194, Develop existing attic into ma, Resolutions & Approval Conditions• BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. Lee Sawyer Lot 28-RH ZONING CASE NO. 194 The application of Mr. Lee Sawyer, Lot 28-RH, Rolling Hills Tract, for a conditional use permit under ARTICLE III, Section 3.01, Uses Permitted, Ordinance No. 33 came on for hearing on the 29th day of June, 1977 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as re- quired by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Lee Sawyer, is the owner of that certain real property described as Lot 28-RH, located at 16 Williamsburg Lane in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds, further, that no comment, written or verbal, was received in opposition to the request, and that Dr. Alden Smith, 1 Acacia Road, called to state that he had no objection to the request. II. The Commission finds that the applicant has requested permission to utilize the attic space in their home for a master bedroom in con- nection with extensive remodelling, since homes on Williamsburg Lane are different in architecture from homes in other areas of Rolling Hills, and several were built with attics with a 16 foot ceiling height and dormer windows, although all living space is on one floor, as re- quired by the City's zoning ordinance. The Commission further finds that although it would be necessary to add two windows at the rear of the house, no exterior change would be visible from any point in Rolling Hills, as the addition of windows in the rear would be hidden entirely by tall trees which surround the house. The Commission finds further that an extensive addition to a home on adjacent property is very close to the side property line, and limits the feasibility of a similar addition to the Sawyer property. Further, the proposed utilization of an existing attic would not make the home larger in exterior size, or increase the density of the area. The Commission finds that a conditional use permit should be granted in order to pre- serve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such conditional use permit would not be materially detrimental to the public welfare, nor injurious to property in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit should be granted to Mr. Lee Sawyer, Lot 28-RH, 16 Williamsburg Lane, to permit utilization of the existing attic area for a master bedroom, including addition of windows as shown on Scheme B on the plan submitted, with the provision that the roof line not be changed, and it is, therefore, so ordered. /s/ Forrest Riegel Chairman, Planning Commission • etary, P arming Cap. fission
