94, Construct a retaining in front, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY'OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. Clifford R. Barbee Lot 42SF Zoning Case No. 94 FINDING AND FORMAL REPORT The application of Mr. Clifford R. Barbee, Lot 42SF, Southfield Tract, for variances of front and side yard requirements under Article III, Sections 3.06 and 3.07 of Ordinance No. 33 came on for hearing on the 21st day of April, 1970 at the hour of 8:00 P.M. at the Administration Building of the City of Rolling Hills, California, and the applicant, having submitted evidence in support of his application, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. I, The Commissionfinds that the applicant, Mr. Clifford R. Barbee, is the owner of that certain real property described as Los 42SF, Southfield Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said appli- cation was givenas required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. IIo The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition thereto. III0 The Commission further finds that the lot was pre -graded, and placement of the house on the pad is limited, but bridle trail ease- ments were reserved, and the variances were requested for construction of a retaining wall in the side and front yard. The owner stated, further, that the wail would be constructed of smooth poured concrete, painted white in compliance with requirements of the Rolling Hills Community Association, and he would be willing to do necessary plant- ing to soften the effect of the wall. The Commission finds, there- fore, that the variance of front and side yard requirements to allow construction of a retaining wail in the front and side yards should be granted to the applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detri- mental to the public welfare, nor injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of front and side yard requirements should be granted by the Planning Commis- sion of the City of Rolling Hills to Mr, Clifford R. Barbee, Lot 42SF Southfield Tract, in accordance with the plot plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered.
