155, Construct a tennis court, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of ) Dr. Gordon Bernstein ) ) Lot 5-SF ) FINDINGS AND REPORT The application of Dr. Gordon Bernstein, Lot 5 SF, Southfield Tract, for a conditional use permit under Article III, Section 3.04, ZONING CASE NO. 155 Lot Coverage, Ordinance No. 137 came on for hearing on the 18th day of May, 1976 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. :The Commission finds that the applicant, Dr. Gordon Bernstein, is the owner of that certain real property described as Lot 5-SF, Southfield Tract, located in the City of Rolling Hills, California, and that notice of the public hearing -in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission further finds that the applicant requests a conditional use permit for construction of a tennis court which would result in 26.46% development of the buildable area of his property. Dr. Bernstein advised the Commission that he purchased the property two years ago with the expectation of building a tennis court, and could do so without removing any trees or disturbing any bridle trails. A letter from Dr. Bernstein requesting favorable consideration of his re- quest was entered into the file on the case... III. The Commission finds, further, that a letter dated May 18, 1976 was presented to the Planning Commission and read into the record by the Chairman. The letter, expressing opposition to the construction and use • • of a tennis court, was signed by: Ron La Belle, 3 Flying Mane Lane; Dick Small, 5 Flying Mane Lane; Dick Keller, 1 Flying Mane Lane; Chet Jenkins, 10 Southfield; John Link, 3 Ringbit Road West; Frank Jelsma, 14 Southfield Drive and Ann Roberts, 7 Southfield Drive. The concerned residents advised the Planning Commission that the property does not meet requirements of Ordinance No. 137, Section 3.04, Lot Coverage. Further, that the property is so located that a tennis court would greatly detract from the beauty and quiet of the rural atmosphere which is so very important to the residents, and the proposed tennis court would also create a noise problem in addition to an increase in traffic. Verbal opposition was expressed at the meeting by Dr. Richard Small, Dr. Ronald La Belle, Dr. John Link and Mr. Allan Roberts, Photographs of the area submitted by Dr. La Belle were made part of the file. IV. The Commission finds that the plan submitted does not show a 200 square foot area in a legal location reserved for stable development, as required by the ordinance, and that granting a conditional use permit for development of 26.46% of the property would be in violation of the intent of the ordinance, and inappropriate for the lot under consideration. The Commission finds, therefore, that after considering the facts presented to the Commission, and in view of the objections of neighbors, stated in writing and verbally at the meeting, a conditional use permit should not. be granted for construction of a tennis court. V. From the foregoing it is concluded that a conditional use permit should not be granted under Article III, Section 3.04, Lot Coverage Ordinance No. 137 to Dr. Gordon Bernstein for construction of a tennis court in order to preserve substantial property rights possessed by other properties in the same vicinity and zone, and that the granting of such conditional use permit would be materially detrimental to the public welfare and injurious to property in the same vicinity and zone, and it is, therefore, so ordered. /s/ Forrest Riegel Chairman, Planning Commission Q , 5,,,,i ecretary, Plannin9ommission
