This letter shall serve to notify you that the Planning Commission adopted a
resolution on April 20, 2010, granting a request in Zoning Case No. 778. That action,
accompanied by the record of the proceedings before the Commission was reported
to the City Council on April 26, 2010.
The Planning Commission's decision in this matter shall become effective thirty
days after the adoption of the resolution by the Commission, (by May 20, 2010).
If no appeals are filed within the thirty (30) day period after adoption of the
Planning Commission's resolution, the Planning Commission's action will become
final and you will be required to cause to be recorded an Affidavit of Acceptance
Form together with the subject resolution in the Office of the County Recorder
before the Commission's action takes effect.

SINGLE FAMILY RESIDENCE AND ACCESSORY STRUCTURES, IN ZONING
CASE NO. 774 AT 5 WAGON LANE, (LOT 110-4-RH), (TU). PROJECT HAS BEEN
DETERMINED TO BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND,
RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. John Tu with respect to real property
located at 5 Wagon Lane (Lot5 110-4-RH), Rolling Hills, requesting a Site Plan Review for grading of
150 cubic yards of cut and 150 cubic yards of fill and construction of a 1,650 square foot detached garage
and access thereto.
Section 2. The Planning Commission conducted duly noticed public hearings to consider the
application on November 16, 2009 and at a field trip on December 15, 2009. At the field trip the
Commission expressed concerns regarding the size and mass of the proposed garage, as well as the
proposed location and compatibility with the neighborhood. The architect requested continuance of the
public hearing, so that he.may revise the project. The applicants submitted a revised plan and the Planning
Commission visited the site again on March 16, 2010 and held a public hearing on March 16, 2010 at
their evening meeting.. The applicants have further reduced the size of the garage to 1)650 square feet.
The applicants were notified of the public hearings in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal and from members of the City staff and
the Planning Commission having reviewed, analyzed And studied said proposal. The applicants'
representatives were in attendance at the hearings.
Section 3. The subject property is zoned RAS-2 and is accessed from Wagon Lane. The lot wraps
around another property on Wagon Lane and also fronts on both sides of Portuguese Bend Road..
Portuguese Bend Road is a 100-foot roadway easement and cuts through the property. The gross area of
the lot is 4 acres. Excluding the roadway easements, the lot is 3.4 acres. The net lot area for development
purposes is 3.07 acres or 133,808 square feet. Approximately 43,000 square feet of the lot is located on
the west side of Portuguese Bend Road.
Section 4. The property is currently developed with a 6,506 square foot residence, 547 square
foot attached garage, 170 square foot entryway, 1;038 square foot swimming pool and spa, 108 square
foot service yard, 11 square foot pool equipment area, 128 square foot play equipment (roofed), 185
square foot sheds, 1,782 square foot sports court, 1,526 square foot raised deck attached to the house and
has 1,618 square foot basement. As part of this approval the unpermitted shed, roofed play equipment and
sport court will be demolished.

This letter shall serve to notify you that the Planning Commission at their regular
meeting on March 16 directed staff to prepare a resolution, with conditions, to approve
your request in Zoning Case No. 774. The Commission will consider this resolution at
their April 20, 2010 meeting.
The resolution with findings and conditions of approval will be forwarded to you on the
Friday prior to the next Planning Commission meeting. Please review the conditions of
approval once you receive them.
The Planning Commission decision shall become effective thirty days after the adoption
of the resolution unless an appeal has been filed by you, any interested party or the City
Council takes jurisdiction of the case within that thirty (30) day appeal period. (Section
17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal, the
Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code.
The Planning Commission action, accompanied by the records of the proceedings will be
presented to the City Council as a report item on their agenda at the Council's regular
meeting following the Commission's approval.

On December 15, 2009 the Planning Commission visited your property to view the
silhouette of the proposed detached garage. The Planning Commission expressed concerns
regarding the size of the proposed garage, massing in relationship to the location of the
residence, height, proximity to your neighbors, the out of grade construction of one of the
walls, height of the garage doors and the incompatibility of the structure with the
neighborhood. They also requested information from Edison Co. regarding the electric wires
and how high they would need to be if there was a structure beneath them.
In order to allow you time to resubmit a revised project, the Planning Commission continued
the public hearing to their January 19, 2010 meeting, starting at 6:30 PM.
Please submit revised plans by January 6, 2010.

The Planning Commission will conduct a field inspection of your property to view a
silhouette of the proposed project on Tuesday„ December 15, 2009, at approximately
8:00 AM. The Commission will visit another property beginning at 7:30 am, and
then proceed to your site.
The site must be prepared according to the enclosed Silhouette Construction
Guidelines and the following requirements.
♦ A full-size silhouette in conformance with the
attached guidelines must be prepared for ALL
STRUCTURES of the project showing the footprints
and roof ridges;
• Show the roof height with the louvered vents;
O Show the height of the finished floor of the proposed
garage;
• Delineate/stake the location of the required setbacks;
rear and sides in the area of the garage;
• Show the location of the garage doors;
• Stake/delineate the footprint of the future stable area
and corral area;
• Delineate the driveway access to the garage;
♦ Delineate/stake the proposed wall and stairs;
• Delineate/stake limit of grading.
The staking must be completed a minimum of 5-7 days
prior to the meeting. Please be advised that inaccurate
staking could delay the review of the project. You or
your representative must be present at the meeting.

After the field trip, the next regular meeting of the Planning Commission will take place

SILHOUE'1"i'h CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
