On Thursday, December 20, 1990 representatives of the Brooks Construction Company visited City Hall to get the final plans for this project stamped with the City approval so that the proper building permits could be obtained from the County of Los Angeles. These plans have been stamped by the City. However, according to the Resolution of the Planning Commission granting approval for this project, Paragraph B of Section 5 requires landscaping plans to be submitted to the City and a bond in the amount of the cost of the estimate of the landscaping plus fifteen percent may be required to be posted and retained until it is determined that the landscaping is properly established and in good condition. According to the representative from the Brooks Construction Company, it appears that there may have been some misunderstanding regarding whether or not a landscaping plan and bond are required for this project. Members of the Rolling Hills City Council adopted the Site Plan Review Ordinance in an effort to maintain the beauty and integrity of the rural atmosphere of Rolling Hills which is enjoyed by all residents. • • We hope this requirement for the landscaping plan and the bond to be posted does not cause any undue hardship; however, we hope you can understand the necessity of taking prohibitive action to ensure that all projects are completed in the manner in which they were presented to the Planning Commission and City Council. We have signed the plans which will authorize your architect and/or construction company to pull building permits for commencement of your project. However, please cause or direct your representatives to prepare a landscape plan and post a bond in the amount determined by Section 5, Paragraph B of the resolution relating to your project. We have enclosed a copy of this Resolution and the correspondence which was sent to you on September 13, 1990. Additionally, we have enclosed a copy of the Planning Commission Minutes which relate to this Resolution. We thank you for your cooperation. Encl. /jc Very trul Ray/Ramada Principal Planner RESOLUTION NO. 90-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING SITE PLAN REVIEW APPROVAL IN ZONING CASE NO. 430 THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Dr. and Mrs. Mathias Fobi with respect to real property located at 10 Saddleback Road, Rolling Hills (Lot 17-1-RH) requesting site plan review approval. for proposed residential additions. Section 2. The Planning Commission conducted a duly noticed public hearing to consider the application on June 19, 1990 and July 17, 1990; and conducted a field site review on June 30, 1990. Section 3. Section 17.34.010 requires a development plan to be submitted for site plan review and approval before any building or structure may be constructed or any expansion, addition, alteration or repair to existing buildings may be made which involve changes to grading or an increase to the size of the building or structure by more than twenty-five (25%) percent in any thirty-six (36) month period. Section 4. The Commission makes the following findings of fact: A. The proposed development is compatible with the General Plan, the Zoning Ordinance and surrounding uses because the proposed structure complies with the General Plan requirement of low profile, low density residential development with sufficient open space between surrounding structures. The project conforms to Zoning Code setback and lot coverage requirements. The lot has a net square foot area of 36,251 square feet. The proposed residential structure, garage, swimming pool, future stable, and service yard will have 6,822 square feet which constitutes 18.8% of the lot, which is within the maximum 20% structural lot coverage requirement. The total lot coverage including paved areas and driveway will be 12,677 square feet which equals 34.9% of the lot, which is within the 35% maximum overall lot coverage requirement. The proposed project is similar and compatible with neighboring development patterns. B. The proposed development preserves and integrates into the site design, to the maximum extent feasible, existing natural topographic features of the lot including surrounding native vegetation, mature trees, drainage courses, and land forms (such as hillsides and knolls) because the proposed development will require no substantial grading and impact to existing vegetation • will be minimal. C. The development plan follows natural contours of the site to minimize grading because all drainage flow from the site will be channeled into existing drainage courses to the rear of this property that has double roadway frontage. • • D. Prior to the submittal of a final grading plan, if necessary, to the County of Los Angeles for plan check, a detailed grading and drainage plan with related geology, soils and hydrology reports that conform to the Development Plan as approved by the Planning Commission must be submitted to the Rolling Hills Planning Department staff for their review. Cut and fill slopes must conform to the City of Rolling Hills standard of 2 to 1 slope ratio. E. The working drawings submitted to the County Department of Building and Safety for plan check review must conform to the Development Plan approved with this Site Plan Review. F. The access to the future stable must be clearly delineated on the Development Plan. Any required approvals from the Rolling Hills Community Association allowing access to the stable through Association easements must be obtained by the applicant prior to submitting any drawings for the proposed residence to the County of Los Angeles for a building permit. G. The applicant shall execute an affidavit of acceptance of all conditions pursuant to 17.32.087 or this approval shall not be effective. PASSED, APPROVED AND ADOPTED this 1990. Based upon the evidence submitted and the identified hardships imposed upon the property due to its location and irregular shape, Staff is of the opinion that the proposed project can be approved. Principal Planner Hamada presented the Staff report (as per written material), stating that because of the uniqueness of the property, the proposed project does exceed the buildable pad coverage and that because of the lot's irregular shape and the double frontage roadway, the buildable area is significantly limited. Rolling Hills, Ca. 90274 Dear Sirs: 41I/June 18, 1990 This letter is written in response to the Public Notice on the proposed residential addition to the Fobi residence, 10 Saddleback Road, Rolling Hills. I have reviewed the Preliminary Site Addition Plan at the City Hall. It is my feeling that as long as the additions meet with the City and Association guidelines and restrictions the proposed construc- tion should be approved. However, we have recently undergone two lengthy construction pro- jects (Agarwal and Jankovich) and feel the inconveniences we and our neighbors on Saddleback experienced during this construction should definitely be avoided. A constant battle occured with the contractors to avoid heavy construction equipment and material suppliers from using our driveway as an area to turn around. Our driveway was damaged in addition to other damage to our property. In several instances the equipment or trucks pulled on to our property and parked prohibiting us from ingress or egress. It would be our strong suggestion that any approval carry the stipulation this cannot occur or the Approval would be voided at any time during con- struction. The subject property is on a hairpin curve on Saddleback Road, and parking of cars necessary to construction will cause a definite traffic hazard. It should be further stipulated that the contractor have flagmen present during all times to avoid possible accidents and parking along the street should not be permitted. The City Manager and the Association are aware of the many instances occuring during the above mentioned past construction in which long term residents were inconvenienced and the con- tractors would not cooperate.
