This letter shall serve to notify you that the Planning Commission adopted a resolution on April 18, 2000,
determining the front and rear yards at your existing lot at 25 Portuguese Bend Road (Lot 89-A-RH), Rolling
Hills, CA. That action, accompanied by the record of the proceedings before the Commission was reported to
the City Council on April 24, 2000.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS DETERMINING THE FRONT AND REAR YARDS AT A 6.63
ACRE EXISTING LOT AT 25 PORTUGUESE BEND ROAD THAT HAS ONE
RESIDENTIAL UNIT FRONTING THE NORTH SIDE OF PORTUGUESE BEND
ROAD.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Mr. and Mrs. Phillip V. Cho made a request to the Planning Commission
to determine the location of the front yard with respect to a 6.63 acre lot located at 25
Portuguese Bend Road (Lot 89-A-RH), Rolling Hills, where there is a single family residence.
Section 2. The Planning Commission considered the request at duly noticed
meetings held on February 15, 2000 and March 21, 2000, and at a field trip visit on March 11,
2000. The applicants were notified of the meeting in writing by first class mail. Evidence was
heard and presented from all persons interested in affecting said proposal and from members
of the City staff and the Planning Commission having reviewed, analyzed and studied the
request. The applicants and the applicants' representatives were in attendance at the meetings.
Section 3. The Planning Commission hereby determines that the front yard is
located at the south side of the lot that fronts the north side of Portuguese Bend Road, that the
rear yard is located at the north side of the lot at the northern terminus of Pheasant Lane, and .
that all other yards are side yards.

We have arranged for the Planning Commission to conduct a field inspection of your property to
view your proposal on Saturday, March 11. 2000.
The Planning Commission will meet at 8:00 AM at 1 Wideloop Road and then proceed to your
property. Do not expect the Planning Commission at 8:00 AM but be assured that they will be
at your property by 8:45 AM.
The site must be prepared according to the following requirements:
• Flag the EXISTING 50 foot front yard setback line;
• Flag the PROPOSED 35 foot side yard setback line; and

RE: Lot 89, Rolling Hills Tract — Architectural File Data
To Whom It May Concern:
As Rolling Hills lots are unique and shaped in non-traditional forms, in my long experience
working with the City with respect to "yard" determinations, some were very difficult to
make. Many items were considered; front door location, street location and access address, as
well as topography and orientation of the home on the property.
The above property was purchased by Mr. and Mrs. Lee (now Dotha Welbourn) from Mr. W.
Hoagland, who built the home in 1948 in the central portion of the area now subdivided into
Lot 89A and 89B. The house address given by the Association was 25 Portuguese Bend Road
as this was the only street at the time.
In 1955 Lot 89 was subdivided into 89A and 89B by Mr. Hoagland, and the original 1948
access to the Welbourn house from Portuguese Bend Road was established as "Pheasant
Lane" to serve both lots. Owners are now Cho and Askari. The original address of "25
Portuguese Bend Road was retained by the owner and the new lot became 2 Pheasant Lane.
Although the Welbourns received mail at 25 Portuguese Bend Road, both homes were
identified by the Association as accessing from the same street, Pheasant Lane. The front
door and front yard of the Cho (Welbourn) home face Pheasant Lane.
Perhaps it would be helpful in considering the historical aspects of the property and
community in addressing the definition of the "yards" which relates to further development of
the existing residence. Also, since an existing residence will remain, architectural aesthetics
in creating the most desirable development would be beneficial to the entire community.
I hope this information is helpful. The old Association records are available for review and
may be of assistance in determining "yard" definitions that can help retain the character of the
home.

REQUEST FOR SIDE YARD AND FRONT YARD DESIGNATION
Dear Mrs. Ungar and Members of the Planning Commission:
City documents indicate that the Front Yard for the subject property was recently shown at the westerly
property line which abuts Parcel 89B. The Side Yard is shown at the property line which adjoins Pheasant
Lane.
City Development Code Section 17.12.230 defines a Front Yard as
" the space extending across the full width of the lot between the side lot lines,
the depth of which is measured between the front roadway casement line and
either the line of the primary building or the nearest line of any enclosed or
covered porch attached thereto."
If the Front Yard depth is measured from the roadway easement to the structure, then the Front Yard for the
subject property must be located at the Pheasant Lane Easement side of the property, which is the side adjacent
to Parcel 92-2.
The front entrance side of the house faces Pheasant Lane; all access is from Pheasant Lane; and therefore it is
difficult to see how the Front Yard can be established adjacent to Parcel 89B,at one of the innermost sides of
of the property. Perhaps this location for the Front Yard is a carryover from the previous subdivision map in
which a roadway easement was established 10 access all three parcels of the subdivision. Since the subdivision
has been abandoned, this no longer applies.
We respectfully request that you reconsider the Front Yard and Side Yard designations for the subject
property, taking into consideration its current configuration.
