Expires Feb 26, 2022 • Exhibi-l- A RESOLUTION NO. 2018-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING APPROVAL FOR A SITE PLAN REVIEW, CONDITIONAL USE PERMIT, AND VARIANCES TO ALLOW GRADING, WALLS, AND A 5,000 SQUARE FOOT RIDING RING IN THE FRONT SETBACK AND FRONT YARD AND , TO IMPORT DIRT IN ZONING CASE NO. 947 AT 34 SADDLEBACK ROAD, LOT 13- RH, (EDDY DELGADO). TIlE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Thomas Yuge on behalf of the property owner, Eddy Delgado, with respect to real property located at 34 Saddleback Road, Rolling Hills (Lot 13-RH) requesting a Site Plan Review for grading of 671 cubic yards and retaining walls greater than 36 inches, up to a maximum of 48 inches in height with the highest point of each wall represented on the plans as 45 inches; Conditional Use Permit for a 5,000 square foot riding ring and .Variances allowing encroachment into the required 50 foot front yard setback and construction in front of the leading edge of the residence with the riding ring; encroachment into the required side yard setback with short walls, grading that requires the iinpo±t of 189 cubic yards of dirt, disturbance of the lot to exceed the maximum permitted. Section 2. The Planning Commission conducted a duly noticed public hearing on September 25, 2018 at the morning meeting at the subject property. That evening the Planning Commission conducted a duly noticed and continued public hearing on that same date. At the September 25, 2018 evening meeting, the Planning Commission provided direction to staff to prepare a resolution of approval for the proposed project. Neighbors within a 1,000-foot radius were notified by mail of the public hearings and a notice was published in the Peninsula News on September 13, 2018. The applicants and their agents were notified of the public hearings and the applicants and agents were in attendance at the hearings.. Evidence was heard and presented from all persons interested in affecting said proposal, and from members of the City staff. Section 3. The property is zoned RAS-1 and the gross lot area excluding the roadway easement is 2.71 acres. The net lot area for development purposes is 2,32 acres or 101,040 square feet, which is well above the minimum lot area required by the zone. The existing property is currently improved with an existing 4,379 square foot house with a,640 square foot garage, 1,140 square foot stable, 780 square foot swimming pool & spa and other miscellaneous structures. Resolution No. 2018-15 1 • Section 4. The Planning Commission finds that the project is exempt from the California Environmental Quality Action (CEQA) pursuant to Class 3, Section 15303 of the CEQA guidelines: Section 5. Site Plan Review. Section 17.46.010 of the Rolling Hills Municipal Code permits approval of grading and walls above three feet in height under Site Plan Review. (RHMC Sections 17.46.020 (A)(1) and 17.16.190(F).) The Planning Commission must consider applications for Site Plan. Review and may, with such conditions as are deemed necessary, approve a project; which complies with the required findings under RHMC Chapter 17.46. With respect to the requests for Site Plan Review, the Planning Commission finds as follows: A. The project complies with and is consistent with the goals and policies of the general plan and all requirements of the zoning ordinance. The proposed grading and retaining walls are consistent with the General PIan. The grading will be used to create a riding ring which is consistent with the, equestrian nature of the City. The proposed walls are required for the construction of the riding ring, and meet the requirement for heights of walls in the City. B. The project substantially preserves the natural and undeveloped state of the lot minimizing building coverage. The grading substantially preserves the natural and undeveloped state of the lot since it is being used to create a riding ring which will. minimize the building coverage on the lot. No new building is being proposed on the lot. Despite the grading, there is remaining open space in the front yard area. The retaining walls also preserve the natural and undeveloped state of the lot by providing support to the lot. Additionally, the walls are 4 feet at their highest point and do not obstruct the natural, state of the lot. The walls will be screened. C. The project is harmonious in scale and mass with the site, the natural terrain and surrounding residences. The grading and resulting riding ring are harmonious in scale and mass with the site and are consistent with the scale of the neighborhood considering some of the recent riding rings constructed in the neighborhood. The visibility of the grading and resulting riding ring and wails were taken into consideration when viewing the proposed improvements from the roadway easement. The walls will be screened and are minimally visible from the wad or other properties. D. The project preserves and integrates into the site design, to the greatest extent possible, existing topographic features of the site, including surrounding native vegetation, mature trees, drainage courses and land forms (such as hillsides and knolls). The grading was introduced in part to preserve some of the mature trees on the property. Even though there is grading being conducted on the property, drainage Resolution No. 2018-15 2 courses on the perimeters of the property will not change. The riding ring walls will be located behind new and existing landscaping. E. The grading has been designed to follow natural contours of the site and