work on 18 Portuguese Bend, so that
the undergrounding project can be completed. Until the interior work has passed
inspection, the exterior work cannot progress. There is also much work needed to finish
the house so that it can be deemed habitable.
We support the project and want it to be completed in as timely a fashion as possible.
We understand that as a result of the previously enacted agreements, we would be
responsible for additional costs if the subdivision improvement project could not be
completed with the present funds available.

In discussions with Ken Allen, he has stated that the communication utilities are not willing to proceed
with the remainder of this project. It appears that we are at an in pass with NextG, Verizon andCox
utilities. They have re -written their letters and have stated that they are unwilling to continue with the
project. Southern California Edison has stated that they will go forward and remove the overhead
facilities behind #17 and #18 Portuguese Bend Road, relocate the existing pole on the north/west corner
of #18. They will continue with the work to install the padmount transformer in front of #18 Portuguese
Bend to serve both #17 and #18 Portuguese Bend Road.
If this is the final phase on this project, we would like to make a compromise to leave any remaining
money in an account for the city to use for future projects. We have paid for all of the work except the
re -location of the power pole and that price is $8,749.26 for SCE, no billing to date for Cox, or Verizon.
We feel certain that there is enough money in escrow to complete the work as outlined above.
Currently Cox Communications and NextG have not rendered bills, partly because the billing is less than
originally submitted. Following this letter, are the letters from Verizon, NextG and Cox supporting our
position on Phase 2.
It is our recommendation that we continue with the work outlined above and then end this project.
We would like to have this discussion at the next city council meeting, so please put us on the schedule.

Once again, my wife and I would like to approach the subject of obtaining our Final
Inspections. We are extremely desperate to have the freedom to obtain conventional
financing or sell the property at 18 Portuguese Bend. We are paying an astronomical
interest loan amount to Vineyard Bank and are at the point of despair.
Vineyard Bank has given us an extension of May 15, 2008. We need to act on our
financing before they file a N.O.D. We have worked endlessly on all aspects of this
project and all its hurdles and it would be a complete shame to have an outcome like a
foreclosure. Not to mention that another party would be involved.
As you may or may not be aware, our Phase 1 of the undergrounding is 99.9 % complete.
We are waiting for the telephone company to run their wires in the conduit and then it
will be complete. We are now working on the scope of work for Phase 2. We again,
have some complications that are out of our control that we would like to address in front
of the city council.
We have options that we could entertain to satisfy the city if they are concerned or
uncomfortable about their exposure. We have discussed some of them in the last
meetings. We would be willing to take some of those suggestions into consideration.

invested a considerable amount of time and money into this property and it is imperative that we

Regarding Loan 61 525975 — 18 Pon.ugvcsc Bend Road. Rolling Hilts Estates. CA
As you know, the Bank has tightened its lending due to the present real estate market.
The above referenced loan matured March 22, 200° and the balance is now due. You
have indicated that you will attempt to find outside financing to retire our loan, but I
doubt that you will he successful without a "Final" or Certificate of Occupancy from the
appropriate government agency. It is imperative that you obtain this as soon as possible.
While the tank has indicated it does not want to approve any further extensions to this
loan, if you can provide a copy of the "Final" or "CofO", I will attempt to get one last 30
to 60 day extension to enable you to obtain outside financing.
