BACKGROUND
1. The Planning Commission approved the attached subject resolution on
October 15, 1996 at their regular meeting.
2. A previous proposal was approved on October 14, 1994. The modification of
plans and the additional square footage proposed for the project following
review by the Rolling Hills Community Association necessitated additional
review by the Planning Commission. During the hearing process, a larger
residential expansion was reduced by the applicants. There will be a 400
square foot addition to the residence from 4,960 to 5,360 square feet. The
residential building pad was expanded from 20,315 to 20,973 square feet
requiring grading of 1,050 cubic yards of cut soil and 1,050 cubic yards of fill
soil. Coverage of the reconfigured building pad went from 32.9% to 34.4%.
Attached is a table showing changes from the original approval and the
current proposal.
3. Structural lot coverage will be 11.9% and total lot coverage will be 28.9%.
Maximum disturbed area will be 36.9%.
RECOMMENDATION
It is recommended that the City Council receive and file Resolution No. 96-19.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS APPROVING A MODIFICATION TO PLANNING
COMMISSION RESOLUTION NO. 94-26 AND GRANTING SITE PLAN
REVIEW MODIFICATION APPROVAL FOR THE CONSTRUCTION OF A
NEW SINGLE FAMILY RESIDENCE AND GUEST HOUSE IN ZONING
CASE NO. 543.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application has been filed by Mr. and Mrs. Edgar Capifali with
respect to real property located at 49 Saddleback Road, Rolling Hills (Lot 61-RH), Rolling
Hills, requesting a modification to a previously approved Conditional Use Permit and
Site Plan Review for the construction of a new single family residence with attached
garage and a guest house to replace an existing single family residence.
Section 2. The Commission considered this item at a public hearing on July
16, 1996, August 20, 1996, and September 17, 1996, and at a field trip visit on August 3,
1996 at which time information was presented indicating the need to modify
construction plans following review by the Rolling Hills Community Association,
enlargement of the project and grading to reconfigure the building pad.
Section 3. Based upon information and evidence submitted, the Planning
Commission does hereby amend the following three paragraphs of Resolution No. 94-
26, dated December 10, 1994:
Paragraph A, Section 8 to read as follows:
"A. The proposed development is compatible with the General Plan, the
Zoning Ordinance and surrounding uses because the proposed guest house structure
complies with the General Plan requirement of low profile, low density residential
development with sufficient open space between surrounding structures. The project
conforms to Zoning Code setback and lot coverage requirements. The lot has a net
square foot area of 66,103 square feet (1.98 acres). The residence (5,360 sq.ft.), attached
garage (712 sq.ft.), swimming pool (400 sq. ft.), stable (648 sq.ft.), service yard (96 sq.ft.)
and guest house (640 sq.ft.) will have 7,856 square feet which constitutes 11.9% of the lot
which is within the maximum 20% structural lot coverage requirement. The total lot
coverage including paved areas and driveway will be 19,106 square feet which equals
28.9% of the lot, which is within the 35% maximum overall lot coverage requirement.
The proposed project is on a relatively large lot with the proposed structures located
away from the road so as to reduce the visual impact of the development and is similar
and compatible with several neighboring developments. The building pad is 20,973
square feet and structural coverage on the building pad is 34.47%.

"D. The lot shall be developed and maintained in substantial conformance
with the site plan on file marked Revised Exhibit "A," dated October 10, 1996, except as

Request for Site Plan Review Modification of a previously approved single family
residence and guest house to replace an existing single family residence.
BACKGROUND
1. At the Planning Commission meeting on August 20, 1996, the public hearing
was continued to allow the applicant the opportunity to amend the grading
plan to reduce the percentage of pad coverage. The applicants' representative,
Mr. Douglas McHattie, has informed staff that there are no new plans and
that he is preparing a presentation to the Commission.
2. The Planning Commission viewed a silhouette of the proposed project on
August 3, 1996. Commissioners noted that there were differences between the
previously approved and present proposed residential building pad at the
western end of the pad. The current proposal has a smaller residential
building pad that includes the garage, pool, and service yard but, not the guest
house. The previously approved project had a larger residential building pad
that included the garage, pool and guest house but, no servicd yard.
Proposed residential coverage is 6,748 square feet on a 17,682 square foot
residential building pad and will be 38.2%. Previously approved residential
coverage was 6,689 square feet on a 20,315 square foot pad and was 32.9%.
The allowable size of the stable pad is 2,952.5 square feet and coverage is
21.9%. The guest house pad within allowable setbacks is 1,288 square feet and
coverage is 62.1%. The total building pads are 21,922.5 square feet with
structural coverage of 33.2%.

