Dear Ms. Johnson,
One of the conditions of approval of your project in Zoning Case No. 806,
approved by Resolution No. 1116 requires that you landscape the property,
including screen the sports court, after construction and prior to obtaining
grading permit deposit with the City a security deposit for installation of the
landscaping and irrigation.
Your estimate for the landscaping and irrigation in the amount of $78,050 has
been accepted by the City. Therefore, a security instrument in the amount of
$89,757 (naming the City as secondary beneficiary) or in favor of the City shall be
deposited with the City. This includes the cost of material and labor plus 15%
City fee.
In accordance with Resolution No. 1116, the security deposit shall be retained
with the City for not less than two years after landscape installation. The retained
deposit will be released by the City after the City Manager/Planning Director
determines that the landscaping was installed pursuant to the landscaping plan
as approved, and that such landscaping is properly established and in good
condition. Please keep accurate records of when planting was installed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS
GRANTING APPROVAL FOR A SITE PLAN REVIEW FOR GRADING AND
CONSTRUCTION OF A NEW RESIDENCE AND ACCESSORY STRUCTURES,
GRANTING A VARIANCE TO EXCEED THE MAXIMUM PERMITTED GRADING
QUANTITIES FOR A SPORTS COURT AND GRANTING CONDITIONAL USE
PERMITS TO CONSTRUCT A DETACHED GARAGE AND A SPORTS COURT IN
ZONING CASE NO. 806, AT 17 CREST ROAD EAST, (LOT 9-FT), (JOHNSON).
PROJECT HAS BEEN DETERMINED TO BE EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA).
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND,
RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Ms. Ann L Johnson with respect to real property
located at 17 Crest Road East, Rolling Hills (Lot 9-FT) requesting a Site Plan Review, Conditional Use
Permit and a Variance. The project entails grading of total of 12,703 cubic yards of dirt (cut and fill), to
construct a new 8,796 square foot residence with 702 square foot attached garage and 1,139 square foot
basement; 2,087 square feet covered porches at the main residence, 527 square feet porte cochere, 1,045
square foot detached garage, 4,700 square foot sports court, 240 feet long retaining wall which would
range in height from 0' to 5 feet, 648 square foot covered porch at the existing stable and a 745-square
foot detached trellis by the existing swimming pool. A 125 square feet water feature and 158 square foot
service yard and a small barbeque are also proposed.
The applicant also seeks a Variance to allow 3,632 c.y. when compacted (4,273 c.y. before compaction)
grading for the sports court.
Section 2. Following Planning Commission's approval of the project the City Council took
jurisdiction of the project. Pursuant to Section 17.54.015 of the Rolling Hills Municipal Code, a review
hearing for cases taken under jurisdiction by the City Council shall be conducted as de novo hearings.
Section 3. The City Council conducted duly noticed public hearings to consider the application
on January 3, 2012 in the field and at an adjourned meeting on January 9, 2012. Neighbors within 1,000-
foot radius were notified of the public hearings and a notice was published in the Daily Breeze on
December 1, 2011. The applicant was notified of the public hearings in writing by first class mail.
Evidence was heard and presented from all persons interested in affecting said proposal and from
members of the City staff, neighbors and applicant's engineers and the City Council having reviewed,
analyzed and studied said proposal.
Section 4. The property is zoned RAS-2 and the gross lot area is 9.64 acres. The net lot area
for development purposes is 9.08 acres or 395,840 square feet. The lot fronts on Crest Road East and a
small portion backs up to Portuguese Bend Road. The stable and the riding ring are located in the front
yard and the existing house is located in the rear of the property. The existing house will be demolished
and the proposed house will be located in the general location of the existing house, on an enlarged
building pad. The stable and riding ring are considered legal nonconforming.
Section 5. The City Council finds that the project qualifies as a Class 3 Exemption, and is
therefore categorically exempt from environmental review under the California Environmental Quality
Act.
Section 6. Section 17.46.030 requires a development plan to be submitted for Site Plan
Review and approval before any grading requiring a grading permit or any building or structure may be
constructed or any expansion, addition, alteration or repair to existing buildings may be made which
involve changes to grading or an increase to the size of the building or structure by at least 1,000 square
feet and has the effect of increasing the size of the building by more than twenty-five percent (25%) in
any thirty-six (36) month period. With respect to the Site Plan Review application requesting grading
and construction of a new residence and accessory structures, the City Council makes the following
findings of fact:
A. The proposed development is compatible with the General Plan, the Zoning Ordinance
and surrounding uses because the proposed structures comply with the General Plan requirement of low
profile, low -density residential development with sufficient open space between surrounding structures.
The project is located on a large lot, over 9 acres, and will not look overdeveloped. The homes in the
neighborhood are similar in size to the proposed home on smaller lots. The project conforms to Zoning
Resolution No. 1116 (17 Crest E.)

Gentlemen I am not an engineer or geologist, but, as a very long time observant
resident, I get concerned whenever there is an intention to excavate on the south
side of Crest Road East. The above Case No. 806 involves what you describe as
"substantial aradina" and a "Variance to exceed the maximum permitted aradina
Quantities". I always remember how close the slide area is on the south side of
Crest Road East, and also remember that the Portuguese Bend slide, that is still
not under control, resulted from excavation on that side of the hill. I also assume
that "maximum permitted grading quantities" must have had some reason for
being created.
Being a good neighbor is important to us. But also, we want to be sure no risky
excavation is to take place. So, we ask you to be very careful and that you have
irrefutable reports and backup from completely objective and reliable sources
showing absolutely no risk of generating a new slide or activating an old one.
I am not able to attend the meeting on the 13, and would have nothing to
contribute except the above in any event.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week precedine the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 2' - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

