Dear Mr. and Mrs. Wallace:
We have arranged for the Planning Commission to conduct a field
inspection of your property to view a staking of the perimeter of
the subject solar panels at the proposed site on Tuesday, September
7, 1993 after 5:30 PM.
The Planning Commission will meet at 5:30 PM at 20 Outrider Road
for a time and then proceed to your project site. Do not expect
the Commission at 5:30 PM, but be assured that the field trip will
take place before 7 PM.
The site must be prepared with a staking of the perimeter of the
proposed protect using wire, twine or ribbon with small pieces of
cloth or ribbon flags attached to aid in the visualization of the
proposed project. In addition, please provide a product sample at
the site. We have enclosed general Silhouette Construction
Guidelines.
The owner and/or representative should be present to answer any
questions regarding the proposal.

SILHOUETTE CONSTRUCTION GUIDELINES
1. When required by the Planning Commission or City Council, a
silhouette of proposed construction should be erected for the
week preceding the designated Planning Commission or City
Council meeting. The Silhouette shall not remain erected for
a period longer than one week unless directed by the Planning
Commission or City Council.
2. Silhouettes should be constructed with 2" x 4" lumber.
Printed boards are not acceptable.
3. Bracing should be provided where possible.
4. Wire, twine or other suitable material should be used to
delineate roof ridges and eaves.
5. Small pieces of cloth or flags should be attached to the wire
or twine to aid in the visualization of the proposed
construction.
6. The application may be delayedif inaccurate or incomplete
silhouettes are constructed.

Enclosed you will find information you've requested for our proposed solar
system approval at 340utrider. You will find included:
A) A plot plan (to scale) of property indicating panel location in relation
to what is existing now.
8) Solar collector specifications and related details.
C) Solar system operation and installation data
D) A picture of an existing system very sirniiar to this one in appearance
and surroundings. The appearance is identical with one exception; there
will be no white stripes between panels it is now a solid bin?. You
can clearly see the panels are aestheticly appealing. More importantly
because they are mounted low to the ground on an unusable portion of
the property they are nearly invisible to neighbors and any public
right of Way.
E) The State of California Solar Rights Act. You w111 find this very infor-
mative as to the guidelines and regulations the State strictly enforces
to encourage and protect against difficulty in approval for the use of
solar.
F) Lastly; I've included a letter I Initially sent to Kevin Ennis containing
information I feel will be valuobie to you it further addresses sCmw

You will find this package complete with all you have requested in order to
present our proposal for approval on Tuesday "sight. I understand from our
last conversation that your plan is to reclassify solar to be approved in
the same fashion as satellite dishes. Therefore minimizing time involved
in processing and cost of approval. i think it is important that we under-
stand exactly how much time and exactly how much money we are talking
about so we can agree that this plan of attack is the best option. Could
you please call me at your convenience to further fill me in?
As i mentioned to you, Marsh Hauge from our company will be attending the
meeting Tuesday at 7:30 pm at City Hall. He will be able to answer any
questions which come up and further explain this installation in order to
assure complete understanding on the city's behalf to ensure best
Possibility for rapid approval. We are taking the time to attend this meet -
because time and money is of the utmost importance. Therefore if you
think of anything which will help our efforts which we can come prepared
with or address before the meeting please let me know right away.

RE: Proposed Solar Pool Installation at residense located at
34 Outrider in Rolling Hills.
Thank you for your time yesterday. I appreciate your efforts to
help us to get this situation resolved quickly. It took some time
to obtain proper information for you to address the setback comments
you mentioned. • I think you will find the following information
adequate to speak with Lola about our proposed project. If you need
anything else at all please feel free to call me at my direct phone
number 714/978-7970.
To follow are three sheets of information:
1. The State of Calif. Solar Rights Act; I have underlined the parts
which directly relate to our case and need to be addressed as we
proceed.
2. Plot Plan of proposed property; Shows location of proposed collectors
in rear yard in relation to property lines. You will see that we
are ,able tomaintain the required setbacks you mentioned.
3. A picture of similar installation. This will give you an idea of
the overall appearance. One attractive difference in this installa-
tion is there will be no white strip between panels. It is a solid
dark color.
The question Lola had is weather this would be considered a "structure".
If so she has told me a Site Plan Review costing $1,500. will be required,
and process can take quite awhile. If we are told to abide by this
costly, lenghtly process we will rely on the State of CA Act to support
and force our efforts for reasonable approval.
Weather or nbt the city of Rolling Hills wants to declare this a
"structure" and call it a structure we strongly feel this situation
warrants seperate and special consideration. The reasons for this are:
1. The collectors will nol-be visabl2 to any public rightaway.
2. This is located on a sloped unusable piece of land.
3. They just sit there collecting the suns reys needing no human
or otherwise contact. There is no related safety considerations.

There are other factors involved relating to the location and
the efficiency of the system which I would be happy to discuss
with you.
For now I would truly appreciate your looking into this situation
as quickly as possible. If there is any possibility of some
answers today we would be forever greatful. Again, I am happy
to supply you with anything you may need, just call me.

SOLAR RIGHTS ACT
The people of the State of California do enact as follows:
Section 714 of the Civil Code
•
a) Any covenant restriction, or condition contained in any deed, contract, security
instrument, or other instrument affecting the transfer or sale of , or any interest in, real
property which effectively prohibits or restricts the installation or use of a solar energy system
is void and unenforceable.
b) This section shall not apply to provisions which impose reasonable restriction on
• solar energy systems. However, it is the policy of the state to promote and encourage the use
of solar energy systems and to remove obstacles thereto. Accordinaly, reasonable
restrictions on a solar energy system are those restrictions which do not significantly increase
the cost of the system, or significantly decrease its efficiency or specified performance, or
which allow for an alternative system of comparable cost, efficiency, and energy conservation
benefits.
c) For the purposes of this section, "solar energy system" has the same meaning as
defined in Section 801.5.
d) Whenever approval is required for the installation or use of a solar energy system,
the application for approval shall be processed and approved by the appropriate approving
entity in the same manner as an application for approval of an architectural modification to the
property, and shall not be willfully avoided or delayed.
e) Any entity, other than a public entity, that willfully violated this section shall be liable
to the applicant or other party for actual damages occasioned thereby, and shall pay a civil
penalty to the applicant or other party in an amount not to exceed one thousand dollars
($1000). •
f) In any action to enforce compliance with this section, the prevailing party shall be
awarded reasonable attorneys fees.
Section 714.1 of the Civil Code
Notwithstanding Section 714; any association, as defined in Section 1351, may impose
reasonable provisions which:
a) Restrict the installation of solar energy systems installed in common areas, as
defined in Seciton 1351, to those systems approved by the association.
b) Require the owner of a separate interest, as defined in Section 1351, to obtain the
approval of the association for the installation of a solar energy system in a separate interest
owned by another.
c) Provide for the maintenance, repair, or replacement of roofs or other building
components.
d) Require installers of solar energy systems to indemnify or reimburse the association
or its members for loss or damage caused by the installation, maintenance, or use of the solar
energy system. _
