Lighting is permitted along pedestrian pathways for the purpose of providing safe passage. Bulbs used in such lighting shall not exceed 40-watt or maximum of 400 lumens, or their equivalent. Lighting fixtures shall accommodate only one bulb, shall incorporate shields to cast light downward, shall be spaced no closer than 20 feet apart and shall be no higher than 18 inches from grade to the top of the fixture. In no event shall light from such fixtures be cast upward or off the property; 2. Security lighting is permitted, provided that in no event shall a security light be set to shine for longer than 5 minutes following activation and the bulb shall not exceed 40-watt or maximum of 400 lumens, or their equivalent; 3. Entry post lighting is permitted at the foot of a driveway, provided that lighting is cast downward and does not spill onto the roadway. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. Application was duly filed by Mr. and Mrs. Lloyd Olson with respect to real property located at 16 Roadrunner Road, Rolling Hills (Lot 2- CR-H) requesting a Variance to not to underground utility lines on their property, after having made improvements to their sre§idence including an addition. Section 2. The Planning Commission conducted duly noticed public hearing to consider the application at their regular meetings on April 17, 2007. The applicants were notified of the public hearing in writing by first class mail. Evidence was heard and presented from all persons interested in affecting said proposal and from members of the City staff and the Planning Commission having reviewed, analyzed and studied said proposal. The applicants' representative was in attendance at the hearings. Section 3. In August of 2005, the property owners received an administrative approval for a 584 square foot addition to the residence. No grading was required. One of the conditions of the approval was to underground the utility lines. Section 17.27.030 of the Zoning Ordinance states in part that "All utilities servicing the building in question or any residentially zoned parcel shall be installed underground upon: (B) Remodeling of a primary or accessory building which entails enlargement of the structure or alteration of the building footprint, and (D) Relocating in increasing the electrical panel servicing a building or parcel". Section 4. The property is located below street level. The utility pole from which the applicant is drawing power is located above the subject property on neighbors' lot, not in a roadway easement. The lines cross over the driveway of subject property. Section 5. Prior to completion of the construction, the applicant contracted with Edison Co, for plans and specification to underground the utilities and for the location of the new panel and was ready to proceed with the undergrounding. While trenching for • placement of the lines, the applicant encountered solid rock on the slope near the residence. In addition, large trees are located in the general vicinity of the area where the trenching was taking place. Our company has seen situations where trees end up toppling over, or go into shock and die as a result of trenches being created nearby. I have been to the site and I am familiar with the property at 16 Roadrunner Road, specifically the situation with the existing trees, the driveway, and the overhead utility lines. I believe that trenching in the vicinity of the existing large, mature pine trees could weaken and or disturb the roots of the trees to the extent that there is a realistic possibility that the trees could topple over or go into shock and die.