to minimize the amount of grading required to create the building area. The size of the riding ring has been scaled in size to preserve a knoll area behind the ring and to minimize grading on the property. F. Grading will not modify existing drainage channels nor redirect drainage flow, unless such flow is redirected into an existing drainage course. All drainage plans will be reviewed by. the Building and Safety Department and shall be completed to •the satisfaction of its staff. Even though there is grading being conducted on the property, drainage courses on the property will not be affected. G. The project preserves surrounding native vegetation and mature trees and supplements these elements with drought -tolerant landscaping which is compatible with and enhances the rural character of the community, and landscaping provides a buffer or transition area between private and public areas. The grading has taken into account the surrounding vegetation and trees and has been designed to largely preserve the mature trees on the property. Vegetation will be planted to help screen the retaining walls for the riding ring. The riding ring was originally designed differently but was changed to preserve mature trees that provide shade to the horses. H. The project is sensitive and not detrimental to the convenient and safe movement of pedestrians and vehicles. Neither the grading nor the retaining walls will change the existing driveway apron. There is ample parking on the property and there is parking for guests on site. I. The project conforms to the requirements of CEQA; as previously stated, the project is exempt from CEQA, Class 3, Section 15303 of the CEQA guidelines, Section 6. Conditional Use Permit. Sections 17.18.050(A)(5) of the Rolling Hills Municipal Code permits approval of a horseback -riding ring with a Conditional Use Permit. The Planning Commission must consider applications .for a Conditional Use Permit and may, with such .conditions as are deemed necessary, approve a conditional use which complies with the findings in RHMC Section 17.42.050. The proposed 5,000 square foot riding ring complies with all requirements of this section except that it is being located in the front yard and front yard setback, requires grading in excess of the maximum allowable disturbance, and requires importation of dirt. Variances for those conditions are being granted concurrently in this resolution. With respect to this request for a Conditional Use Permit, the Planning Commission finds as follows: Resolution No. 2018-15 3 A. The proposed conditional use is consistent with the General Plan, The granting of a Conditional Use Permit for the riding ring would be consistent with the purposes and objectives of the Zoning Ordinance and General Plan because the use is consistent with similar uses in the community, and meets all the applicable code development standards for such use's, and is located in the area on the property that is adequately sized to accommodate such use. The proposed use is sufficiently separated from nearby structures. The riding ring will be constructed in furtherance of the Rolling Hills goal of encouraging equestrian uses within the'City. B. The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and that the use will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures. The proposed riding ring use is separated from the roadway easement, is of sufficient distance from nearby residences so as to not impact the view or privacy of surrounding neighbors or cause obnoxious odor near surrounding neighbors, and is conveniently located for enjoyment of the property owners. C. The site for the proposed conditional use is of adequate size and.shape to accommodate the use and buildings proposed. The proposed use complies with the low profile residential, development pattern of the community and will not give the property an over -built look, since the riding ring will remain open and unobstructed. The lot is 2.32 net lot acres and is sufficiently large to accommodate a 5,000 square foot, riding ring, The riding ring will be compatible with the uses in the surrounding area because Rolling Hills encourages equestrian uses, D. The proposed conditional use complies with all applicable development standards of the zone district. The riding ring meets the requirements in Sections 17.18.050(A)(5). and 17.18.100 of the Zoning Ordinance except that it is being located in the front yard and front yard setback; requires grading, which causes exceedance of the maximum allowable disturbance, and requires importation of dirt. Variances are being granted concurrently herewith. E. The proposed conditional use is consistent with the portions of the Los Angeles County Hazardous Waste Management Plan relating to siting criteria for hazardous waste facilities. The project site is not listed on the current State of California Hazardous Waste and Substances Sites List, F. The proposed conditional use observes the spirit and intent of this title. . The property currently is improved with a stable and corral and the riding ring furthers the City's goal for promoting equestrian uses. Section 7. Variances. Sections 17.38.010 through 17.38.030 of the Rolling Hills Municipal Code permit approval of Variances granting relief from the standards and requirements of the Zoning Ordinance when exceptional or extraordinary Resolution No. 2018-15 4 circumstances applicable to the property prevent the owner from making use of a parcel of property to the same extent enjoyed by similar properties in the same vicinity or zone. A