Dear Mr. McHattie:
Thank you for your letter of April 23, 1997, requesting modification of the existing
Stop Work Order at the subject site to (1) Backfill the stable retaining wall using
gravel and dirt from the site and (2) Complete the septic system.
We have reviewed these two requests with County Senior Building Engineering
Inspector Rafael Bernal and determined that modification of the Stop Work Order
can only be strictly limited to your first request to backfill the stable retaining wall
utilizing gravel and soil existing on the property.
The second request for completion of the septic system is not authorized at this time
because a septic system requires percolation tests, a Sewer Permit and "as graded"
plans for the County.
As we have stated in a letter addressed to the applicant, Mr. Bernard Howroyd, and
copied to you, the Planning Commission will review and consider a draft
resolution, together with conditions of approval at the Commission's regular
meeting at 7:30 PM on May 20, 1997. The final draft resolution will be forwarded to
Mr. Howroyd and you before being signed by the Planning Commission and City
Clerk. That action accompanied by the record of proceedings before the
Commission, is tentatively scheduled to be placed as a report item on the City
Council's agenda at the Council's adjourned regular meeting on Tuesday, May 27,
1997.
You should also be aware that although we are allowing the Stop Work Order to be
modified in a strictly limited manner, any continuation of grading within the
permitted grading authorized under the original Site Plan Review approval is all

that is permitted and authorized at 7 Maverick Lane. We understand that the
current application seeks approval for an "as graded" condition that exceeds the
original approval. The current application process is not yet complete and you must
understand that any grading beyond the original approved plan may be subject to
amendment and may be required to be returned to the original approved
configuration and the imported soil may be required to be removed from the site.
Any grading that is done will be at the owner's risk. Although the owner is n o t
precluded from submitting a revised grading plan to the County for plan check, any
such approval will not be effective until the City's own approval process is
complete.
Once again, the Stop Work Order is strictly limited to construction of the stable wall,
including gravel and soil backfill that utilizes soil existing on the property. The
owner is not authorized to complete any other work or import any soil to the
property. The Stop Work Order for all other building and grading work remains in
effect.

This request is a follow up to your letter of February 7, 1997 in which you state that the
retaining wall should be finished. Rafael Bernal inspected the subdrain behind the walls, and
approved it. At this time, we will perform the backfilling of the wall using gravel and dirt from
the site.
In addition, it would be expeditious to complete the septic system at this time, as the process
will generate dirt that can be used as backfill; ultimately making it disappear.
In the event that the pad, as it exists, was required to be changed, it would not affect the septic
system„ The cess pool is located in a natural grade area; an area that has not, or will not, be
touched. The septic tank, which is located adjacent to the wall is also in an area that could not be
affected by any remedial grading.

Plan Review approval and a Variance for the importation of soil associated with the

a barn. We are evaluating your applications and anticipate that your case will be
presented to the Planning Commission on March 18th, 1997.
We have reviewed the correspondence dated February 6, 1997 which was submitted

By copy of this letter, we are requesting that the County of Los Angeles issue a "Stop
Work Order" for any additional grading and building work on the premises at 7
Maverick Lane. This request follows the City's prior letters, dated December 6 and
17, 1996, asking you to submit "as graded" grading plans for the site showing the
importation of a maximum of 130 cubic yards of soil from the Hao property at 5
Sagebrush Lane (Lot 100-A-3-RH) to your lot at 7 Maverick Lane (Lot 28-SK). Those
plans were not received by December 27, 1996 as requested in our December 17, 1996
letter.
This request to the County is for the County to apply the provisions of the Uniform
Building code which allow the Building Official to stop work on a project when
there is evidence that the project is not being implemented in accordance with
approved plans (Uniform Building Code Section 104.2.4). The City's approval of the
project was based upon a site plan that showed no importation of soil. The City
Manager subsequently authorized the importation of a maximum of 130 cubic yards
of soil, in accordance with the authority provided by Section 15.04.150 of the Rolling
Hills Municipal Code. We have subsequently received several complaints and
reports from citizens indicating that up to 10 times the approved amount may have
been transported onto your property from the Hao's property. Thereafter, we
requested preparation of "as graded" grading plans to indicate the total amount of
soil imported. Those "as graded" plans have not been forthcoming and has led to
the need to stop construction to further evaluate the status of the alleged violation
of the approved site plan.

