Dear Dr. Wolinsky Dear Mr. Morris: This letter shall serve to notify you that the Planning Commission voted at their regular meeting on April 20, 2004 to direct staff to prepare resolutions to approve your request. The Planning Commission will review and consider the draft resolutions, together with conditions of approval, at an upcoming meeting and make its final decision on your applications at that meeting. Please be advised that the Planning Commission requested that accurate information, legal description and plan showing the easements along the new lot created by this adjustment, including the additional easement for the trail, be submitted for their review. The findings and conditions of approval of the draft resolutions will be forwarded to you few days before the Planning Commission meeting. The decision shall become effective thirty days after the adoption of the Planning Commission's resolution unless an appeal has been filed or the City Council takes jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision will be stayed until the Council completes its proceedings in accordance with the provisions of the Municipal Code. The Planning Commission's action taken by resolution approving the development application is scheduled for Tuesday, May 18, 2004. Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable. Bracing should be provided where possible. Wire, twine or other suitable material should be used to delineate roof ridges and eaves. Small pieces of cloth or flags should be attached to the wire or twine to aid in the visualization of the proposed construction. The City of Rolling Hills contracts with the County forr reviewing legal descriptions for lot line adjustments, certificate of compliance and other technical matters. I am also enclosing a copy of an agreement, by which Mr. Wolinsky was allowed to construct a stable on one of the lots currently being considered for lot line adjustment/sale, (7567-14-16), while his residence is located on a separate lot, at 8 Reata Lane, (7567-14-25), and there was no single-family residence on the lot where the stable was constructed. The agreement states that should the lot with the stable be sold, the stable must be removed. The City may require that prior to approving the Lot Line Adjustment, Mr. Wolinsky show an area suitable for a stable and corral and access thereto at 8 Reata Lane, since he will no longer have the use of the stable on the vacant lot. Records indicate that lot 7567-14-17 (.30 acres), which is a landlocked lot, is owned by Mr. Wolinsky. It would be appropriate to consider including this lot in the lot line adjustment application, or combine it with Mr. Wolinsky's lot on 8 Reata Lane. Dear Ms. Tonsich: Thank you for speaking with me the other day regarding Poppy Trail lots, lots 7567-14- 16, 7567-14-15 and 7567-14-20, that are listed for sale in the Peninsula News and the Daily Breeze Home Guide. The ads describe the property as having a barn, riding ring, corrals and pastures. We appreciate your prompt response to our request for information. We would like to inform you that the City of Rolling Hills Planning Department's records indicate that an approval for a lot merger for lots 7567-14-15 and 7567-14-20 was approved in 1987, however the lot merger Certificate of Compliance has not been recorded. Therefore, these properties show up as two lots in the County Assessor's records. From speaking with the Rolling Hills Community Association Manager, we understand that there is an agreement between RHCA and Mr. Wolinski, who resides at 8 Reata and owns one of the lots for sale (7567-14-16), which allowed him to construct a stable on that lot. It appears that if these properties were to be sold as one property, before any application for construction of a residence on these lots is considered by the City, the lot lines would have to be adjusted through a process called "Lot Line Adjustment" and proof would have to be submitted to the City that a buildable pad of a minimum of 12,000 square feet for a residence is possible on this newly configured property. City's regulations stipulate that a stable, riding ring and other accessory structures and uses are allowed on a lot only in conjunction with a single family residence. Once the property sells and the stable, riding ring, corral and pastures are no longer under an agreement for the use by the property owner at 8 Reata, it would be a violation of Section 17.16.030 Accessory Uses and Structures of the Municipal Code, if these facilities were to be rented out or used for commercial purposes.
