This a response to your letter of March 17, 1994
requesting information about a "night -lighted" tennis court
and a barn "being used as a guest house".
These are erroneous statements made by the realtor
who is selling our property.
There is no "lighted tennis court".We built -our
tennis court,in the riding ring,properly, according to the
conditional use permit.This area was lit by two lights, one on
each end. These lights originally provided lighting to the
riding ring. These lights were left intact exactly as they
were for twenty years. These are not tennis lights. They do
provide enough light to play tennis. No one uses these lights.
The next issue is the barn. Our property has
two barns.The brick barn closest to the house is the barn in
question. This particular structure is far from the average
barn. This structure existed with plumbing, electricity,
hard surface floors, bathrooms, and three finished rooms
with windows. These rooms provided for a caretaker to live
there. There were heating lamps, flourescent lights, and
many cabinets. These existed.Additionally, the structure
has an approved fireplace on the plans(not built). These
things run with the property.
We did remove the pipe corrals. These are
stored at the rear of the second barn. We did put wood
framed windows in the stall doors and barn door.These are
set so that the existing barn doors are still in place and
are functional. We left all the pipes for water to each stall
in place. We fixed the existing ceiling that was falling
down. The heating lamps were removed and stored.Decorative
fans using existing electricity were put in.The interior
of the barn was painted.
This barn had three finished rooms. One room
was completely panneled in wood; has carpetting, and glass
cabinets. The previous owner advertised and used this room
as a "gentleman's study". The second room has a 1/2 bath,
carpets. and shelves. The third room has a bathroom. This
room originally contained a pool table.
We moved the pool table into the main area.
We also have a ping-pong table, exercise equippment, and
sofa in this area.
All the~walls, inside and out, are brick.
These walls are in their original condition.
As for a "kitchen"; there were cabinets in
the hall between the stalls and the finished rooms. We
put a piece of furniture with a tiled top and bar stools
here. There is no kitchen.
We feel entitled to use this space in this
fashion. The stalls are still available; and the space
not altered to prevent the stalls from being reinstalled
should a new owner want horses.
We did not replumb; or rewire, or add walls,
or do anything besides paint the interior.
Also, the barn is not heated or air conditioned.
We are truly surprised about this complaint. We know that
there are many residents who have converted their barns to
living quarters without proper permits. No one lives in
our barn.
We apologize for our realtor's erroneous
statements and thank you for your interest.

Dear Dr. and Mrs. Taus:
We are informed that there may be a "night -lighted regulation tennis court and a
barn that is now being used as a guest House with a great room, kitchen, and
three bedrooms on your property that were constructed without lawful building
permits.
Our information is based on an advertisement prepared by Ms. Kathy Tillson of
Rodeo Realty, Prudential California Realty. We received information from Ms.
Tillson that her statements were in error and would like to verify that fact.
In 1990, the Planning Commission approved a Conditional Use Permit for a
tennis court that specifically states that "court lighting is not permitted" and "the
two (2) existing stables shall remain for horsekeeping and related uses only."
Please let us know in writing about the presence of the tennis court lights and
whether the barn has been converted to a guest house with a great room, kitchen,
and three bedrooms because building permits and land use decisions run with the
land.
Please contact this office within the next twenty day_ s to inform us of whether or
not these illegalities exist.

Please accept my apology for the errors that appeared in my initial advertisements of the
above referenced property. The "night lighted tennis court" was an error on my part since
they are not on the tennis court and are never used by the Taus family. I have included my
revised Brochure and ad copy for you and the Planning Commission to review. In
addition, please note that all references to a "guest house" have been replaced by barn or
stable. It was never my intention to misrepresent or to misinform prospective buyers of the
City of Rolling Hills' Zoning Code requirements.
After reviewing the enclosed advertisements, please advise me of any additional changes
that you recommend. I will certainly comply immediately. I apologize for any
inconvenience that this has caused you.

It has come to the attention of the Planning Department that the
subject property has been listed "for sale" by your firm and
described as having a "night lighted regulation tennis court and a
barn that is now being used as a Guest House with a Great Room,
Kitchen, and three Bedrooms."
It is important for you to note and inform prospective clients of
the following City of Rolling Hills Zoning Code requirements: (1)
tennis court lighting is not permitted and illegal, (2) the use of
a barn as a guest house is not a permitted use and illegal, and (3)
a kitchen is not permitted in a guest house and is illegal. In
addition, the Rolling Hills Planning Commission in Resolution No.
90-38 (November 3, 1990) approved a Conditional Use Permit for a
tennis court that specifically states that "court lighting is not
permitted" and "the two (2) existing stables shall remain for
horsekeeping and related uses only."
It is necessary for present and future owners to be advised of
these illegalities because building permits and land use decisions
run with the land.

This is to inform you that the City Council, at their meeting on
November 13, 1990, received and filed the Planning Commission's
approval of the above referenced planning/zoning case application.
Pursuant to Section 17.32.087, Ordinance No. 207, an Affidavit
of Acceptance form must be executed before the above approval becomes
effective. A copy of the Resolution of Approval, specifying
conditions of approval set forth by the Planning Commission, is
enclosed for your information. Once you have reviewed the Resolution
of Approval, please complete the enclosed Affidavit of Acceptance
form, have the signature(s) notarized, and forward the Affidavit to
the Office of the County Recorder, Room 15, 227 North Broadway, Los
Angeles, CA 90012, with a check in the amount of
$ 7.00. When the Affidavit of Acceptance has been returned to the
City, duly executed and recorded, the Los Angeles County Department

meeting, the Planning Commission voted to approve the above request.
The Planning Commission's decision will be reported to the City
Council at their regular meeting on November 12, 1990. The decision
of the Planning Commission may be appealed pursuant to Sections
17.32.140 and 17.32.150 (enclosed) of the Municipal Code. A copy of
Resolution 614, establishing the fee for filing an appeal, is also
enclosed for your information.

Dear Ray:
Although my wife and I do not object to the tennis court
proposed by our neighbor, after what we went through to obtain
permission for our tennis court, we would like to be satisfied
that they comply with the same requirements to which we agreed
when we applied for our tennis court permit, namely:
1. An accustical study be completed (as was done for our
court) to determine the noise level that would be created on our
property by tennis being played on the proposed court. (Dr.
Bailey, prior owner, informed me at one point that if my tennis
court were below his bedroom, he would have objected
vociferously to its placement, due to the fact that sound
travels upward.)
2. The owner would agree not to play tennis before 9:00 a.m.
3. 36" box trees, placed approximately 10' on center, be used as
screening along the fence line between our properties.
