Ballard, as the owners of that property situated at 3 Wideloop Road, Rolling Hills, designated as Lot 10B of a division of Eastfield, Rolling Hills, California, do hereby petition for a variance from zoning ordi- nance. Such change is warranted because a portion of the building on said property already is constructed and occupied, but is within 13'6" of the westerly property line. II. Such change is based upon the following exceptional and extraordinary circumstances that do not apply generally to other proper- ty or class of use in this vicinity and zone. Complete and detailed drawings of the pro- posed new construction, including a plot plan clearly showing the proposed location in respect to property lines, easements, etc. were submitted to the Planning Com- mission and to the County Engineers' Office. Both offices approved the final drawings and the construction proceeded accordingly. III. Such change is necessary for the preservation and enjoyment of a substantial property right possessed by other property in this same vicinity and zone because the Ordinance requiring a set -back of 10 feet from the (ID') easement was enacted after most existing construction and property use had already been established. IV. Such change will not be materially detri- mental to the public welfare or injurious to the property or improvements in this vicinity and zone where this property is located because of the reasons given in Paragraph III above and since the Majority of buildings in this vicinity are already • -2- July 12, 1961 Planning Commission City of Rolling Hills (con't) IV. in violation of the recently enacted ordinance.
