This letter shall serve to notify you that the City Council at their regular meeting on June
9, 2014, ratified the Planning Commission's resolution granting your request in Zoning
Case No. 855.
The decision shall become effective thirty days after the adoption of the resolution by the
Planning Commission unless an appeal has been filed within thirty days of the
Commission's approval. Should there be an appeal, the Commission's decision will be
stayed until the Council completes its proceedings in accordance with the provisions of
the Municipal Code.
Before this case takes effect you are required to record an Affidavit of Acceptance Form,
accepting all of the conditions of the resolution, together with the subject resolution in the
Office of the County Recorder.
I have enclosed a copy of RESOLUTION NO. 2014-10, specifying the conditions of

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL OF A CONDITIONAL USE
PERMIT AND A VARIANCE TO RETAIN AN AS BUILT 256 SQUARE
FOOT HOBBY SHOP LOCATED IN THE SIDE SETBACK IN ZONING
CASE NO. 855 AT 8 WILLIAMSBURG LANE, ROLLING HILLS, CA,
LOT 37-RH, (RAMSDELL). THE PROJECT HAS BEEN DETERMINED TO
BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. and Mrs. Charles Ramsdell with
respect to real property located at 8 Williamsburg Lane, Rolling Hills (Lot 37-RH)
requesting a Variance and Conditional Use Permit to retain a 256 square foot hobby
shop, which encroaches up to 9.5-feet into the side yard setback.
Section 2. The property is zoned RAS-1. Records indicate that the original
home was built in 1938, with additions permitted for various improvements between
1958 and 1983, including a front yard Variance granted in 1980 for a living area
addition. In January 2014 the property owners received over-the-counter approval for
addition of 938 sq. ft. to the home and 41 sq. ft. to the garage, new landscaping and
irrigation, subject to legalizing the unpermitted hobby shop.
Section 3. The Planning Commission conducted duly noticed public hearings
to consider the application at a field trip visit and at their regular meeting on April 15
and April 16, 2014 respectively. Evidence was heard and presented from all persons
interested in affecting said proposal and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. The
property owners were in attendance at the hearings. The field trip public hearing and
the regular meeting of the Planning Commission were properly noticed. None of the
neighbors came to the meetings and staff received no comments from any interested
party.
Section 4. The Planning Commission finds that the project qualifies as a Class
1 Exemption, Existing Facilities, and is therefore categorically exempt from
environmental review under the California Environmental Quality Act.
Section 5. Sections 17.38.010 through 17.38.050 of the Rolling Hills Municipal
Code permit approval of a Variance from the standards and requirements of the Zoning
Ordinance when exceptional or extraordinary circumstances applicable to the property
and not applicable to other similar properties in the same zone prevent the owner from

On May 20, 2014, the Planning Commission unanimously adopted a resolution, with
conditions, granting your request for a CUP and Variance Zoning Case No. 855. That

at 7:30 PM. You or your representative should be present to answer any questions the

The Planning Commission's decision in this matter shall become effective thirty days

The Planning Commission voted at their meeting on April 15, 2014 to direct staff to
prepare a resolution to approve your request in Zoning Case No. 855 and shall be
confirmed in a draft resolution that is being prepared. The Planning Commission will
review and consider the draft resolution, together with conditions of approval, at an
upcoming meeting on May 20, 2014 and make its final decision on your application at
that meeting.
The findings and conditions of approval of the draft resolution together with the staff
report will be forwarded to you before the next Planning Commission meeting.
The Planning Commission's decision shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed or the City Council takes

Pursuant to state law the City's staff has completed a preliminary review of the
application noted above and finds that the information submitted is:

We have enjoyed residing and raising our family in the City of Rolling Hills
since 1980, and at this point in our lives we are able to expand and upgrade the
original kitchen and add a guest room to our home.
We have submitted our plans to the city, and the new survey shows that the
garden hobby room on the lower level where we grow plants from seed and keep
the garden books and equipment is almost ten feet into the setback - although not in
the easement. We discovered this after it was erected. We were replacing some
sprinklers and found the line of sprinklers on the north side of the property were
ten feet into our neighbors property, and the fence had been moved ten feet in our
direction.
Placing the garden hobby room into the setback was entirely unintentional.
The sprinklers have been moved, but at this point it would be impossible to move
the garden hobby room without destroying it, and we respectfully request that it be
approved as is. There have been no complaints that we are aware of; there is no
home adjacent to it; it is not visible to the neighbors; and it is not on the easement.
As mentioned, we have lived in the same house on Williamsburg Lane for the
last 34 years, and everything we have done to the property has been with City and
RHCA approval. Our last project to replace all the doors and windows was
completed with City and Homeowners' Association approval, and with a permit. No
part of the original house or the new addition is in the easement or the setback.
We respect the rules and regulations of the City, but find ourselves in a
difficult position, and respectfully request a variance for the garden hobby room.
