It has come to the attention of the Planning Department that the
required screening for the tennis court approved by the Planning
Commission on March 19, 1985 rletter attached) is not in.
compliance.
When the Planning Commission approved the Conditional Use Permit
for a tennis court, screening of the court with mature landscaping
was required. And, as you know, the Conditional Use Permit goes
with the land.
Section 17.16.012.E of the Rolling Hills Municipal Code allows a
Conditional Use Permit to be granted under certain conditions.
And, Section 17.32.120 of the Code states that after a public
hearing, the Planning Commission may revoke or modify any Variance
or Permit issued on any one of the following grounds:
"A. That the approval was obtained by fraud;
"B. That the permit or variance granted is being or recently
has been exercised contrary to the terms or conditions of such
approval or in violation of any statute. ordinance, law or
regul ation;
"C. That the use for which the approval was granted is so
exercised as to be detrimental to the public health or safety, or
so as to constitute a nuisance. Ord. 188 (part). 1981:
Ord.33.SS6.12. 1960."
You are formally requested to Provide 2 sets of landscapina plans.
a cost estimate and a bond that complies with the Resolution at
once and to contact this office within the next twenty days.
If we do not receive a response from you within that period, we
have no alternative but to arrange a public hearing before the
Planning Commission to revoke or modify your Conditional Use
Permit.

Subject: Zoning Case No. 309
This letter is to serve as official notice, pursuant to Section
17.32.090 of the Rolling Hills Municipal Code, that a Conditional Use
Permit for construction of a tennis court and a Conditional Use Permit
for construction of a pool house on your property known as Lot 169A-MS
was approved by the Rolling Hills Planning Commission on Tuesday,
March 19, 1985, subject to standard conditions for tennis courts and
guest houses/servants' quarters. A formal report of the Planning
Commission as required by Section 17.32.086 of the Municipal Code is
contained within the minutes of the proceedings before the Commission.
A copy of the minutes and copies of conditions of approval for tennis
courts and for guest houses/servants' quarters are enclosed. Condi-
tions which apply to guest houses and servants' quarters are also ap-
plicable to cabanas and pool houses.
The Planning Commission's action was reported to the City Council
at a regular meeting on Monday, April 8, 1985 pursuant to Section
17.32.140 of the Municipal Code. Since no action was taken by the
Council regarding the conditional use permits, the decision of the
Planning Commission, including designation of the private access drive-
way to the property as "Storm Hill Lane", has been ratified by the City
Council and the Conditional Use Permits for construction as shown on a
plan submitted for Zoning Case No. 309 are approved.
An acceptance form as required by Ordinance No. 207 is enclosed.
When the Affidavit of Acceptance, duly executed and recorded, has been
returned to the City, the Los Angeles County Department of Building
and Safety will be notified that building permits can be issued.

Chairman Roberts opened discussion of a request by Mr. and Mrs.
James Bird for a Conditional Use Permit for a pool house and tennis
court as part of the development of Lot 169A-MS on Johns Canyon Road.
The Chairman noted that the public hearing was continued from the
last meeting of the Commission, and that a field trip was made to the
site; he then invited comment from persons present at the meeting.
There was none, and Chairman Roberts closed the public hearing.
In discussing the request it was determined that the proposed
construction would be in a location which is remote from the road,
is compatible with the area, that the proposed tennis court can be •
screened, and there was no objection from any neighbors who were
notified in writing of the request. Commissioner Hankins moved that
the request for a Conditional Use Permit be approved, subject to
standard conditions of approval for tennis courts and cabanas, and
that the approval specify" that there be no kitchen or sleeping fa-
cilities in the pool house. Mr. Anderson said the prohibition is
included in the standard conditions of approval for cabanas and other
similar accessory buildings. The motion was seconded by Commissioner
Frost and carried by the following roll call vote:

REQUEST FOR ASSIGNMENT OF ADDRESS FOR LOT 169A-MS
In a letter to the Commission dated March 12, 1985 Mr. and Mrs.
Bird advised that all odd numbers on Johns Canyon Road have been used,
and in order to obtain building permits a street address must be as-
signed. Two possible solutions were presented: 1) to renumber all
Johns Canyon residences beyond the Bird property; or 2) to approve
installation of a private driveway togiveaccess to the property
from Johns Canyon Road, with all installation and maintenance costs
to be the responsibility of Mr. and Mrs. Bird. If the private access
drive is approved they requested that the name of the access be
designated Storm Hill Lane.
The Manager reported that the Fire Department requires that all
residences in the City be numbered in sequence, and since no number.
has been reserved for the property, which takes access from Johns •
Canyon Road, provision must be made for identification. He said the
proposed development on the property is considerable distance from
Johns Canyon Road, and is adjacent to additional vacant property
which presently has no access. In the event the adjacent property is
developed at a.future date it will become necessary to build a road
to provide access; at this time access can be given to the property
by means of a private access drive to be maintained by the owner,
which would provide access to the residence from Johns Canyon Road;
The Planning Advisor recommended that if such access is approved,
the Commission require that the lane consist of a 60 foot right of
way, that.a 50 foot setback be required for construction, that a
plan showing the location of the lane be submitted and that a note
be placed on the plan stating that approval of a private driveway
as access to the residence on Lot 169A-MS will not affect future
subdivision of adjacent property.
Commissioner Hankins moved that a private access driveway to
the residence be approved, subject to requirements recommended by
the Planning Advisor to be shown on a plan submitted by the appli-
cant, and that the access be designated "Storm Hill Lane" with a
number to be assigned in accordance with the numbering system in
that part of the City, and further subject to a requirement that the
private access not divide the property. The motion was seconded by
Commissioner Frost and carried'by the following roll call vote:

