138, Construct a stable in front ya, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. David Perrin Lot 17-FT ZONING CASE NO. 138 FINDINGS AND REPORT The application of Mr. David Perrin, Lot 17-FT, Flying Triangle Tract, for a conditional use permit under ARTICLE III, Section 3.06,Front Yard Requirements, Ordinance No. 33 came on for hearing on the 15th day of April, 1975 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. David Perrin, is the owner of that certain real property described as Lot 17-FT, Flying Triangle Tract, located in the City of Rolling Hills, Cali- fornia, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application, and that no comment, written ororal, had been received in favor of o'r oppositon to the request. III. The Commission further finds that the applicant requests the conditional use permit for construction of a stable in the side yard which would project into the front yard between the front road line and the nearest line of the main building. The applicant stated that the stable must be located as shown on the site plan submitted to avoid massive grading, because of the topography of the site, and further, the exceedingly steep terrain of the site prevents normal use of the property, and the view from adjacent properties would not be blocked by the proposed stable. The Commission finds that use of stables is enjoyed by other owners of property in the area, and a conditional use permit should be granted in order to preserve sub- stantial property rights possessed by other property in the same vicinity and zone. IV. From the foregoing it is concluded that a conditional use permit should be granted under Article III, Section 3.06, Front Yard Requirements, Ordinance No. 33 to Mr. David Perrin, Lot 17-FT for construction of a stable projecting into the front yard subject to the condition that a minimum side yard of 35 feet be reserved in locating the proposed residence on the property, and that an existing retaining wall in the side easement be removed, and it is, therefore, so ordered. /s/ William C.
