Dear Mr. Cippola:
I am following up to a letter from the City Planning Director dated January 22, 2014 (copy attached) to
you regarding a code violation on your property. The code violation is access road work that was
performed at the rear of your property without required permits in early January of this year.
Since this initial notification you have informed the City by phone or email that you intend to not
only remedy the code violation matter but to also apply for a permit to construct a new barn. You
have advised the City that you have hired a civil engineer to assist with the access road application
and a building designer to assist with plans for the new barn. In my email to you dated May 27, 2014
(copy attached) you were advised of a timeline for processing the required planning applications. To
date the City has not received an application from you.
As you know, your property contains a natural canyon and "blue -line stream" which is protected
under State of California Department of Fish and Wildlife regulations. Failure to act in a timely
fashion raises concerns about possible disturbance to the stream due to erosion and sedimentation.
It is requested that you submit an application for a Site Plan Review minimally for the access road
portion of the work no later than 30 days from the date of this letter. We highly encourage that you
first submit a plan for preliminary review within 15 days of this letter for the pathway construction
work. Failure to file the necessary application(s) within the time frame as requested will result in this
matter being referred to the City Attorney's office for further follow-up.

As you know, it has come to the City's attention that you have cleared your
slopes from vegetation and created paths around the lower portion of your
property, in the canyon, to obtain access to that part of your lot.
Your property contains a natural canyon and a blue line stream, which is .
protected under the State of California Fish and Wildlife regulations. Any
construction and/or grading near the blue line stream constitutes a violation and
requires filing of a permit and obtaining permission from the department of Fish
and Wildlife.
In order to remedy the violation on your property there are two options for this
site.
First, if you would like to keep the walkways adjacent to the stream you must
prepare and submit grading plans to be reviewed and approved through the
Department of Building and Safety. As part of the process of obtaining approval,
the project would be referred to Fish & Wildlife in order to obtain approval from
them. There may also be landscaping and/ or retaining wall requirements in
order to stabilize the vertical cuts and denuded soil.
You will then obtain the grading permit and complete any remaining work
under the permit (from Fish and Wildlife and Building and Safety Department).
This does not include any requirements from the City. For example, if the
County or Fish and Wildlife require a wall, the Association and the City would
need to review it and approve it. If the wall would be in setback or over 3' in
height then the wall would need to go through the formal public hearing process
before the Planning Commission.

The second option would be to restore the site back to the original slope and
configuration. We would allow this to be done without formal approvals from
the Department of Fish and Wildlife, but this would have to be very carefully
done so as not to disturb the adjacent stream whatsoever. If in the process of
doing this work sediment gets pushed into the stream or any disturbance of the
stream is occurring then the job would be stopped and you would have to go
through the formal process described above, once again with Fish & Wildlife
approval.
In either of the two scenarios above, you should immediately hire a civil engineer
to advise you on which of the options you should undertake.
Please respond by. February 5, 2014 with the name of the company you hired
and which of the options you selected to correct the violation on your property.
We'll then set a schedule for submittal of the required plans and information to
the appropriate agencies.
We have a list of reputable engineers who have worked in the City on similar
projects for other property owners. If you need a suggestion, please contact me.

I've already emailed the name of the County Fire Department person who you should contact
regarding requirements they have for the barn. The following information is to give you more
overall guidance on the submittal and hearing timeline for your project. You may contact me if
questions.
Application packet: bundle together into one application: "Site Plan Review" required for the
barn construction and grading and grading for the back pathway and "Conditional Use Permit"
for a new barn and additional driveway to the barn (Code only allows one driveway serving a
residential site but can apply for a CUP if meeting certain criteria in RHMC 1.16.210). A
"Variance" will also be required for the additional barn driveway if you find it does not meet
criteria of section cited above.

Back pathway: Check with your civil engineer whether any retaining walls are needed within
the setbacks for the back pathway construction, because zoning code only allows walls in
setback that are < 3 ft and if determined to be required by the County drainage engineer.
(Ultimately the County drainage engineer will weigh in on this during plan -check, but your
engineer can check in advance with her to see if she knows now if retaining walls will be
needed at any location — see her contact info below).
Barn driveway: Any time a barn is proposed and the barn access, driveway or pathway is
going to require a new connection to the public roadway as is shown on the prelim site plan, the
city's Traffic Commission needs to review and approve that connection to the roadway. The
Traffic Committee meets every other month and their next meeting will be July 24th. That
hearing costs $300 and you apply by submitting a cover letter with check, and two sets of plans
showing the proposed access for the barn and plan should also clearly show the other existing
driveways. You should submit the driveway application by July 1, to be heard by the Traffic
Committee on July 24.