Mrs. Claudia Bird thanked the Planning Commission for their
consideration of her request.
PUBLIC •RING, ZONING CASE NO. 309, JIRD, LOT 169A-MS 2021
Chairman Roberts opened a meeting of a public hearing on an appli-
cation by Mr. and Mrs. James Bird for conditional use permits for con-
struction of a tennis court and pool house on Lot 169A-MS located on
Johns Canyon Road. The Clerk reported that.the hearing was duly noticed
as required by law, and that no comment, written or verbal, was received
in favor of or in opposition to the request.
Mr. Douglas McHattie represented the applicant at the hearing and
explained that the proposed tennis court and pool house are part of
the development of a 12.21 acre parcel. The Planning Advisor said the
proposed structures will be approximately 100 feet from the side pro-
perty line, and the plan shows balanced grading of 20 feet of cut and
20 feet of fill. Members of the Commission agreed that a field trip
should be made to the site, and Chairman Roberts asked that the property
be staked to define elevation, four corners and fence height of the
tennis court and the four corners and eave height of the pool house.
The Chairman said a field trip would be scheduled later in the meeting
and he ordered the matter held on the agenda. .

CONDITIONS OF 'ROVAL - TENNIS COURTS
While a complete list of conditions cannot be recommended until a
public hearing has been held and all testimony taken, the following
list of conditions pertaining to tennis courts is provided:
1. This Conditional Use Permit shall not be effective for any
purpose until the owner of the property involved, or his duly
authorized representative, has filed with the City Clerk of the
City of Rolling Hills an affidavit stating that he is aware of
and agrees to comply with all the conditions of the Permit.
2. It is declared to be the intent of the Planning Commission that
if any provision of the Permit is held or declared to be invalid,
the permit shall be void and the privileges granted thereunder
shall lapse.
3. It is declared and made a condition of the Permit that if any
conditions thereof are violated, or if any law, statute or
ordinance is violated, the Permit shall be suspended and the
privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation
and has failed to do so for a period of thirty (30) days.
4. All requirements of the Zoning Ordinance and of the zone in
which the subject property is located must be complied with un-
less otherwise set forth in the Permit, or shown otherwise on
an approved plan.
The property shall be developed and maintained in substantial
conformance with the site plan on file marked Exhibit "A"
except as otherwise provided herein.
6. Tennis court fences shall be a maximum of eight (8) feet in
height above the surface level of the court.
All new sloes shall be landscaped with ground cover and trees
to screen t.� curt _wr►.
A landscape plan and irrigation system shall be submitted to
the Planning Commission for review and approval.
9. All proposed walls shall be a uniform earthen color. The color
and material shall be approved by the Planning Commission.
10. A bond shall be deposited with the City, to be held until
eighteen months after completion, to guarantee the satisfactory
growth and maintenance of the required landscaping.
11. All landscaping shall be planted and the irrigation system shall
be installed concurrent with completion of the tennis court.
12. Tennis court fence shall be black or dark green vinyl coated
chain link.
13. Additional offstreet parking may be required.
14. Prior to issuance of building permits a grading plan satisfactory
to the City Engineer shall be submitted.
This Conditional Use Permit shall expire unless used within one year
from the date of grant.
15. The Planning Commission may, at its discretion, attach such
other conditions as it deems appropriate to the property.

court, agreed to dedicate their portion of a 60 foot roadway, which
is now know as Storm Hill Lane. The purpose of this memorandum is
to inquire if the Birds have in fact dedicated their portion of the
roadway easement from Johns Canyon Road to the end of their property
(Lot 169-A-MS), at #4 Storm Hill Lane.

To Whom It May Concern:
We are in the process of contruction of a single family
residence off of Johns Canyon Road on a 12 acre Rolling Hills
parcel, number 169A. At present we do not have a street address
and the odd numbers on our side of the street have all been taken.
In order for us to obtain building permits we must have a street
address so time is of the essence in this matter.
There appears to be two possible solutions to this problem.
1. Renumber all of the Johns Canyon residences below our home.
2. We would install and maintain a access lane which we would as-
sume full responsibility for.
If you are willing to grant this access lane we would like
to respectfully request that the name of this lane be "Storm
Hill Lane."
We greatly appreciate the time you have granted us in this
matter.