3. The applicants are requesting to modify a previously approved site plan to
increase the size of the guest house to 800 square feet at the southwest portion
of the lot, the residence to 5,540 square feet, the garage to 712 square feet, and a
service yard of 96 square feet, adding 867 square feet to the approved plans.
The applicant's representative, Mr. Douglas McHattie, South Bay
Engineering, contends that calculations by the previous representative of the
Capifalis were incorrect. Staff reviewed the coverage and size of the
residential building pad and found them to be correct.
4. The Planning Commission approved a Conditional Use Permit and Site Plan
Review for the construction of a guest house and new single family residence
at the site on December 10, 1994. The approval was later extended for another
year on December 19, 1995. That approval was for a 625 square foot guest
house, a 4,960 square foot single family residence, 704 square foot garage, 400
square foot pool, and the 648 square foot existing stable. The approval
included the provision that any modifications to the project that would
constitute additional development would require the filing of a new
application for Site Plan Review by the Planning Commission.
5. The structural lot coverage proposed is 8,196 square feet or 12.4% (20%
permitted) and the total lot coverage proposed is 19,446 square feet or 29.4%
(35% permitted).
6. Grading for the project site will require 93 cubic feet of cut and 93 cubic feet of
fill soil.
7. Disturbed area of the lot will be 19,446 square feet or 29.4%. Staff did not
include the corral as disturbed area. •
8. Access will continue from the existing driveway at the northeast from
Saddleback Road.
9. The existing house, attached garage, and the pool were built in 1965. The 648
square foot stable was constructed in 1949. The existing residence is 2,883
square feet, the garage is 712 square feet, the pool is 582 square feet, and the
service yard is 96 square feet.
10. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed plans and

Request for Site Plan Review Modification of a previously approved single family
residence and guest house to replace an existing single family residence.
BACKGROUND
1. The applicants are requesting to modify the approved site plan to increase the
size of the guest house to 800 square feet at the southwest portion of the lot,
the residence to 5,540 square feet, the garage to 712 square feet, and a service
yard of 96 square feet, adding 867 square feet to the approved plans.
2. The Planning Commission approved a Conditional Use Permit and Site Plan
Review for the construction of a guest house and new single family residence
at the site on December 10, 1994. The approval was later extended for another
year on December 19, 1995. That approval was for a 625 square foot guest
house, a 4,960 square foot single family residence, 704 square foot garage, 400
square foot pool, and the 648 square foot existing stable. Resolution No. 94-26
(attached) included the provision that any modifications to the project that
would constitute additional development would require the filing of a new
application for Site Plan Review by the Planning Commission.
3. The structural lot coverage proposed is 8,196 square feet or 12.4% (20%
permitted) and the total lot coverage proposed is 19,446 square feet or 29.4%
(35% permitted).

4. The proposal shows coverage on a 17,682 square foot residential building pad
to be 38.2%. The previously approved coverage on a 20,315 square foot
residential building pad was 32.9 %.
There is a 5,844 square foot stable pad area but, much of the existing stable and
stable pad encroaches into the front yard setback. Therefore, the allowable
size of the stable pad is 2,304 square feet and coverage is 28.1%. The guest
house pad beyond setbacks is 1,288 square feet and coverage is 62.1%. The
total building pads are 21,274 square feet with structural coverage of 38.5%.
5. Grading for the project site will require 93 cubic feet of cut and 93 cubic feet of
fill soil.
6. Disturbed area of the lot will be 19,446 square feet or 29.4%. Staff did not
include the corral as disturbed area.
7. Access will continue from the existing driveway at the northeast from
Saddleback Road.
8. The existing house, attached garage, and the pool were built in 1965. The 648
square foot stable was constructed in 1949. The existing residence is 2,883
square feet, the garage is 712 square feet, the pool is 582 square feet, and the
service yard is 96 square feet.
9. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the Planning Commission review the proposed plans and
take public testimony.
