During this period of construction, because it has not been an inconvenience for us to do so, we have allowed you to use that corner of your driveway which encroaches on our property. Surely you know the area of encroachment given that it has been marked off by our surveyor with stakes and other markers. However, as our construction activity progresses, we anticipate that there will come a time in the near term when it is no longer convenient for us to allow your driveway encroachment across our shared property line. For the time being, in the spirit of being good neighbors, we will continue to allow you to use the corner of your driveway that encroaches on our property. However, we want you to be aware that our permission of your continuing use and encroachment is revocable at any time. Indeed, it is likely that it will be necessary for us to revoke our permission to you to use our property sometime, in the next month or two. Given the relatively small area of our property that is encroached upon by your driveway, we seriously doubt that our revocation of permission will cause you any inconvenience. We'll let you know when we intend to complete our landscaping and driveway; it is at that time that we will retake for our own use that small area of our property which presently forms the southwest corner of your driveway, as indicated by the surveyor's stakes and markers. We have spent a great deal of money for engineering, grading and drainage to comply with Los Angeles County erosion control. However, the plan will not work because your drainage is improper and insufficient and currently, it is illegal because you have a major drain that empties onto our property near our driveway. The drain we are talking about is the one at the end of your driveway near your garage. The drain faces our property and the water shoots out and is funneled directly onto our graded area. You need to have a drain pipe connected to this drain in an "L" and continue the drain down your own property. Our best advice is to hire an engineer, someone like South Bay Engineering in order to resolve your problem. This problem, plus the flooding you experienced in your house two years ago, should raise your concern to have these drainage problems fixed as soon as possible. If this problem is not fixed before the rains, you could be held liable for erosion on our property.
