As you know, the construction activity at our property continues in full swing.
During this period of construction, because it has not been an inconvenience for us
to do so, we have allowed you to use that corner of your driveway which encroaches
on our property. Surely you know the area of encroachment given that it has been
marked off by our surveyor with stakes and other markers.
However, as our construction activity progresses, we anticipate that there will come a
time in the near term when it is no longer convenient for us to allow your driveway
encroachment across our shared property line. For the time being, in the spirit of
being good neighbors, we will continue to allow you to use the corner of your
driveway that encroaches on our property. However, we want you to be aware that
our permission of your continuing use and encroachment is revocable at any time.
Indeed, it is likely that it will be necessary for us to revoke our permission to you to
use our property sometime in the next month or two. Given the relatively small area
of our property that is encroached upon by your driveway, we seriously doubt that
our revocation of permission will cause you any inconvenience. We'll let you know
when we intend to complete our landscaping and driveway; it is at that time that we
will retake for our own use that small area of our property which presently forms
the southwest corner of your driveway, as indicated by the surveyor's stakes and
markers.

stockpiling materials to begin construction on your project. During the interim, we
have received complaints from your neighbors regarding the clearance of screening
shrubbery and the exposure of stored materials at your property.
Therefore, it would be helpful to us if you could stockpile any unsightly materials in
as unobtrusive a manner as possible and provide the City of Rolling Hills a
reasonable Construction Schedule for the project within 30 days (by November 21,
1997).

We have received a letter from Mr. Croft and a copy of the letter from the Gibsons and
Swarts. In response, we reiterate, we are not conducting a business from our home
at 6 Meadowlark Lane. We are not staging or consulting with crews or clients at our
home.
We were on vacation the last two weeks of August. We had two workers come to the
house daily to water the roses and fruit trees and to feed the outdoor cat. In September,
we had a major problem with one of our trucks, so one of our trucks had to come to the
house and pick up Rick for work. We also have a crew come to the house weekly for yard
maintenance. We do not see this type of activity as "running a business from our home".
Nor is this activity on a daily basis as they claim until you asked specifically -- then they
recounted their story.
It is very unfortunate that our neighbors will not and do not communicate with us except
to call the city and the association at every possible turn. They are not people who want
to be "neighborly". Instead, they have come to you, taken up your time and ours about
things which are untrue and unfounded. It seems whenever we begin some remodeling
activity at our house, they find a need to complain and make up a story about our
business. In September, we had Atlas Septic Systems deliver the materials to our house
for the new septic tank. Now, surprise, they are complaining again. Is this jealousy or
what is going on with these people?
We assure you we are following the laws of the City and Association and look to you for
help in dealing with these neighbors who insist on harassing us at every step of our
remodeling process.

We would like to formally submit a complaint regarding the three businesses that the
Swarts are running from their home at 2 Meadowlark
1. Swart's Auto Racing Business: Mr. Swart's auto racing business is causing a
possible fatal threat to our family. For the past three years, he has stored
approximately 15 -25 racing cars at his house and continues to bring onto our narrow
lane a very large, oversized truck and trailer to move the cars in and out his garages.
Every time he brings this big rig onto the lane, you cannot drive around it. It
completely blocks the road. This means if we need an ambulance or a fire truck while
his truck is in the street, there is no way for the emergency vehicle to get by. As it is
now, we have to wait for him to close up his trailer for us to drive by and we usually
end up in #1's hedge because there in not enough room to pass. He also parks this big
trailer and truck on Saddleback Road overnight which is illegal and extremely
unslightly. This happens mostly on Friday evenings and Monday mornings.
In conjunction with his auto business, he and his son fix these cars and other
customer's cars in the driveway and in the garage with the garage door open. There are
usually many different cars at their house that they are fixing. We were told that this type
of activity is not allowed in the City of Rolling Hills. We don't live in Wilmington where
people are allowed to fix cars in their driveway and on the street.
We have photos of these activities taking place over the course of the last three years.
We have tried to be neighborly and not complain but we are fed up with their recent
actions and can no longer put up their illegal activities that puts our family in jeopardy.
2. Swart's Rental Business: The Swarts lease out barn space to Diane Kennedy at 541-
5361 and over the years to many other people. This causes a daily trip by the leasees
to the Swarts' property as well as increased traffic from vets, hay deliveries, horse
trailers, etc. We have been told by the city attorney and homeowner's association that
you are not allowed to operate any business from your home. This constitutes a
violation.
3. Swart's Video Business: From the newspaper clipping attached, you will notice that
they are running a third business from their home which involves selling video
equipment. Obviously, another violation of city ordinances.

We ask the Board to put a stop to the Swart's illegal activities. It is critical that Mr.
Swart no longer be allowed to bring his big truck and trailer into the city and especially
not onto Meadowlark Lane. We are serving you notice that this is extremely dangerous
and could result in disaster for the two properties at the end of Meadowlark.
Thank you for your help with this matter. It is extremely important to us.

Re: Business activities of Hilliard /'Peninsula Landscaping'
at 6 Meadowlark Lane.
Dear Mr. Henke.
Ever since the Hilliard family moved into this city, in
July 1994; they have conducted part, or all of their bus-
ness for Peninsula Landscaping from their residence.
We have reported this matter numerous times in the
past to the Assocation and presented them with lists of
recorded activities, at their request.
Company vehicles and workers continue to drive down
this narrow lane to their home, for staging, loading and
unloading of materials and equipment and office consul-
tations, on a DAILY basis.
Recently, when the Billiards were away for two weeks,
the workers continued to come in, in their own car and
leave in company vehicles, having loaded the nessecary
equipment. Then returned in late afternoon to do the
reverse.
The Hilliards have cut away most of the trees and bush-
es on the property, therefore removing all privacy and
with the storage of all the materials and equipment in
full view, it looks more like Wilmington than Rolling Hills!
This also devalues our homes and the hill stability.

The intesity of the activities varies from time to time,
but. NEVER STOPS. Recently things have increased, which
prompted us to also record a few videos and continue the
notes, to bring these illegal actions again to your
attention.
We have lived here happily, for a long time but the last
three years have been most frustrating. This situation
should have been resolved long ago. The two letters rec-
eived from Mr.Croft dated 3.15'96 and 6.25'96 indicate
that this matter is not regarded too seriously, either by
him or the Board. This means that either they are not
fully aware of the intensity of the Hilliard's illegal
activities or they don't want to face the facts.
Our peace, privacy and safety (they also smoke) is being
threatened daily by these workers and continual traffic
in our lane.
We urgently request the Association to finally take
strong and appropriate action and bring a permanent
end to this outrageous violation of the Rolling Hills
residential zoning laws.