Thank you for your letter dated September 19, 1996 requesting to export 240 cubic
yards of soil from the Blazevich job site at 1 Buggy Whip Drive. The letter appears
to satisfy the reasons why soil needs to be imported at 7 Maverick Lane and the Hix
Ring. However, you have not submitted any evidence supporting the need to
export the soil from 1 Buggy Whip Drive as required pursuant to Section 15.04.150 of
the Municipal Code (enclosed). Therefore, your request is denied at this time.
In order to consider your request for approval, you must comply with the
provisions of Paragraph 3 of Section 15.04.150 of the Rolling Hills Municipal Code
which provides an exception to the balance cut and fill ratio requirement.
Conditions which must be met include:
a. construction of the structure on the lot or parcel has commenced.
b. that the need to import or export soil could not have been foreseen prior
to commencement of construction and
c. that either the structure cannot be completed without the requested
import or export of the soil or that the emergency condition exists due to
the threat of land subsidence or other eminent danger.
Until the provisions of Section 15.04.150 are satisfied, and approval is granted by the
City, you are not permitted to export any soil from 1 Buggy Whip Drive.

the Building Code, entitled "Excavations," is amended to
add subsection 7015.4 to read:
7015.4 BALANCED CUT AND FILL RATIO.
1. No export or import of soil shall be permitted
from or to any lot in the City.
2. No grading plan for which a permit is required
shall be approved unless the amount of soil to be cut
from the site equals the amount of soil to be filled
on the site.
3. The City Manager may grant an exception to the
requirements of parts 1 and 2 of this paragraph (d) to
allow for the import or export of soil not to exceed
500 cubic yards if he or she finds, based upon written
reports and other information submitted, that all of
the following conditions are present: (a) construc-
tion of a structure on the lot or parcel has com-

Maverick Lane.
At this time I am requesting that we be allowed to export the allowable maximum of 500 cubic
yards of earth from the Blazevich property.
In as much as we have already moved 260 cubic yards to complete the Hilliard job, this would
leave 240 cubic yards that we would be allowed to export.
There has been an urgent request from the Caballeros to obtain dirt to finish the Hix ring.
I am estimating 110 cubic yards would complete that task. The remainder, 130 cubic yards, be
used to finish the Howroyd project as requested in the AGI letter, which is enclosed.

During my observations of the grading operations on the slope behind your residence, it is
obvious that the soil being placed is taking a tremendous shrink. This is not an uncommon
occurrence in this area and can generally be remedied with the importing of soil from another
local project. Since all of the criteria for your project is predicated on the pad reaching proposed
design elevation, and the high shrinkage factor is making that unlikely, you may be needing soil.
As luck would have it, a recent backfill design criteria change for the basement walls at
# 1 Buggy Whip Drive, here in rolling hills, allows you that opportunity.

