We are in receipt of your request for an extension to commence construction of the guest
house approved by the Planning Commission on August 21, 2007 in Zoning Case No.
744. Unfortunately, that approval expired on September 21, 2009. The City's Zoning
Ordinance, excerpt enclosed, allows up to two year time extensions, provided the request
is received prior to the expiration date. I received your request on October 28, 2009, over
a month after the project expired.
In a letter to you dated June 17, 2009, I reminded you of the expiration and the process
for requesting extension. Staff has no authority process your request and there is no other
recourse.
Should you in the future wish to construct the guest house, you will be required to apply
for a new Conditional Use Permit, pay all applicable fees and go through the review
process anew.
If you have any questions, please do not hesitate to call me.

17.42.070
C. Minor modifications may be approved by the City
Manager, or his designee, as an administrative item and
shall not require a public hearing or notice. Evidence of
an approved minor modification shall be provided in writ-
ing to the property owner and shall be filed with the
original conditional use permit approval. An action of
the City Manager to deny a request for minor modifications
may be appealed to the Planning Commission as provided for
in Chapter 17.54.
D. Major modifications shall be considered a new
project. As such, a new application for conditional use
permit shall be required, and the application shall be re-
viewed as provided for in this chapter. (Ord. 301 §6
(Exh. A (part)), 2006).
17.42.070 Time limits.
The following time limits shall apply to approved
conditional use permits:
A. Use of Conditional Use Permit.
1. Any conditional use permit which is not
used within the time specified in the grant of approval,
or, if no time is specified, within two years of the ef-
fective date of such approval, shall become null and void
and of no effect. The Planning Commission may extend such
approval for a period not to exceed two years, provided an
application requesting the extension is filed prior to the
original expiration date.
2. Extensions of conditional use permits for
temporary manufactured homes may be granted for subsequent
one-year periods until the permit is revoked pursuant to
Chapter 17.58 of this code. A hearing shall be conducted
for each extension pursuant to Section 17.34.070 of this
code.
3. For the purpose of this section, "used"
means the commencement of grading or construction or any
activity authorized by the grant. (Ord. 295 §7 (Exh. B
(part)), 2004: Ord. 239 §11(part), 1993).

This letter shall serve to notify you that the Planning Commission adopted a resolution on
August 21, 2007, granting a request in Zoning Case No. 744. That action, accompanied by
the record of the proceedings before the Commission was reported to the City Council on
September 10, 2007.
The Planning Commission's decision in this matter shall become effective thirty days after
the adoption of the resolution by the Commission, unless an appeal has been filed or the
City Council takes jurisdiction of the case within that thirty (30) day appeal period.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you will

RESOLUTION OF THE PLANNING COMMISSION

GUEST HOUSE AT AN EXISTING SINGLE FAMILY
RESIDENCE AT 22 SADDLEBACK ROAD, (LOT 15-
RH) IN ZONING CASE NO. 744, (STEINHAUER).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Kurt
Steinhauer with respect to real property located at 22 Saddleback Road, Rolling
Hills, CA requesting a Conditional Use Permit to construct an 800 square foot
guest house.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application on June 19, 2007, July 17, 2007, and at a field
trip visit on July 17, 2007. The applicants were notified of the public hearings in
writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. The
applicants' representative was in attendance at the hearings.
Section 3. The property is zoned RAS-1 and consists of 3.3 acres gross and
2.86 acres (124,800 s.f.) net lot area for development purposes. The property has a
40-foot frontage on Saddleback Road and it backs up to Palos Verdes Drive North.
The property is developed with 3,153 square foot residence with 200 square feet
covered porches, 784 square foot garage, 800 square foot swimming pool, (currently
under construction), pool equipment, service yard and 400 square foot stable.
Section 4. The Planning Commission finds that the project qualifies as a
Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 5. Section 17.16.210(A)(5) of the Rolling Hills Municipal Code
permits approval of a guest house under certain conditions, provided the Planning
Commission approves a Conditional Use Permit. With respect to this request for a
Conditional Use Permit, the Planning Commission finds as follows:
A. The granting of a Conditional Use Permit for the guest house would
be consistent with the purposes and objectives of the Zoning Ordinance and
General Plan because the use is consistent with similar uses in the community,
meets all the applicable development standards of the Zoning Ordinance, no
grading is requested and no deviations from the development standards are
requested.
B. The nature, condition, and development of adjacent uses, buildings,
and structures have been considered, and the construction of a guest house will not

Dear Mr. and Mrs. Steinhauer:
This letter shall serve to notify you that the Planning Commission voted at their regular
meeting on July 17, 2004 to direct staff to prepare a resolution to approve your request in
Zoning Case No. 744 and shall be confirmed in the draft resolution that is being
prepared. The Planning Commission will review and consider the draft resolution,
together with conditions of approval, at an upcoming meeting on August 21, 2007 and
make its final decision on your application at that meeting.
The findings and conditions of approval of the draft resolution will be forwarded to you
before the Planning Commission meeting.
The decision shall become effective thirty days after the adoption of the Planning
Commission's resolution unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (301 day appeal period. (Section 17.54.010(B) of

As stated above, the Planning Commission's action taken by resolution approving the

scheduled to be placed as a report item on the City Council's agenda at the Council's
regular meeting on Monday September 10, 2007.

The Planning Commission scheduled a field trip to your property to view a
silhouette of the proposed project on TULY 17, 2007.
The Commission's schedule is to visit another property at 5:20 PM, before coming.
to this site. Please expect the Commission at about 5:50 PM on that day.
The owner and/or representative must be present to answer questions regarding
the proposal.
The site must be prepared according to the enclosed Silhouette Construction
Guidelines and the following requirements:
A. A full-size silhouette in conformance with the
attached guidelines must be prepared for ALL
STRUCTURES of the project showing the
footprints and roof ridges indicating heights;
B. Indicate (i.e. with a ribbon), which trees,
shrubs and other vegetation will be removed as
a result of this project;
C. Delineate all proposed patio areas, covered
porches, entryways, trellises and all other
structures.
Your neighbors within 1000-foot radius will be notified of this field trip.
The Planning Commission will continue deliberation of this project at their
meeting on the same night, July 17, 2007 beginning at 6:30 PM.
