SUBJECT: ZONING CASE NO. 424; Request for Conditional Use Permit to
establish and maintain a guest house and Site Plan Review to
determine compatibility of the proposed guest house with the
site; 5 Quail Ridge Road South, Lot 113-RH; Owner: Don Borden
DISCUSSION
The Planning Commission, at their regular meeting of March 20, 1990,
continued the above -stated application to an adjourned meeting so as to
conduct a site inspection. The applicant is requesting a conditional use
permit and site plan review in order to construct and maintain an 800
square foot guest house on the property.
Issues and concerns raised at the previous meetings were discussed as
follows:
1. The paramount issue is use compatibility of the proposed guest
house with the site and surrounding properties. Findings that must be
determined include consistency with the purposes and objectives of the
zoning ordinance, and desirability to the public welfare and convenience.
2. Project details indicate that grading on the lot will not be
required, and that construction can be accomodated upon the existing
topography that includes the slope along the side of the property. This
proposal was observed on the field trip. Further, there would appear to
be no view impairment concerns. Should the request be approved, the
standard condition for landscaping must be included.
3. New construction of structures require site plan review and the
eight findings of fact set forth by the code must be satisfied.
4. Standard requirements for guest houses include no rental, no
kitchen or other cooking facilities, and no vehicular access or paved
parking area be developed within 50 feet.
RECOMMENDATION
Staff recommends that the Planning Commission closely examine the proposal
for land use compatibility, and evaluate potential impacts to the site and
surrounding properties. Before a conditional use permit may be granted,
the Commission must determine if the required showing is present in that
granting of the conditional use permit would be consistent with the
purposes and objectives of the zoning ordinance, and would be desirable to
the public convenience and welfare. Further, the Commission must consider
site plan review for the project and determine that findings required for
approval as set forth by the ordinance are satisified.

REVIEW AND EVALUATION OF ISSUES
In reviewing the applicant's request under Title 17 (Zoning), Staff would
identify the following issues for evaluation:
1. The applicant proposes to construct and maintain an 800 square
foot guest house on the main portion of the property bisected by Quail
Ridge Road. The structure will comply with required building setbacks.
A future stable is indicated on plans.
2. The applicant's design professional indicates that no grading is
required for development of the project.
3. Standard requirements for such uses include no rental, no kitchen
or other cooking facilities, and no vehicular access or paved parking area
be developed within 50 feet.
4. The new construction requires site plan review and the eight
findings of fact set forth by the ordinance must be satisfied.