AN APPEAL OF A PLANNING COMMISSION DENIED REQUEST FOR A VARIANCE TO
CONSTRUCT A GARAGE IN THE SIDE YARD SETBACK IN ZONING CASE NO. 497.
BACKGROUND
1.
The City Council viewed a staking of the proposed project on
December 11, 1993.
2. The Council requested that staff show the setbacks and
easements and distance of the existing buildings and their
distances to the adjacent property to the west (Brogden).
Attached is an enlarged drawing showing that the Howroyd
residence is approximately 28 feet from the property line at
the front portion of the west side yard and approximately 21
feet from the property line at the rear portion of the west
side yard. The wall in the Howroyd's side yard near the rear
portion of the west side yard is approximately 3 feet from the
rear of the garage and continues 18 feet to the property line.
The Brogden house is 15 feet from the property line. The
Brogden house encroaches 20 feet into the 35 foot side yard
setback and is approximately 43 feet from the Howroyd
residence and 37 feet from the brick wall at the Howroyd
residence at the front portion of the lot.
3. A Table documenting Planning Commission Action for the 10
existing residences on Maverick Lane is attached.
4. The applicants are appealing a Planning Commission denied
request for a Variance to construct a garage addition into the
side yard setback as delineated on the attached appeal form.
The Planning Commission did approve Site Plan Review for a new
stable with loft and corral area in a separate resolution.

This action was received and filed by the City Council on
September 13, 1993.
5. The Planning Commission approved attached Resolution No. 93-28
denying the Variance to construct the garage in the side yard
setback on September 7, 1993.
6. The applicants requested Site Plan Review for a 1,294 square
foot stable with loft and corral area that requires grading.
During the public hearing process, another application was
duly filed requesting a Variance to construct a 540 square
foot garage that would encroach up to 14 feet into the 35 foot
side yard setback on the separate residential building pad.
7. The Planning Commission approved the stable with loft and
corral area that requires grading but, denied the Variance for
a garage addition in Resolution No. 93-28 for the following
reasons: (1) the existing house includes a garage which has
been illegally converted to residential living space, (2) the
building pad coverage for this project would be 84.2% which
the Planning Commission found excessive and exceeds the
building pad coverage of most properties in the vicinity, (3)
additional encroachments would exacerbate the amount of
residential structure within setback areas, and (4) the
proposed project does not minimize structural coverage on the
pad, leaving little open space between property lines and
would result in further overdevelopment of the building pad.
8. The Site Plan Review approving the proposed stable requires
that the existing garage which has been converted to
residential living space to be reconverted to a garage to the
satisfaction of the Building Official and the Planning
Department prior to the issuance of a grading or building
permit for the approved stable and corral from the County of
Los Angeles.
9. The structural lot coverage approved is 5.9% and the total lot
coverage approved is 9.6%. (The proposed structural coverage
with the garage denied by the Planning Commission was 6.9% and
the total lot coverage proposed was 14.7%).
10. The proposed stable pad coverage is 28% and existing
residential pad coverage is 70.5% for a total pad coverage of
54.3%. (The proposed residential pad coverage with the garage
denied by the Planning Commission was 84.2% for a total pad
coverage of 63.5%).
RECOMMENDATION
It is recommended that the City Council review the proposed plans,
open the public hearing, and take public testimony.

The Howroyd's request for a side yard building setback encroachment should be granted
because of exceptional conditions to the property. Maverick lane is a very unusual road in
the city of Rolling Hills in that the properties on the west side of the road are zoned RAS.1
and the properties on the east side, (the Howroyds are on this side), is zoned RAS•2. The
more restrictive side yard setbacks the Howroyd's have to respect, (RAS•2 zone), are less
for their neighbors in the RAS•1 zone, who ironically have wider properties. Therefore, the
Howroyd's property is being denied rights possessed by other properties in the same
vicinity.
It is also interesting to note that many homes built on Maverick Lane currently have
encroachments into side yard setbacks.