This letter shall serve to notify you that the Planning Commission at their regular
meeting on November 15, 2011, adopted a Resolution, with conditions, granting your
request in Zoning Case No. 806. That action, accompanied by the record of the
proceedings before the Commission will be reported to the City Council on Monday,
November 28, 2011, at their regular meeting beginning at 7:30 PM. You or your

The Planning Commission's decision in this matter shall become effective thirty days

In response to the lone "no -vote" at yesterday's planning commission hearing, please see the
following explanation:
The quantity of earthwork/grading is mostly driven by the results of geotechnical exploration
and tests. After extensive subsurface investigation and geotechnical calculations it was
determined that the current location of the house was the best location for the following
reasons:
1. Over TT of the current house is located within the theoretical factor of safety/failure plane
(the "Geological Setback") for hillside construction. By moving the location of the new house to
its current location, with the exception of a small portion of the southeast corner, it is located
outside of the Geological setback. As an alternative, if the new house pad were to be located to
the north towards Crest Road, it would encroach on the existing (legal, non -conforming) Stable
structure which would have to be demolished.
2. The pad of the new house will be lowered a few feet to actually reduce the depth/amount
of fill required at the west side of the house plus the added benefit providing for a stable
foundation by moving the finish floor elevation closer to the bedrock strata as well as providing
a much more reasonable economic solution than an exorbitant quantity of deep caissons. The
resulting excavation will produce a quantity of fill material that will either have to be (i) disposed
of somewhere in the front yard, (ii) exported from the site, or (iii) used for fill by locating a
sports court near the southeast motor court (which will not be visible from surrounding
properties or from Crest Road).
3. Regarding drainage; best engineering practices have been employed to help control
moisture content at the site which is near the top of the hill in a hillside construction
environment. The preliminary drainage design has considered impact to surrounding properties,
controlling moisture and minimizing saturation at the top of the hill, and directing runoff to
proper drainage courses. Final drainage plans will be designed per County of Los Angeles plan
check approval.
I believe that our project is in compliance with the zoning and planning ordinances with the
exception of the CUP request for the sports court and detached garage and the variance for
additional fill (to balance the site) at the sports court. It should be noted that the sports court
and southeast motor court will be substantially below the existing grade of the riding ring and
Stable and will not be visible from Crest Road East or surrounding properties. Also it is a benefit
to the geological stability of the project to reduce moisture infiltration into the soil at the top of
the hill by using the hardscape areas to capture and redirect water runoff to the proper drainage
courses.

Dear Ms. Schwartz,
Pursuant to telephone and email correspondence (the
"Correspondence") on February 18 and February 20, 2014, respectively
between Dan Ristow of Jerico Development, Inc. ("Jerico") and
Yolanta Schwartz of the City of Rolling Hills (the "City") regarding
the single family construction project (the "Project") commonly
known as the Ann Johnson project at 17 Crest Road E., Rolling Hills,
California, this letter hereby confirms, (i) the commitment by
Jerico to perform certain work and, (ii) determinations and
approvals by the City of Rolling Hills and the County of Los Angeles
authorizing Jerico to proceed with such work contingent upon certain
conditions. The following provides confirmation of the
Correspondence as it relates to each party:
1. Jerico has notified the City that there is a substantial
shortage of fill material relating to the grading work at the
Project.
2. Jerico has proposed a solution to produce additional fill
material necessary to balance the site by, (a) using structural
excavation spoils material for fill material and, (b) lowering
the elevation of the pad by twelve inches (12"). The final
elevation of the sports court will be adjusted as necessary to
achieve balanced grading quantities.
3. Jerico has assured the City that the limits of grading for the
Project will not change from the current grading plan as
approved by the County of Los Angeles Department of Public
Works, Building and Safety Division (the "County").

4. Jerico will submit an amended grading plan to the City and the
County for review and approval, and will provide a final as -
built grading plan verifying final elevations.
5. The City has provided to Jerico via the Correspondence that it
has coordinated with the County and that Jerico's proposal to
lower the elevation of the Project pad by twelve inches (12")
is conditionally approved (pursuant to foregoing items 1
through 4) by the City and County.
This letter provides confirmation of the Correspondence as written
herein and Jerico will proceed with the grading of the Project in
accordance with the approved grading plan as amended herein; and
will submit an amended grading plan verifying the same as
expeditiously as possible. If you find any errors or omissions in
the foregoing confirmation of Correspondence please notify Jerico
within two (2) working days.
Jerico greatly appreciates the expeditious review and reply by both
the City and the County regarding this matter thereby allowing
Jerico to continue with the grading work at the Project.

Dear Ms. Johnson:
The Planning Commission at the September 20 meeting scheduled a field trip to your
property to view a silhouette of the proposed project on Tuesday, October 18, 2011 at
7:30 A.M. Your neighbors will also be notified of the meeting.
The owner and/or representative must be present to answer any questions the
Commissioners may have regarding the proposal.
• A full-size silhouette in conformance with the
attached guidelines must be prepared for ALL
P ROPOSED STRUCTURES of the project showing the
footprints, roof ridges, entryways, covered porches
and trellises;
S take the property lines in the vicinity of the area
of grading and construction
S how the height of the finished floor of the
proposed structures;
• Stake the projections beyond the footprint of the
proposed structures, including the porch for the
stables (i.e. porches/trellises/porte cochere) in a
different color flags;
• Stake the limits of grading;
• Stake the limits of the basement and light well;
• Stake the limits of grading for the driveway
• Stake the pergola by the pool and all walls
• Stake the sports court
After the field trip, the next regular meeting of the Planning Commission will take place
on the same day, Tuesday. October 18. at 6:30 PM at City Hall, at which time the
Commission will further discuss and deliberate your proposal.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 2'h - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
