276, Addition to existing SFR, Resolutions & Approval ConditionsCITY OF ROLLING HILLS PLANNING COMMISSION RESOLUTION NO. 24 A RESOLUTION OF. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS CONDITIONALLY APPROVING ZONING CASE NO. 276 A ZONE VARIANCE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS HEREBY RESOLVES AND ORDERS AS FOLLOWS: SECTION 1: A public hearing to consider the proposed Variance with respect to real property described. in Exhibit "A" of Zoning Case No. 276 attached hereto was duly held on June 1, 1982 in the Council Chambers of the City Hall, 2 Portuguese Bend Road,. Rolling Hills, California. Notice of the time, date, place and purpose of the aforesaid hearing was duly given. SECTION 2: Evidence, both written and oral, was duly presented to and considered by the Planning Commission at the afore- said public hearing The applicant was represented by George Sweeney, Architect. SECTION 3: The Planning Commission finds, pursuant to the provisions of Section 17.32, Variances and Conditional Use Permits, of the Rolling Hills Municipal Code, that: 1. The Commission visited the subject property an an adjourned meeting on June 1, 1982. 2. The Commission found that the subject property was so situated as to be remote from surrounding residences. 3. The Commission found that the subject property was an irregularly shaped flag lot; 4. The Commission found that the greatest portion of the subject property was steep sloping terrain. 5. The Commission found that the strict application of Code requirements would cause an unnecessary hardship. 6. The Commission found that the proposed construction is consistent with the neighborhood pattern and would not adversely impact neighboring properties. SECTION 4: Based on the foregoing findings the Commission hereby approved Zoning Case. No. 276, a request to construct residence additions in the required yards, subject to the following conditions: 1. This Zone Variance hall not be effective for any purpose until the owner of the property involved, or. his duly authorized rep- resentative, has filed with the City Clerk of the City of Rolling Hills an affidavit stating that he is aware of and agrees to comply with all the conditions of the grant. 2. It is declared to be the intent of the Planning Commis- sion that if any provision of the grant is held or declared to be invalid the grant shall .be void and the privileges granted thereunder shall lapse. 3. It is declared and made a condition of the grant. that if any conditions thereof are violated or if any law, statute or ordinance is violated, the grant shall be suspended and the privil- eges granted thereunder shall lapse, provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days. • 4. All requirements of the Zoning Ordinance and of the zone in which the subject property is located must be.complied with unless otherwise set forth in the grant, or shown otherwise on an approved plan. 5. A revised Exhibit "A" shall be submitted to the satis- faction of the staff and the property shall be developed and main- tained as shown. 6. Provide a paved or graveled ten (10) foot wide access drive immediately adjacent to the northerly room addition. 7. Maintain the existing stand of eucalyptus in the area immediately north of the northerly room addition. Plant additional eucalyptus in the area adjacent to the proposed driveway to the satisfaction of the City staff. SECTION 5: The Secretary shall certify to the adoption of this resolution and shall transmit copies of the same to the permit holder and to the City Clerk. SECTION 6: This action shall become final and effective twenty (20) days after the adoption of this resolution unless within such time an appeal is filed with the City Clerk in accordance with the provisions of the Rolling Hills Municipal Code..
