As discussed with Art, there is a broken connection in this drain that needs to be fixed. The, drain was constructed by a previous property owner of your property and it is your responsibility to maintain it in proper working condition. As you requested, the Association, City and County Building and Safety have reviewed their records to determine if this particular drain is the maintenance responsibility of any of these entities. At the same time, the Rolling Hills Community Association has been reviewing the case. We also talked with Mrs. Walton about the five (5) alleged zoning violations that you reported on her property. The duties and obligations of the City of Rolling Hills and the Community Association are totally separate and distinct. It is our understanding that the Board members of the Community Association addressed and provided a response to you under separate cover regarding the Walton's concrete slab, the horse corral and the plantings. Regarding your assertions that a sports court was constructed, the barn was converted and the retaining walls exceed three (3) feet in height: • Sports court: "Recreational game court" means a tennis court, racquetball or squash court, or any other fenced, enclosed, paved or hard -surfaced area used for private recreational purposes (Section 17.12.180 of the Rolling Hills Municipal Code). The City does not consider the irregular area between the stable and residence as a sports court. • Barn: The City will be inquiring about the possible conversion of the barn to another use by the Waltons and you will be informed of any action. • Retaining wall height: Mrs. Walton asserts in the attached letter that the old wall of railroad ties was replaced with a cement wall. The City does not have height limits for retaining walls except for the height of walls next to game courts which may not exceed 4 feet in height. It was agreed by the Board that the cement be cut back from the MacLeod property plus a reasonable additional amount to provide planting to serve as a screened barrier between the two properties; the Landscape Committee to visit the site to assist you in selection of planting for the screening. A License Agreement is required for the planting and screening located in the 10' easement. If the cement removal and con- formance with the Landscape Committee recommendations are not made, the entire easement will be cleared and returned to its natural condition. The Board also agreed that the temporary extension to the three rail fence now used for a dog enclosure could remain; however, in the event the property is sold by your family, the top rail should be removed and the traditional three rail fence be restored. The changes made to the property directly affect us, and to our knowledge have been made without any neighborhood input. We believed these items were in discussion with the Community Association and/or the City. However, now that the property is up for sale we are concerned they will simply be passed along to the new owner, and are likely to become faits accompli for the neighborhood. Therefore, we feel it would be prudent for the City and Association to address these concerns and have them be corrected prior to the sale of the house to new owners. 1. A concrete slab was poured halfway around the Walton's former barn. The slab extends at least six inches over our property line, without our permission, and also covers the property's setback and easement areas. We understand that to pour concrete slab in a setback area requires a City variance. Further, the slab extends several feet away from the barn in every direction, and is being used as a recreational game court, which requires a conditional use permit from the City. We hear the ball playing easily from our children's bedrooms twenty feet away. It is also our understanding that to cover an easement area with concrete requires a Community Association permit. What happened to the required review processes? 2. The former horse corral has been made into a dog pen, housing the Walton's two Labrador retrievers. A fence was built that is approximately six feet high instead of the approved four foot height. No public hearing occurred prior to its construction. Also, the corral extends to the property line, which clearly violates the Association's building regulations which state that "all corrals must be located ... not less that 25 feet from any property line." We would like the corral fencing to be removed. 3. There are no plantings whatsoever along the side of the Walton's yard facing our home. In order to preserve our privacy we have been forced to plant copiously in our easement (for which we obtained a Community Association permit three years ago). Both Association and City Building Regulations provide that recreational game courts shall be adequately screened on all four sides. However, the Walton's slab extends right over our property line! • • 4. The former barn was converted to another use about a year ago, with no other provision for horses made that we are aware of. The barn doors were removed, windows installed, and the structure clearly can no longer accomodate a horse. However, when we asked why a concrete walkway had been poured along the property line, we were told that it was to be "an access to the barn." 5. High retaining walls (clearly over three feet) appear to have been constructed in at least two locations in the rear yard. The concrete pool decking was massively increased last summer. The decking even cantilevers out over the rear yard. We believe that the percentage of building pad coverage is much too high on the Walton's property. We were under the impression that this style of construction was not welcome or allowed in Rolling Hills. Certainly, it violates the intent of the city. We are forced by the lack of adequate plantings along the Walton's side of the property line to view these recent additions —white concrete decking, decking supports, walls, slabs, gas heaters, umbrellas, etc. --from our bedrooms, kitchen, living room and front porch. We would like answers to the many concerns we have spelled out in this letter, and would like the Walton's to immediately remove all concrete that they have placed on our property, and all corral fencing along the property line. Further, we believe we have a right to our neighbors being required to provide a suitable landscaped buffer, to shield from our view the stark white surface of concrete with which they have covered their yard. The subject addition in a part consisted of enclosing existing roofed over porch of approximately 200 sq. feet and a new construction, requiring new roof covering of approximately 190 sq. feet. The necessary inspections were performed during the construction phase to ensure compliance with applicable code regulations. As permitted by the Section 15.04.080 of the Municipal Code of the City of Rolling Hills, and as requested by the owner, the roof covering over new addition was allowed to match existing roof covering, since it was less than 200 sq. feet.