RESOLUTION NO. 93-28
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING
HILLS DENYING A REQUEST FOR A VARIANCE TO CONSTRUCT AN
ATTACHED GARAGE IN THE SIDE YARD SETBACK TO AN EXISTING SINGLE
FAMILY RESIDENCE IN ZONING CASE NO. 497.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1., An application was duly filed by Mr. and Mrs.
Bernard Howroyd with respect to real property located at 7 Maverick
Lane, Rolling Hills (Lot 28-SK) requesting Site Plan Review for a
stable with loft, and corral area that requires grading. During
the public hearing process another application was duly filed
requesting a Variance to permit the construction of an attached
garage in the side yard setback to an existing single family
residence and convert an existing attached garage to residential
living space on an upper pad separate from the lower stable pad.
Section 2._ The Planning Commission conducted a duly noticed
public hearing to consider the application for Site Plan Review on
May 18, 1993, and June 15, 1993. The Planning Commission conducted
a duly noticed public hearing to consider the applications for Site
Plan Review and Variance on July 20, 1993 and August 17, 1993, and
at a field trip visit on August 10, 1993. The Planning Commission
approved the Site Plan Review for a stable and corral on a lower
pad pursuant to Resolution No. 93-27.
Section 3._ The Planning Commission finds that the project is
categorically exempt from environmental review under the California
Environmental Quality Act pursuant to a Class 3 exemption provided
by Section.15303 of the State CEQA Guidelines.
Section 4. Section 17.38.010(A) permits approval of a
Variance from the standards and requirements of the Zoning
Ordinance when exceptional or extraordinary circumstances
applicable to the property and not applicable to other similar
properties in the same zone prevent the owner from making use of a
parcel of property to the same extent enjoyed by similar
properties. A Variance to Section 17.16.120(B)(1) is required to
construct a garage addition to the residence in the thirty-five
(35) foot side yard setback. The applicant is requesting a garage
addition that will encroach up to a maximum of fourteen (14) feet
into the side yard setback. The Planning Commission finds:
A. There are no exceptional and extraordinary circumstances
and conditions applicable to the property and the intended use that
apply generally to the other property in the same vicinityand
zone. The Variance is not necessary because the existing house
includes a garage which has been illegally converted to residential
living space and the building pad coverage for this project on the
upper residential pad would be 84.2% which the Commission finds
excessive and exceeds the building pad coverage of most properties

in the vicinity so that the proposed expansion is not appropriate
for the property.
B. This Variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by other
• property in the same vicinity and tone, but which is denied to the
property in question because approximately two-thirds of the
present house encroaches into the front and side yard setbacks and
additional encroachments would exacerbate the amount of residential
structure within setback areas.
C. The granting of this Variance will be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity or zone in which the property is
located because the proposed project does not minimize structural
coverage on the pad, leaves little open space between property
lines and would result in further overdevelopment of the building
pad. This would make the proposed garage structure more visually
prominent on the building pad than appropriate for the existing
development pattern of the City.
Section 4. Based upon the foregoing findings, the Planning
Commission hereby denies the request for a Variance approval for
the construction of a new garage in Zoning Case No. 497.

At the regular City Council meeting held Monday, November 8, 1993, City Councilmembers
directed staff to continue the public hearings scheduled for Zoning Case No. 480 (WACHS),
6 Outrider Road and Zoning Case No. 497 (HOWROYD), 7 Maverick Lane beyond the
originally scheduled field trip date of Saturday, November 13, 1993. Although technically
we will still need to advertise that adjourned public hearing field trip for Saturday,
November 13, 1993, a quorum of members of the City Council will not be present and,
therefore, these hearings will be continued to the regular City Council meeting to be held
Monday, November 22, 1993 with the intent of selecting a new field trip date at that time.
Please communicate any suggestions to this office prior to November 17, 1993 as to what
dates would be most acceptable following the Thanksgiving Holiday to conduct these field

Regarding: Scheduled field trips for Howroyd and Wachs appeals
Dear Mayor Murdock,
I realize that it is difficult to choose a field trip date taking into account all 5 members of the city
council. Unfortunately, I have a conflict that I can not reschedule. My family has the weekend of
November 13th planned to celebrate thanksgiving out of town with my sisters. It would be
impossible for me to attend the field trip and be with my family.
I have spoken with both the Howroyd's and the Wach's on this matter. They have no objections to
rescheduling the field trip for a date after thanksgiving. May I also suggest the possibility of an early
morning weekday field trip.
