92, Construct a tennis court with , Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Dr. Donald Wright Lot 14RH ZONING CASE NO, 92 FINDING AND FORMAL REPORT The application of Dr. Donald E. Wright, Lot 14RH, Rolling Hills Tract, for a variance of front yard requirements under Article III, Section 3.06 of Ordinance No. 33 came on for hearing on the 30th day of September, 1969 at the hour of 8:00 P.M. at the Administration Building of the City of Rolling Hills, California, and the applicant, having sub- mitted evidence in support of his application, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. Io The Commission finds that the applicant, Dr. Donald E. Wright, is the owner of that certain real property described as Lot 14RH, Rolling Hills Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.0 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. IIo The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evi- dence was received by the Commission in opposition thereto. III. The Commission further finds that in order to construct a tennis court on his property it would be most desireable to located it in the front yard. He stated that location in the rear yard was not feasible because it would eliminate the parking area near the barn on his property, and would require relocation of the seepage pit. Dr. .Wright .submitted .plans -marked "A",-"B"-and Revised Plan "B" in support of his request. The Planning Commission finds that Location "B", in the front yard is more acceptable than Location "A" in the rear yard, and after discussion, decided that the orientation in Revised Plan "B" was considered most acceptable. The Commission finds, therefore, that a variance to permit construction of a tennis court in the front yard should. be granted to the applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. Iv From the foregoing it is concluded that a variance of front yard requirements should be granted by Planning Commission of the City of Rolling Hills to Dr. Donald E. Wright, Lot 14RH, Rolling Hills Tract, in accordance with the plot plan marked "Revised Plan B" on file in these proceedings, and it is, therefore, so ordered.
