128, Construct pool in side yard, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Fritz Egger Lot 43-SF ZONING CASE NO. 128 FINDINGS AND REPORT The application of Mr. Fritz Egger, Lot 43-SF, Southfield Tract, for a variance of Side Yard Requirements under Article III, Section 3.07 of Ordinance No. 33 came on for hearing on the 21st day of August, 1973 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Fritz Egger, is the owner of that certain real property described as Lot 43-SF, Southfield Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission finds, further, that no communication, written or oral, had been received in opposition to the request, and that Mr. Chester Noble, 6 Ringbit Road East and Dr. Richard Small, 5 Flying Mane Lane, had reviewed the plans and stated that they had no objection to the pool in the proposed location. Further, Mr. James Millhauser, 2 Ringbit Road East, said he concurred that the site chosen is the ideal location, since the pool would be 23 feet from his residence, and screened by a row of evergreens; however, Mr. Millhauser requested that the pool company be required to post a bond guaranteeing completion, because of soil conditions in the area, and as protection for his property. The Commission further finds that the applicant requests the variance to permit construction of a swimming pool in the side yard, occupying 19', leaving one foot of side yard and a ten foot easement between the side property line and the outer edge of the pool.
