SUBJECT: SPECIAL PERMIT #4; Request for a mobile trailer for temporary
use; 68 Portuguese Bend Road South, Lot 31-FT;
Owner: Mr. Damoder Reddy
DISCUSSION
The City is in receipt of a written application from Mr. Damoder Reddy,
owner of property located at 68 Portuguese Bend Road South and identified
within the "Flying Triangle" landslide hazard area, requesting permission
to use a mobile trailer on the site while the existing residence is being
repaired of damage resulting from land movement. The applicant, unaware
of City requirements, has placed a trailer on the site, and was placed on
notice by the City. The Ordinance outlines the minimum application
submittal requirements to include a site plan, an engineer's or architects
report describing the damage to the primary residence, and a report by a
licensed geologist stating that the placement of the mobile trailer on the
property will not aggravate the existing slide or cause a safety hazard.
Upon advisement from the City Attorney's Office, Staff received the
application and statement of owner, who is also a registered civil
engineer, indicating that, based upon his professional opinion, his
evaluation of the site and load of the trailer would be able satisfy the
requirement of the geologist's report. The City Attorney further stated
that it would be the discretion of the Commission to request any
additional information.
Upon making the following affirmative findings, the Commission may grant
approval of the special permit for a period not to exceed 12 months and
future extensions can be considered:
1. There is a presently occupied primary residence on the property
which has been rendered uninhabitable by an active landslide.
2. Placement of a mobile trailer on the property will not create a
geologic hazard or otherwise be detrimental to the public health, safety
and welfare.
3. The applicant has presented facts demonstrating a necessity for
temporary alternative living arrangements during the pendency of an active
landslide.
In reviewing the applicant's request, staff would note consideration of
concern for potential impacts of the trailer to the abutting property down
slope from the subject site.
RECOMMENDATION
Staff would recommend that the Planning Commission closely examine trailer
placement and potential impacts in accordance with zoning requirements.
The Commission should receive public testimony and continue the matter to
a field inspection of the site and surrounding properties.

DISCUSSION
The Planning Commission, at their regular meeting of June 19, 1990,
continued the above -stated application to an adjourned meeting so as to
conduct a field inspection of the site and surrounding properties. At the
field visit, it was noted that the applicant is requesting permission to
retain the "as -placed" mobile trailer for temporary use while the existing
residence is being repaired from resulting damage due to land movement.
Issues to be addressed from the previous meetings are as follows:
1. It would be the discretion of the Commission to require a geologist's
report or accept the applicant's professional opinion as a civil engineer
regarding the placement of the trailer relative to land movement impacts
and safety hazards.
2. Potential land movement and visual impacts to the abutting property
down slope from the trailer.
The Commission must determine findings, as outlined in the Section
17.16.010 (D) (3a-c), before the special permit can be granted. Should
the application be approved, staff would recommend those conditions also
specified in the code, including that the owner shall enter an agrreement
holding the City harmless for any liability that may result from placement
of the trailer on the site.
RECOMMENDATION
The Commission may grant approval of the special permit if it is able to
make affirmative findings as outlined in the Ordinance. The City has, in
the past, approved similar requests in the Flying Triangle Slide Area.
Staff is of the opinion that the required findings can be made to support
the request.
