Dear Pete:
Thank you for informing me of your concern for the wall dividing
our properties. I examined the wall on 10-3-01.
At your request 10 years ago dense vegetation was planted and
approved by you on the upper slope side of the wall to provide
privacy between our homes. Through the years to ensure your privacy
I have maintained a sprinkler system in this area to keep this area
healthy and dense. This requires water. I have never had any part
of my system set for more than 10 minutes per cycle and generally
cycle every 2 days. However due to your continuing concern for the
wall, I will discontinue watering the phicus trees and other
vegetation directly between our homes. I suspect some plants will
die and some privacy will be lost.
Also 10 years ago I built a wall dividing my property and the
Watt's property next door. This wall has a deep steel reinforced
foundation, is constructed of builders block, has a rock facing
only, permits dainage from above, and has steel reinforcing the
full height. I suspect it will last forever because of it's design.
It has had water poured on it, around it, and upslope from it for
years and still appears the same. As you have noted the wall you
installed on your property has no foundation, no reinforcment with
steel, no builder block, and is just a rock wall rough set with
mortar. It has a limited life by design.
Water seems to be the primary concern for you. However when I
examined the wall yesterday I stepped into your yard after your
sprinklers had finished running and noted how saturated and soft
your ground was directly at the base of the wall particularily in
the area of greatest lean which is toward the front of your lawn.
Perhaps you are creating more of the problem yourself with the
excess watering of your newly installed lawn. A rock wall is
certainly not going to be able to stand up in mud.I would also ask
you to note the wall has its greatest lean in the area where I have
the greatest slope on my property to carry surface water to the
street. If water retention above the wall is the primary cause for
the lean why is it leaning the most in the area where no water can
be retained.
It would seem the problem is not a grading issue but rather an
issue with an aging improperly built wall. Your request in the
letter dated 9-20-01 that I reposition the wall is not one that I
can fullfill. As you are in the concrete business I am sure you are,
aware that request is not possible as the wall would fall apart if
there was any attempt to move it. I am not sure why you would make
the request.
When I moved onto this street 10 years ago the rock wall had been
in place for many years. It had a lean to it at that time which
does not appear any different now. I have tried to be a good
neighbor during these years and to be aware of your concerns. I
have enjoyed being able to wave and smile at all the people living
on the street. "Good" neighbors do that. But they don't send
threatening registered letters with impossible demands. They go and
talk to each other. I invite you to come and talk to me to see how
we can help each other as neighbors do.

Dear Dr. Moore:
During our telephone conversation yesterday, we discussed your
neighbor's complaint regarding construction completion and drainage
related to your property at 11 North Middleridge Lane, and any
drainage that might be directed towards his property at 15 North
Middleridge Lane, before the winter rains. County Building &
Safety Inspector Rafael Bernal and I investigated the complaint on
Tuesday, October 27, 1992.
It is my understanding that you are currently requesting bids for
landscaping and propose to award a contract within a month to
landscape and properly drain your front yard and the bank behind
your house that might undermine the lower retaining wall.
We also discussed removing the red "Juge" trailer across the road,
screening the pool equipment, and buffering the equipment noise.
The City appreciates your cooperation and your understanding of the
urgency and need to complete these projects in a timely manner.
We expect that you shall have awarded the landscaping contract and
that remedial work on the required landscaping, drainage, trailer,
pool equipment screening, and noise buffer will have begun by
November 28, 1992.

Dear Mr. Nealis:
I am writing regarding the construction taking place at 11 North Middleridge Lane.
I am concerned over the lax effort being made by Mr. Moore to complete his
grading before the fall and winter rains strike.
The remodeling of his home has taken approximately two years. I have had
numerous problems last year with rain run-off, from his property onto mine. I do
not want to be confronted with the same problem again this year.
I have spoken directly with Mr. Moore regarding the grading of his property. Two
weeks have now past and nothing has been done. I want to bring this to your
attention. The following is list of items that need to be dealt with quickly:
• Grading - His property needs to be graded before any rain hits. If it is not
graded, the rock wall separating our properties may collapse.
• Run-off - The run-off from Mr. Moore's property flows directly onto mine at the
rear of my house near my barn.
• Garbage bin - The unsightly garbage bin in front of his house should be
removed by now. At this phase of construction, a garbage bin of this size is
unnecessary.
• Pool equipment shed - Mr. Moore needs to enclose his pool equipment to keep
the noise level down.
These are major problems that need to be dealt with immediately. I would like to
see the city take necessary action.