variance from the requirements of RHMC Section 17.16.110 (structures cannot be located in the front setback), Section 17.18.100 (riding ring cannot be located in front yard),Section 17.16.120 (structures cannot be located in the side yard setback), Section 16.20.210 (40%. maximum disturbed area), and Section 15.04.170 (balanced cut and fill for grading) is required. With respect to the aforementioned request for variances, the Planning Commission finds as follows: A. There are exceptional or extraordinary circumstances and conditions applicable to the property that do not apply generally to other properties in the same vicinity and zone. In a previous proposal, the applicant proposed placing a riding ring in the area of a stable and corral in the rear of the property. At that time, the Planning Commission requested that the applicant move the riding ring to the front of the property to allow for the development of equestrian uses that would not crowd one area of the lot. This change also eliminated the need for greater grading of the lot. Due to the topography of the area of the riding ring, the import of 189 cubic yards of dirt is necessary to allow for the ring to slope for proper drainage. The topography also requires retaining walls surrounding the riding ring. The importation of dirt allows the project to utilize short retaining walls rather than higher retaining walls to make the riding ring functional. The disturbance of the site 'is already over the 40% maximum and all of the increase in disturbance for the proposed project is for the riding ring. It adds less than 8% to the existing disturbance. B. The variances are necessary for the preservation and enjoyment of a substantial property rights possessed by other properties in the same vicinity and zone but which is denied to the property in question. The riding ring in the front yard setback is necessary to the preservation of the Applicant's property right since the placement of the riding ring must be to the front of the property as it is the only space sufficiently large for the riding ring without crowding other equestrian uses or greater grading. A riding ring is an amenity enjoyed by many property owners in the City. The walls and grading axe necessary in order to construct the ring, which require import of dirt. The disturbance for the site.is already over the 40% maximum and all of the increase in disturbance for the proposed project is for equestrian purposes and will add less than 8% disturbance to the lot. If a riding ring is added to the property at all then it must include additional disturbance. Resolution No. 2018-15 5 C. The granting of the variances will not be materially detrimental to the public welfare or injurious to the properties or improvements in such vicinity. The riding ring reinforces the equestrian character of the areas surrounding this lot. Even though the riding ring is in the front yard area, the front yard area will remain as open space and will not be built upon. Therefore, it will not change the character of the area. The walls for the riding ring will be minimally visible from adjacent properties and the roadway easement. The trees on the property will be preserved; providing shade to the horses and natural beauty to the neighborhood. It will not negatively affect drainage or traffic circulation to and from the property. The disturbance for the site is already over the 40% maximum and all of the increase in disturbance for the proposed project is for equestrianpurposes, and will add less than 8% disturbance to the lot. The import of dirt would allow for proper drainage, Iower walls anda functional riding ring. D. In granting the variance, the spirit and intent of the Zoning Ordinance will be observed. The equestrian use in the front yard setback will be within the spirit and intent of the Zoning Ordinance. It will not detrimentally affect the rural and equestrian character of the community. The design of the improvements is orderly and attractive. The style is cohesive with the rural and equestrian character of the neighborhood. The disturbance for the site is already over the 40% maximum and all of the increase in disturbance for the proposed project is for equestrian purposes, and will add less than 8% disturbance to the lot. The 189 cubic yards of imported dirt would allow for proper drainage, lower walls and a functional riding ring. B. The variances will not grant special privilege to the applicant. The riding ring is consistent in size and location with other riding rings within the City. The proposed riding ring in the front yard is smaller in size than several of the newer riding rings in the City, a couple of which are along Saddleback Road. The older riding rings in the City are primarily the size of the proposed riding ring. The import of dirt would allow for proper drainage, lower walls and a functional riding ring. The disturbance for the site is already over the 40% maximum and all of the increase in disturbance for the proposed project is for equestrian purposes, and will add less than 8% disturbance to the lot, Many properties in the City, when first developed, were graded to a larger disturbance percentage than 40%, and any additional development that requires changes in topography, no matter how slight, will exceed the amount of the previously disturbed area of the lots. Resolution No. 2018-15 5 F. The variances are consistent with the portions of - the County of Los Angeles Hazardous Waste Management Plan relating to siting and siting criteria for hazardous waste facilities. The