FINDINGS AND REPORT
The application.of Mr, John C. Moffitt, Lot 3A-CH, Crest
Hills Tract, for a variance of Front Yard Requirements under
Article. III, Section. 3.06 of Ordinance No. 33 came on. for hearing
on the 19th day of June, 1973 in the Council Chambers of the
Administration Buiiding,.2 Portuguese Bend Road, Rolling Hills,
California, and the applicant, having submitted evidence in sup-
port of the application, the Planning Commission, being advised,
nw makes its Findings and Report as required.by the Ordinances
of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. John C. Moffitt,
is the owner of that certain real,property described as Lot 3A-CH,
Crest Hills Tract, located in. the City of Rolling Hills, Calif-
ornia, and that notice of the public hearing in connection with
said application.was given. as required by Sections 8.06 and 8.07 of
Ordinance No. 33 of the City of Rolling Hills, California.

The Commission. finds, further, that no communication, written
or oral, had been received in favor of or opposition. to the request
.The Commission further finds that the property takes'access from
a cut de sac on. Spur .Lane, and neighboring residences are oriented
to Crest Road, and the front, yard of subject proper ty is adjacent
to neighbors' rear yards, further the area chosen. is in the vicinity
of. the kitchen and service area, and the pool would not be visible
from any residence. on Crest Road West, nor from any residence on
Spur Lane, since the front yard' is 14 feet above road grade.

The. Commission further finds that t:h,e applicant requests the
variance to permitconstruction of a swimming poolin th.e front.
yard of the property; becauseof l.ar.getrees on the Crest Road
side of the property there is a •lack of sun in the rear yard,
limiting the desireable area for a pool. The Commission finds
that a variance to permitconstruction of a swimming poolin the
front yard should begranted in order to prese.r,vesubstantial
property rights possessedby other property in the same vicinity
and zone.

From the foregoing it is concluded that a variance of Front
Yard Requirements under. Article III, Section 3,06 of Ordinance
No; 33 should begranted by the Planning Commission of th.e. City of
Rolling Hills to Mr. John C. Moffitt, Lot. 3A-CH, Crest Hills Tract,
in accordancewith the plotplan marked Exhibit I on file in these
proceedings, and it is, therefore, so or.der.ed,
