The property owners made application for a Variance to allow the
encroachment of a garage into the front yard setback and a request
for Site Plan Review to construct substantial additions to an
existing single family residence. During the hearing process,
plans were revised to eliminate the substantial additions requiring
Site Plan Review.
In response to your question about building pad coverage, note that
calculations of the building pad include the following
improvements: primary residence, accessory buildings, subterranean
garages, recreational game courts, pools and stables but, do not
include decks. Structural coverage proposed on this 10,144 square
foot building pad is 37.7%. Driveways, patios, decks and patio
areas are included in flatwork calculations. Structural coverage
for the proposed project is 10.1% (20% permitted) and total lot
coverage (structural plus flatwork) is 17.6% (35% permitted).
You should also note that though the Variance for the garage
encroachment was the only thing approved, the following special
conditions were included in the November 16, 1993 resolution: (1)
obtain building permits to remove the attic storage area window at
the north side of the house that was illegally constructed and
reconvert the attic space to non -habitable space so as not to
constitute a second story within six months of the approval of the
resolution; and (2) obtain building permits for the deck and
residential additions situated at the rear of the residence that
were illegally constructed within six months of the approval of the
resolution.

Hornbergers for Architectural Committee review. It is my
understanding that this plan was approved by the City.
The plan was held on the agenda to ascertain if, in fact, the "as
built" deck was approved.
For your information, before the committee can consider any new
construction, the structures already built without permits must be
resolved. In viewing the plan and photographs, and the large deck,
questions were posed by Committee Members that the pad coverage
percentage exclusive of sebacks appears to be at least 80%.
The Committee would also appreciate your input and information
about how the unpermitted construction was resolved.

BACKGROUND
1. The applicants submitted revised plans which do not include
the previously proposed rear additions.
2. The applicants request a Variance to permit the construction
of a 583 square foot garage that will encroach 18 feet into
the 50 foot front yard setback. The new garage will face
south as does the existing two -car garage. The applicants
propose to convert the existing 400 square foot garage space
to residential living area.
3. A survey of nearby homes reveals that they all encroach, some
as much as 25 feet into the code required 50 foot setback from
the front easement line. Another survey shows an average
3,037 square foot residence and 600 square foot garage on
Williamsburg Lane. The building pad sizes vary considerably
from approximately 3,858 square feet to 40,844 square feet,
and coverage on the pads range from 7.45% to 95.07%. The
average is 43.99%.
4. Grading for the project site will not be required.
5. The structural lot coverage proposed is 4,354 square feet or
10.1% (20% permitted) and the total lot coverage proposed is
7,595 square feet or 17.6% (35% permitted).
6. The proposed residential building pad coverage is 37.7%.
7. Access to the property from the street will remain the same
with a widened surface in front of the south -facing garage.

attend the meeting.
2. The applicants submitted revised plans showing the
addition at the northwest portion of the house moved 12
to the south so that the proposed addition will be 35
from the property line, formerly 23 feet.

3. The applicants request a Variance to permit the construction
of a garage that will encroach 16 feet into the 50 foot front
yard setback, and request Site Plan Review to permit
construction of 1,344 square feet of residential additions,
and a 520 square foot garage to an existing single family
residence. Two prior requests were 2,554 square feet and
1,920 square feet, respectively, with a 400 square foot
garage. The applicants also propose to convert their current
400 square foot garage space to residential living area.

1. On July 15, 1993, the Planning Commission viewed a silhouette
of the proposed project.
2. Staff conducted a survey of 9 residences on Williamsburg Lane
(attached) that shows an average 3,037 square foot residence
and 600 square foot garage. The building pad sizes vary
considerably from approximately 3,858 square feet to 40,844
square feet, and coverage on the pads range from 7.45% to
95.07%. The average is shown to be 43.99%. The proposed
project is shown in bold on the survey.
Staff also measured and verified the square footage of the
existing residence which totaled approximately 3,208 square
feet. Previous plans show a total of 2,875 square feet
existing. The additional square footage totals 333 square
feet.
3. The applicants revised their application to include a request
for a Variance to permit the construction of a 400 square foot
garage that will encroach 16 feet into the 50 foot front yard
setback. They have reduced the size of the addition at the
northwest portion of the structure by 634 square feet to 1,920
square feet and propose to convert their current 400 square
foot garage space to residential living area.

1940's. The stable was constructed in 1962. In August, 1991,

previous Zoning Case No. 447 and reveal that the nearby homes
all encroach to as'much as 25 feet into the code required 50
foot setback from the front easement line (attached).
6. Grading for the project site will require 237 cubic yards of
cut soil and 237 cubic yards of fill soil.
7. The structural lot coverage proposed is 5,036 square feet or
11.7% (20% permitted) and the total lot coverage proposed is
8,781 square feet or 20.4% (35% permitted).
8. Access to the property from the street will remain the same
with a widened surface in front of the garage that will face
the street. The existing garage faces south.
9. The structural coverage on the 10,144 square foot residential
building pad is 47.1%. Previous proposed coverage was 55.3%.
10. The Commission observed the added residential area, the 3,056
square foot wooden deck, and the attic storage area all
constructed without permits. Commissioners have also heard a
statement from neighbor, Mr. Charles Ramsdell, 8 Williamsburg
Lane, who complained about a bright light shining from "an
upper story" window at the north side of the house.
11. The project has been determined to be categorically exempt
pursuant to the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.

BACKGROUND
1. At a field trip on May 6, 1993, the Planning Commission viewed
a silhouette of the proposed project. The Commissioners asked
that the buildable pad area be recalculated as well as the
existing and proposed coverages on the pad.
Mr. Eastman, the applicant's representative, resurveyed the
area and determined that the buildable pad is 10,144 square
feet and the existing structure covers 28.2% of the pad. The
proposed structure would cover 55.3% of the building pad.
2. At the field trip, the Commission observed the added
residential area, the 3,056 square foot wooden deck, and the
attic storage area constructed without permits.
3. The applicants are requesting Site Plan Review to add 2,554
square feet of additions to the existing 2,456 square foot
residence (104% increase), an additional 200 square feet of
garage space and a 100 square foot service yard.
4. The existing house and attached garage were built in the
1940's. The stable was constructed in 1962. In August, 1991,
the Planning Commission granted a Variance for encroachment
into the front yard setback and Site Plan Review approval for
a new residence at the site in Zoning Case No. 447. • Those

Request for Site Plan Review to permit construction of substantial
residential additions and a garage space addition to an existing
single family residence.
DISCUSSION
In reviewing the applicant's request under Title 17 (Zoning), staff
would identify the following issues for evaluation:
1. The applicant is requesting Site Plan Review to add 2,554
square feet of additions to the existing 2,456 square foot
residence (104% increase), an additional 200 square feet of
garage space and a 100 square foot service yard.
2. The existing house and attached garage were built in the
1940's. The stable was constructed in 1962. It appears that
a wood deck was constructed at the rear of the house without
permits.
3. Grading for the project site will 285 cubic yards of cut soil
and 285 cubic yards of fill soil.
4. The structural lot coverage proposed is 6,160 square feet or
15% (20% permitted) and the total lot coverage proposed is
10,160 square feet or 24% (35% permitted).
5. The building pad coverage proposed for the 18,148 square foot
pad is 31%.
6. Access to the property will remain the same.
7. Mr. Charles Ramsdell, 8 Williamsburg Lane, reviewed the plans
and objected to a bright light shining from "an upper story"
window at the north side of the house. (The Zoning Code
prohibits second stories).

8. The project has been determined to be categorically exempt
pursuant to the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.