project site is not listed on the current State of California Hazardous Waste and Substances Sites List. It will not affect any existing hazardous waste management facilities. G. The variances are consistent with the General Plan of the City of Rolling Hills. Although the variances will allow the riding ring in the, front yard setback and front yard area, retaining walls in the side yard setback, .disturbance in excess of the maximum allowable, import of dirt, it will allow the property owner to make greater use of the property., Accordingly, the project is still in line with the General Plan's requirement of low profile, low -density residential development with sufficient open space between surrounding structures. Finally, the riding ring is in line with the City's General Plan's focus on an equestrian community. • There is still sufficient space in the setbacks to buffer the property's residential use from other neighboring residences. Section 8. Based upon the foregoing findings, and the evidence in the record, the Planning Commission hereby approves Applicant's requests in Zoning Case No. 946 Site Plan Review for grading of 671 cubic yards and retaining walls greater than 36 inches, up to a maximum of 48 inches in height with the highest point of each wall represented on the plans as 45 inches; Conditional Use Permit for a 5,000 square foot riding ring and Variances allowing encroachment into the required 50 foot front yard setback and construction in front of the leading edge of the residence with the riding ring, encroachment into the required side yard setback with walls, grading that requires the import of 189 cubic 'yards of dirt and to exceed the maximum permitted disturbance of the lot, subject to the following conditions: A. This approval shall expire within two years from the effective date of approval unless the approval granted is otherwise extended pursuant to the requirements of RHMC Sections 17.42.070 and 17.38.070. B. If any condition of this resolution is violated, the entitlement granted by this resolution shall be suspended and the privileges granted hereunder shall lapse and upon receipt of written notice from the City, all construction work being performed, if any, on the subject property shall immediately cease, other than work determined by the City Manager or his/her designee required to cure the violation. The stop work order will be Iifted once the Applicant cures the violation to the satisfaction of the City Manager or his/her designee. In the event that the Applicant disputes the City Manager or his/her designee's determination that a violation exists or disputes how the violation must be cured, the Applicant may request a hearing before the City Council. Resolution No. 2018-15 7 • The hearing shall be scheduled at the next regular meeting of the City Council for which the agenda has not yet been posted, the Applicant shall be provided written notice of the heating. The 'stop work order shall remain in effect during the pendency of the hearing. The City Council shall make a determination as to whether a violation of this Resolution has occurred. If the Council determines that a violation has not occurred or has been cured by the time of the hearing, the Council will lift the stop work order. If the Council determines that a violation has occurred and has not yet been cured, the Council shall provide the Applicant with a deadline to cure the violation; no construction work shall be performed on the property until and unless the violation is cured by the deadline, other than work designated by the Council to accomplish the cure. If the violation is not cured by the deadline, the Council may either extend the deadline at the Applicant's request or schedule a hearing for the revocation of the entitlements granted by this Resolution pursuant to Chapter 17.58 of the RHMC. C. All requirements of the Building and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located must be complied with unless otherwise set forth in this permit, or shown otherwise on an approved plan. Construction fencing may be required. D. The lot shall be developed and maintained in substantial conformance with the site plan on file received on September 25, 2018 except as otherwise provided in these conditions. The working drawings submitted to the Department of Building and Safety for plan check review shall conform to the approved development plan. All conditions of the Site Plan Review, Conditional Use Permit, and Variance approvals shallbe incorporated into the building permit working drawings, and where applicable complied with prior to issuance of a grading or building permit from the building department. The conditions of approval of this Resolution shall be printed onto building plans submitted to the Building Department for review and shall be kept.on site at all times. Any modifications and/or changes to the approved project, including resulting from field conditions, shall be discussed and approved by staff prior to implementing the changes. B. Prior to submittal of final working drawings to Building and Safety Department for issuance of building permits, the plans for the project shall be submitted to City staff for verification that the final plans are in compliance with the plans approved by the Planning Commission. P. A licensed professional preparing construction plans for this project.for Building Department review shall execute a Certificate affirming that the plans conform in all respects to this Resolution approving this project and all of the conditions set forth therein and the City's Building Code and Zoning Ordinance. Resolution No. 20i8-15 8 Further, the person obtaining a building and/or grading permit for this project shall execute a Certificate of Construction stating that the project will be constructed according to this Resolution and.any plans approved therewith. G. Structural lot coverage' of the lot shall not change from the existing condition, which is 10.1%. The total lot coverage proposed, including structures and flatwork, shall not exceed 23,644 square feet or 23.4%, of the net lot area, in conformance with lot coverage limitations (35% max). H. . There will be 671 cubic yards of grading for the project. The disturbed area of the lot shall not exceed 71.4%. 