Having a violation on the property will limit the Association's ability to sign off on any new construction and should be disclosed to potential buyers during escrow. The following is the list of violations we have for the property: • Unpermitted pool house with rooftop deck, • Unpermitted fence and replacement vegetation in roadside easement, 2010 • Unpermitted replacement fence in westerly easement that encroaches into neighboring property, 2011 • Shed that was repaired & possibly enlarged in westerly easement that encroaches into neighboring property, 2011 • Unpermitted fence in easterly easement that encroaches into neighboring property (unclear whether or not it was replaced at the time of westerly fence replacement), • Unpermitted grading and new retaining wall on lower portion of property, 2006/2007 • Unpermitted trellises around residence, 2008-2011 To resolve the architectural violations, please submit "as -built" plans and photos of the new construction for Architectural Committee review. Architectural Committee meetings are held on the first and third Tuesday of each month. Please submit plans and a completed Application for Plan Check by the Thursday prior to the date of the meeting. To resolve the easement violations, you may relocate all the easement encroachments to outside the easement, remove the items completely or you may request a license agreement from the Board of Directors to use that portion of the easement and maintain those items in the easement. It is also helpful to submit photos or even a survey of your property with the location of encroachments indicated. Please submit the completed application and any related documents to the Association office by the Thursday prior to the meeting. Board meetings are held on the first and third Thursday of each month. Once the Board receives your request, they will schedule a field trip to view the property. Property and easement lines must be staked at this time. Following the field trip, your request will be placed on the next agenda for discussion and possibly a decision. It is always helpful that you or your representative is present at both the field trip and the Board meeting. If a license agreement is granted, the homeowner is responsible for the legal and recording fees for the license (approximately $450) as well as $250 administrative fee that is charged for as -built or as - planted conditions. There is no fee if the fence and vegetation are removed from the easement. Enclosed is copy of the Application for License Agreement Review, the Association's easement guidelines and policies, a copy of Resolution 192 "Granting Licenses for Use of Easements", a copy of the Application for Plan Check and the RHCA Building Regulations regarding sheds. As per the Inspector's requirements, you must obtain a plumbing, electrical and gas permit for the work done on the cabana and the fireplace. Please obtain these Hermits by THURSDAY. MARCH 1. 2007. In addition, after you resolve the roof issue with the Rolling Hills Community Association, you will be required to obtain a roof and windows change out permit. We will get back to you on the pool retrofit requirements for the anti -entrapment device. We have also observed that the eave lights on the cabana need to be changed to maximum 40 watts each. I am enclosing a copy of the City's Lighting Ordinance for your reference. Please assure that all the lights on your property adhere to these standards. I have also notices some dirt movement/slope cut on your property. Please be advised that pursuant to the City's Building Code, with some exceptions, any cut into the hill of 3 feet or higher, any fill of dirt of 3 feet or higher OR disturbance of dirt consisting of 2,000 square feet or more of surface area is considered grading and require permission from the Planning Commission, under a Site Plan Review process, (public hearing), and a grading permit. Should the work exceed these thresholds, please contact the City for instructions on how to file a request for a Site Plan Review. In addition, any walls on a property exceeding 3 feet in height require Site Plan Review approval. I am enclosing a copy of the pertinent code sections for grading. Printed on Recycled Paper • • Sincerely lanta Schwartz Planning Director cc: Julie Roberts, RHCA Rafael Bernal, Los Angeles County Building and Safety ANORDINANCE OF THE CITY OF ROLLING HILLS ESTABLISHING OUTDOOR LIGHTING STANDARDS AND AMENDING TITLE 17 (ZONING) OF THE ROLLING HILLS MUNICIPAL CODE ORDINANCE NO. 287 The City Council of the City of Rolling Hills does hereby ordain as follows: Section 1. Findings. The residents of the City of Rolling Hills treasure its rural environment. As is set forth in the City's General Plan, the Council finds that the rural environment is characterized by natural light, and is degraded by artificial illumination at night. Nighttime darkness throughout the City contributes significantly to the uniquely tranquil rural environment, creates a more natural setting for wildlife that inhabit the area, enhances the quality of life and adds to property values. For the foregoing reasons, the City provides no roadway illumination and encourages residents to minimize the illumination of their properties to avoid light spillage onto neighboring properties, easements and roadways. The outdoor lighting standards adopted herein serve to advance the foregoing goals and further public health, safety and welfare. Pursuant to authority and criteria contained in the California Environmental Quality Act (California Public Resources Code Section 21000 