RESOLUTION NO. 90-3
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROLLING HILLS DENYING A
CONDITIONAL USE PERMIT FOR A GUEST HOUSE AND
SITE PLAN REVIEW IN ZONING CASE NO. 415
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr.
Robert Felton with respect to real property located at 14 Upper
Blackwater Canyon Road, Rolling Hills (Lot 97-2-RH) requesting a
conditional use permit for a guest house on said property and for
site plan review approval of the proposed guest house.
Section 2. The Planning Commission conducted a
duly noticed, public hearing to consider the application on January
16, 1990 and February 20, 1990 and conducted field site review on
February 10, 1990.
Section 3. Section 17.16.012(F) of the
Municipal Code requires a conditional use permit to construct a
detached guest house on the same lot as a primary residence provided
that no kitchen or cooking facilities are included.
Section 4. The Planning Commission makes the
following findings:
A. The granting of such Conditional Use Permit
would not be consistent with the purposes and
objectives of the Zoning Ordinance and General
Plan because construction of the guest house
would result in additional grading that would
adversely impact the existing hillside slope at
the rear of the property. Furthermore, the
proposed guest house will result in
overdevelopment of the lot because it will, in
addition to the residence and stable, cover 38%
of the 19,000 square foot buildable pad area.
B. The proposed project would not be
desirable to the public convenience and welfare
because the proposed guest house requires
additional grading that would impact the
hillside, and be of visual impact to surrounding
properties. The proposed project is thereby not
compatible with the site and surrounding
properties.
Section 5. Based on the foregoing findings, the
Planning Commission hereby denies the conditional use permit for
Zoning Case No. 415.

Section 6. Section 17.34.010 requires a
development plan to be submitted for site plan review and approval
before any building or structure may be constructed or any expansion,
addition, alteration or repair to existing buildings may be made
which involve changes to grading or an increase to the size of the
building or structure by more than twenty-five (25%) percent in any
thirty-six (36) month period.
Section 7. The Commission makes the following
findings of fact:
A. The Zoning Ordinance requires a Conditional Use
Permit be approved for the proposed guest house
development. Pursuant to Section 5 of this
Resolution, a conditional use permit cannot be
granted.
B. Pursuant to Section 17,34.040 A.(a), the
proposed project is not consistent with the
purposes and objectives of the Zoning Ordinance
and General Plan.
Section 8. Based as to foregoing findings, the
Commission hereby denies the site plan review application for a
proposed guest house on the property located at 14 Upper Blackwater
Canyon Road as indicated on the development plan attached hereto as
Exhibit A.