LICENSE AGREEMENT
THIS AGREEMENT made by and between ROLLING HILLS COMMUNITY
ASSOCIATION OF RANCHO PALOS VERDES, a non-profit California corporation,
sometimes hereinafter referred to as "LICENSOR" or "ASSOCIATION", and CHAZ B.
CIPOLLA, sometimes hereinafter referred to as "LICENSEE".
WITNESSETH:
RECITALS:
I
LICENSEE are the owners of the hereinafter described parcels of land situated in the
City of Rolling Hills, County of Los Angeles, State of California, commonly known by street
and number as 1 Middleridge Lane North, Roiling Hills, California 90274, and more
particularly described in Exhibit "A".
The above -described real property_ is under the control and jurisdiction of the
ASSOCIATION and is subject to the terms and conditions of that certain document entitled
"Agreement and Declaration No. 150 of Establishment of Basic Protective Restrictions,
Covenants, Conditions, Reservations, Liens, Charges and Certain Local Restriction?,
recorded May 14, 1936, in Book 14065, page 345, Official Records of Los Angeles County,
California. Said Agreement is sometimes hereinafter *referred to in this document as
"Declaration 150."

Declaration 150 reserved certain easements on, over, under, across and along all
strips of land described in said Declarations easements were reserved for roads, streets,
bridle trails, parkways, park areas, poles, wires and conduits for the transmission of elec-
tricity for lighting, hearing, powertelephone and other public utility purposes and the
necessary attachments in connection therewith; public and private sewers, storm water
drains, land drains and pipes, water systems, water, heating and gas mains, pipes and
other methods of conducting and performing any public or quasi -public service or function

beneath the surface of the ground. ASSOCIATION by the provisions of said Declaration
No. 150, has jurisdiction and control over said easements so reserved.

LICENSEE needs to make use of a portion of said easements for the purpose of
constructing and maintaining a white 3 rail fence in portions of the easements
owned by the ASSOCIATION; and the ASSOCIATION finds that the proposed use by the
Licensee of the portion of said easement, on a non-exclusive basis, is necessary; it will
enable LICENSEE to make better use of his property.
IT IS NOW, THEREFORE, AGREED FOR A VALUABLE CONSIDERATION, as
follows:
A. ASSOCIATION grants LICENSEE the right and privilege to utilize a portion
of the easement to construct and maintain a white 3 rail fence In the portions of
the easements owned by the ASSOCIATION, as depicted In Exhibit "B" attached hereto.
B. Except as provided for herein, this Agreement is subject to the condition that.
LICENSEE shall not, during the term hereof, make a use of the area above -described, in
such a way as to conflict with any of the Rules and Regulations of the ASSOCIATION, its
By -Laws, laws, said Declarations as the same are now constituted or as they may
hereinafter be amended or modified or changed.
C. If ASSOCIATION has reasonable need for the use of the easement the
ASSOCIATION expressly reserves the right to terminate said Agreement by giving the
LICENSEE (or his transferee) one hundred eighty (180) days' written notice of its intended
use of the easement and its intention to so terminate the Agreement and thereafter all
rights of LICENSEE (or his transferee) to use the real property which is the subject of this
License, described in paragraph A, shall immediately terminate and end.
D. In the event the Agreement has terminated for any of the reasons provided for
in paragraph C above, LICENSEE agrees to remove any obstruction or structure which
may have been constructed or which may have been extended into the area described in
paragraph A above, at LICENSEE'S own cost and expense; and if such structures or fences
are not so removed upon demand of the ASSOCIATION, then ASSOCIATION shall have
the right, within a reasonable length of time, after notice to LICENSEE (or his transferee),
to go upon said property and remove the same and the cost .of the removal incurred by
the ASSOCIATION shall immediately become a lien upon the real property described in
Recital I hereof, in favor of ASSOCIATION, to secure to it the payment of all sums of
money expended by the ASSOCIATION in connection with the removal of said obstruction
or structure as provided for herein.

Arbitration of Dispute.
Any controversy between the LICENSOR and LICENSEE arising between them out of
this agreement shall be settled by arbitration.
The arbitration shall be conducted in accordance with rules and procedures that are
fair and .reasonable to LICENSOR and LICENSEE. The American Arbitration Association
Commercial Rules of Arbitration in effect as of the date of this agreement shall be deemed
in compliance with this requirement.

You will then obtain the grading permit and complete any remaining work
under the permit (from Fish and Wildlife and Building and Safety Department).
This does not include any requirements from the City. For example, if the
County or Fish and Wildlife require a wall, the Association and the City would
need to review it and approve it. If the wall would be in setback or over 3' in
height then the wall would need to go through the formal public hearing process
before the Planning Commission.
