SUBJECT: CITIZEN CONCERNS REGARDING TENTATIVE PARCEL MAP
APPROVED AT 34 CREST ROAD EAST
Dear Mrs. Fournier:
Thank you for your letter about your concerns regarding the location of a future
stable at 34 Crest Road East that has been approved for a tentative parcel map and
the resident approval system for subdivisions.
While space for a stable and corral are required to be shown on a tentative
subdivision plan, there is no requirement that a stable and corral be constructed at
all or that they are to be located at the exact place as shown on the tentative parcel
map. In fact, should a new residence be proposed, the project would come under
Site Plan Review by the Planning Commission and public hearings would be held.
According to the Zoning Code, stables must be located at least 25 feet from any
property line and 35 feet from any residential structure. We will also flag the file for
34 Crest Road East as well as the Subdivision file and place your letter and a copy of
this letter within to notify you/or the current owner at 30 Crest Road East should
stable plans be submitted.
Subdividing within the boundaries of the City of Rolling Hills is governed by the
State of California's Subdivision Map Act and Title 17 (Subdivisions) of the Rolling
Hills Municipal Code. The review of subdivisions includes design, improvements,
and conformance with the City's Zoning and Building Ordinances that are
conducted during noticed public meetings.
But, the City of Rolling Hills does not require adjacent neighbors to approve the
granting of a subdivision. It is the Rolling Hills Community Association, a private
corporation, that requires the approval of adjacent neighbors of a subdivision. As
such, we shall forward your letter to Mrs. Peggy Minor, Association Manager.
Again, thank you for putting your concerns in writing. Please let us know if you
would like to discuss this further or perhaps, desire us to visit your property to
review your particular lot configuration.

I have recently been made aware of some of the changes that are presently being discussed
regarding the potential subdivision of the property owned by Mr. and Mrs. Occhipinti, 34 Crest Road
East. It has been brought to my attention that their new plot plan shows a stable being located at the
northwest corner of what would be their new lot configuration at the 34 Crest Road East address
should the subdivision occur. This stable is extremely close to the master bedroom of my residence
located at 30 Crest Road East. I am wondering if anyone from the planning commission took this into
consideration when they approved this subdivision. If not, I think a reevaluation is in store. It is
unconscionable that they would knowingly approve this kind of a set-up and/or not consider the impact
on surrounding neighbors and residents. After all, they are the supposed experts on reading and
evaluating plans and blueprints.
It makes me rather sad that so many subdivisions are taking place in this city at this time.
There are so few really nice, large properties remaining in Rolling Hills. To my knowledge, none of the
neighbors immediately adjacent to the Occhipinti property are happy with his subdivision for a variety
of reasons. Yet, all of us are feeling pressured into signing it into effect. It is my understanding that a
number of residents located quite a distance from the Occhipinti subdivision and who are mildly
impacted or not impacted at all are being given the same say as those whose property lines connect.
This is, apparently, due to the fact that the size of the property is the primary factor in "votes", rather
than degree of impact or location of the property of residents being asked to approve or disapprove a
plan. For the sake of our entire community, not just those involved with this particular project, this
regulation needs to be reviewed by your committee and/or the RHCA Board sometime soon. The
inequity and unreasonableness is unfair to those residents whose property values and day-to-day living
are impacted the most.
In conclusion, there are really two issues I am addressing: (1) The resident approval system
being used in our City for a subdivision/property change and; (2) the new stable location for the Crest
Road property. The latter is the one which concerns me the most. I would appreciate that this concern
be formally noted in the Occhipinti file and/or any other appropriate file(s) so that the above mentioned
issues can be addressed at future meetings. I also would appreciate receiving any comments or
information from your office or the City of Rolling Hills regarding this matter. I thank you in advance
for your help.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS
APPROVING A MODIFICATION TO RESOLUTION NO. 726 AND
APPROVING AN EXTENSION TO A PREVIOUSLY APPROVED
TENTATIVE PARCEL MAP NO. 23594, SUBDIVISION NO. 87, A REQUEST
TO SUBDIVIDE A 5.36 ACRE EXISTING LOT THAT HAS ONE
RESIDENTIAL UNIT INTO 2 SINGLE-FAMILY RESIDENTIAL LOTS
FRONTING THE NORTH SIDE OF CREST ROAD EAST AND THE WEST
SIDE OF CABALLEROS ROAD IN ZONING CASE NO. 485.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE
AND ORDER AS FOLLOWS:
Section 1. A request has been filed by Mr. and Mrs. Cosimo Occhipinti with
respect to real property located at 34 Crest Road East (Lot 57-C-MS), Rolling Hills,
requesting an extension to a previously approved Tentative Parcel Map No. 23594,
Subdivision No. 87, a request to subdivide a 5.36 acre existing lot that has one residential
unit into 2 single-family residential lots fronting the north side of Crest Road East and the
west side of Caballeros Road.
Section 2. The Council considered this item at a meeting on January 8, 1996 at
which time information was presented indicating that the extension of time is necessary in
order to clear up a problem with the title report.
Section 3. Based upon information and evidence submitted, the City Council
does hereby amend Paragraph 1, Section 13 of Resolution No. 726, dated January 24, 1994,
to read as follows:
"1. This Tentative Parcel Map shall expire three (3) years from the date of City
Council approval. The Tentative Parcel map was approved on and will expire on the
following dates:
APPROVAL DATE: Tanuary 24,1994
EXPIRATION DATE: anuary 24,1997
This approval shall become null and void if a final map has not been timely filed prior to
the expiration date in accordance with provisions of the Subdivision Map Act."
Section 4. Except as herein amended, the provisions of Resolution No. 726 shall
continue to be in full force and effect.