189 cubic yards of dirt are to be imported. I. The riding may not have Iights anywhere within it or around it. Should a mirror be installed in the future in the ring, and if reflection of the sun off the mirror causes glare on adjoining properties, it shall be the responsibility of the property owner or installer to mitigate this problem in a timely manner. J. At any time there are horses on the property, Best Management Practices (BMPs) shall be applied for manure control, including but not be limited to removal of the .manure on a daily basis or provision of a receptacle with a tight closing lid that is constructed of brick, stone, concrete, metal or wood lined with metal or other sound material and that is safeguarded against access by flies. The contents of said receptacles shall be removed once a week. It is prohibited to dispose of manure or any animal waste into the Municipal Separate Storm Sewer System (MS4), into natural drainage course or spread on the property. K. All graded slopes outside of the riding ring shall be landscaped. A landscaping plan shall be submitted to the City. If applicable, the new landscaping shall be subject to the requirements of the City's Water .Efficient Landscape Ordinance (Chapter 13.18of the RHMC). L. A three rail fence is required around the riding ring. M. A drainage plan, if required by the Building Department, shall be prepared and approved by City Staff prior to issuance of a construction permit. Such plan shall be subject to LA County Code requirements. N. The setback lines and roadway easement lines in the vicinity of the construction for this project shall remain marked throughout the construction. The silhouette (story poles) shall be taken down and removed from the property immediately upon completion of the review process of the project. Resolution No. 2018-15 9 O. Any construction facility, such as a construction fence, trailer/office or portable toilet must be authorized by City staff with such authorization being revoked at any point deemed necessary by City staff and such facilities to a maximum extent practicable, shall be located in a manner not visible from the street, except for a .construction fence, and be in a location satisfactory to City staff. P. Minimum of 65% of any construction materials must be recycled or diverted from landfills. The hauler of the materials shall obtain City's Construction and Demolition permits . for waste hauling prior to start of work and provide proper documentation to the City. Q. During,construction, conformance with the air quality management district requirements, stormwater pollution prevention practices, county and local ordinances and engineering practices so that people or property are not' exposed to undue vehicle trips, noise, dust, and objectionable odors shall be required. R. During construction, the property owners shall be required to schedule and regulate construction and related traffic noise throughout the day between the hours of 7 AM and 6 PM, Monday through Saturday, when construction and mechanical equipment noise is permitted, so as not to interfere with the quiet residential environment of the City of Rolling Hills. S. ' The contractor shall not use tools that could produce a spark, including for clearing and grubbing, during red flag warning conditions. Weather conditions can be found at: htipV/www.wrh.noaa.gov/Iox/main.php?suite=safety&page=hazar&definitions#FIR B. it is the sole responsibility of the property owner and/or his/her contractor to monitor the red flag warning conditions. Should a red flag warning be declared and if work is to be conducted on the property, the contractor shall have readily available fire distinguisher. T. The property owners shall be' required to conform with the Regional Water Quality Control Board and County Public Works Department Best Management Practices (BMP's) . requirements related to solid waste, drainage and storm water drainage facilities management. U. Prior to finalizing the project an "as constructed" set of plans and certifications shall be provided to the Planning Department and the Building Department to ascertain that the completed project is in compliance with the approved plans. In addition, arty modifications made to the project during construction, shall be depicted on the "as built" plan. V. . Construction vehicles or equipment, employees vehicles, delivery trucks shall not impede any traffic lanes to the maximum extend practical; and if necessary to Resolution No. 2018-15 20 block traffic in order to aid in the construction, no more than a single lane may be blocked for a short period of time and flagmen utilized on both sides of the impeded area to direct traffic. W. The applicant shall execute an Affidavit of Acceptance of all conditions of this permit pursuant to Zoning Ordinance, or the approval shall not be effective.
