L. A. RIEMER Lot 18, Rolling Hills, MB 201-23/35 ) ) ) ZONING CASE NO. 45 FINDINGS AND FORMAL REPORT The application of Mr. & Mrs. L. A. Riemer, Lot 18, Rolling Hills Tract, for a side yard variance, came on for hearing on the 26th day of May, 1964 at the hour of 8:00 P.M., at the City Hall of the City of Rolling Hills, California, and the applicants having submitted evidence in support of their application, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of • Rolling Hills, California. I. The Commission finds that the applicants, Mr. and Mrs. L. A. Riemer, are the owners of that certain real property described as Lot 18, Rolling Hills, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33, of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance and that no evidence was received by the Commission in opposition thereto. 1IT_. The Commission further finds that the proposed patio canopy is to extend ten (10) feet into the sideyard of said lot instead of the twenty-five (25) ,103 Ad00 ,, 0213 X A dO3L �O tl_7X inches for overhang permitted by said Zoning Ordinance, and further finds that the variance should be granted to applicants in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of s:zch variance will not be materially detrimental to the public welfare or injurious to property or improvements in such vicinity and zone in which applicants' property is located, and that there are exceptional and extraordinary circumstances and conditions by reason of physical location and terrain of said Lot 18 which do not apply generally to other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Mr. and Mrs. L. A. Riemer of Lot 18 of Rolling Hills Tract in accordance with the plot plan marked Exhibit I and the construction detail marked Exhibit II on file in these proceedings, and it is, therefore, so ordered.
