NEALIS, CITY MANAGER SUBJECT: FOLLOW-UP COMMENTS FROM FRANK BIVINETTO, 29 EASTFIELD DRIVE REGARDING ROOFING MATERIAL. DATE: MARCH 15, 2001 This morning, Thursday, March 15, 2001, Mr. Frank Bivinetto, 29 Eastfield Drive, visited City Hall. The purpose of his visit was to apologize for his comments and position he had taken regarding wood roofing material when he talked with me on the telephone on Monday, March 12 ant to initiate the permit process to re -roof his house with a Class A non -wood roofing material. We had a very pleasant discussion. I directed him to visit the Community Association for architectural approval of the roofing material in anticipation of our approval of his roofing permit. After he visited the RHCA, Principal Planner Yolanta Schwartz stamped his permit for the Class A roof covering material. NEALIS, CITY MANAGER COMMENTS FROM. FRANK BIVINETTO, 29 EASTFIELD DRIVE, REGARDING WOOD ROOF MATERIAL. MARCH 12, 2001 This morning, Monday, 3/12/01, Mr. Frank Bivinetto, 29 Eastfield Drive, contacted me by telephone indicating that he was, "Going to go ahead and install his wood shake roof." Although he later somewhat retracted this statement, he was upset and indicated that the reasons that the City has given him regarding the failures of the County to prohibit this material at two addresses in the City and the failure of the City to enforce the Code at 15 Eastfield Drive were basically "B. S.". I discussed the wood roofing situations in the City with him again indicating that two of the roofs were installed under permits erroneously issued allowing the treated wood material in a Class A "assembly"; another roof was installed without any permits; (we have given this property owner until June 30, 2001 to correct) as well as the status of discussions regarding 15 Eastfield Drive. I informed Mr. Bivinetto that the City Attorney, County and City Staff are meeting with the property owner at 15 Eastfield Drive to resolve this situation. I described the position of the property owner and the administrative decision to allow him to close the 200 sq. ft. of roof that remained after Mr. Bivinetto alerted the City to this situation. I informed Mr. Bivinetto that he could apply for an over-the-counter Class A roof "covering" permit which would be issued immediately. I further reiterated my offer to contact contractors to purchase the wood shake material that he had purchased. His ultimate request was that the City should allow him to install a wood roof because he had purchased this material after talking to the contractor regarding its applicability in the City who was installing the wood roof under one of the erroneously issued permits. re a Printed on Recycled Paper. Page 2. On the whole, our conversation was nonproductive. I informed Mr. Bivinetto that it would better if he placed his comments in writing since my verbal descriptions of the above referenced cases and the Municipal Code requirements did not seem to satisfy his questions for at least a third time.