ete seq.) ("CEQA") and the CEQA Guidelines (California Code of Regulations Section 15000 et seq.), planning staff analyzed the proposed ordinance and concluded that the ordinance will not have the potential to cause a significant effect on the environment. Based on this finding, planning staff has determined that the proposed ordinance is categorically exempt from the requirements of CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines. The City Council has reviewed the proposed exemption and finds that it represents the independent judgment of the City and complies with the requirements of CEQA. Based upon this finding, the City Council finds that the proposed ordinance is categorically exempt from CEQA in accordance with the CEQA Guidelines. Section 2. Paragraph D. of Section 17.16.150 of Chapter 17.16 of Title 17 of the Rolling Hills Municipal Code is amended in its entirety to read as follows: "D. Walkways, steps, mailboxes and irrigations systems are permitted in any yard area." Section 3. Section 17.16.190 of Chapter 17.16 of Title 17 of the Rolling Hills Municipal Code is amended by adding thereto a new paragraph E. to read as follows: E. Outdoor lighting. Outdoor lighting is prohibited except as provided below: 1. Lighting is permitted along pedestrian pathways for the purpose of providing safe passage. Bulbs used in such lighting shall be non -reflective and shall not exceed the wattage of a forty (40) watt incandescent light bulb to a maximum of 400 lumens, or their equivalent if non -incandescent lighting is used. Lighting fixtures shall accommodate only one bulb, shall incorporate shields to cast light downward, shall be spaced no closer than twenty (20) feet apart, and shall be no higher than 18 inches from grade to the top of the fixture. In no event shall light from such fixtures be cast upward or off the property. 2. Security lighting is permitted, provided that in no event shall a security light be set to shine for longer than five minutes following activation. 3. Temporary lighting is permitted for holidays and for special events. 4. Entry post lighting is permitted at the foot of a driveway provided that lighting is cost downward and does not spill onto the roadway. Bulbs used in such lighting shall be non -reflective and shall not exceed the wattage of a forty (40) watt incandescent light bulb to a maximum of 400 lumens, or their equivalent if non -incandescent lighting is used. 5. Lighting that illuminates porches and entry ways into buildings is permitted. Ordinance No. 287 - I - • 15.04.100--15.04.120 shall serve as the Building Rehabilitation Appeals Board and the City Manager shall give notice of sub- standard property and buildings, consulting with the City Engineer as deemed necessary. Notwithstanding the provisions of Section 15.04.010, Section 1503 of the Build- ing Code is amended to read: Section 1503: Roof Covering Requirements. Roof covering for all buildings shall be Class A (having satisfied the fifteen -year weathering test and certi- fied as such by Underwriting Laboratories or an equiv- alent recognized testing agency), except that any new addition or reroofing of structures may match existing roof coverings if not exceeding 200 square feet. Roof coverings shall be securely fastened in an approved manner to the supporting roof construction and shall provide weather protection for the building roof. (Ord. 277-U §1(part), 1999). 15.04.110 Section 3403.9 added. Section 3403 of the Building Code is amended to add a new subsection 3403.9 to read: 3403.9 Roof Repairs. Not more than 200 square feet of the roof covering of any building or structure shall be replaced in any 12 month period unless the roof covering is made to conform to the requirements of this Code for new buildings or structures. Section 7003 of the Building Code, entitled "Grading Permits," is amended to revise subsections 7003.1(1) and (11) to read: Section 7003.1: A person shall not perform any grading without first obtaining a grading permit to do so from the Building Official. A separate permit shall be obtained for each site. EXCEPTIONS: A grading permit shall not be required for: (1) An excavation and/or fill or a combination thereof which is less than three feet in depth below the existing ground surface, provided that said exca- vation and/or fill or combination thereof which is less than three feet in depth does not cover more than 2,000 square feet of existing ground surface. 171 (Rolling Hills 11/99) \I0\c \r\ C� Dear RHCA and The City of Rolling Hills To whom it may concern: During the past several weeks, I've been hearing a lot of loud pounding hammer noise type work at either 44 or 46 Eastfield Drive. I've noticed several cars parked on the Eastfield Drive roadside area which is a very dangerous curve. Also, I have noticed that work has tempered off at 44 Eastfield and the construction fence has been closed. I was curious to know if any other neighbor is performing work in the area and have they obtained any permission, authorization or the necessary permits to perform whatever work is going on! Over the past year, I have noticed A LOT of construction work going on Eastfield Drive. I know the lots vary in size in that area but, some are also very small on the Eastside of the City. I'm just very concerned that Rolling Hills Eastfield Tract lots are getting crammed with over development! Eastfield area is quite fragile. I would really like an inspector or Rolling Hills City Planner and County Building Inspector to review and construction permits in the vicinity of 44 and 46 Eastfield Drive!
