The sheds are in compliance with the applicable front building set back requirement in that they are located at least 50 feet back from the front roadway easement line. However, based on your submitted site plan, the shed locations violate another zoning regulation that prohibits accessory structures within the front yard (RHMC 17.16.200.J.2). The front yard is the portion of the lot between the front roadway easement line and front building wall of the main residence. In order to comply with the front yard requirement you would need to move the sheds about 20 feet farther back from the current location. You and I spoke on a number of occasions regarding locating the storage sheds before they were erected. I believe that you made a good faith effort to comply with the code with focus on the front building set back requirement. I have concluded that the noted violation is a result of a miscommunication or misunderstanding regarding the code requirement for front yard. As stated in my letter dated July 10, 2009, it will be necessary to apply to the Planning Commission for a Variance to keep the sheds or remove or relocate them. Should the City at any time in the future receive an application, before this is resolved, requesting a permit or permission to significantly alter the sheds (in their present location), alter the main residence, or receive other development application, the City will require that the sheds be made compliant. As I mentioned to you, no structures may be located in the front yard area of a property, the depth of which is measured "between the front roadway easement line and either the nearest line of the primary building or the nearest line of any enclosed or covered porch attached thereto". You also informed me that the sheds are less than 120 square feet each. Pursuant to the LA. County Building Code, which the City adopts by reference, building permits are not required for such structures. I understand that you are awaiting a final inspection for your new residence snd a final sign off from the Los Angeles County Building and Safety Department. In this case, since no building permits are required for the sheds and their placement constitutes a zoning violation and not a building and safety violation, or violation of the conditions of the Resolution of approval of the development, when the house is ready to be finaled, the City will authorize the Building Official to sign off the project. However, the zoning violation must be addressed in the very near future. You may either remove the sheds or relocate them from the front yard area or request permission from the Planning Commission to keep them in their current place. Should you wish to request permission to keep the sheds, please submit a Variance application together with the appropriate plans and a fee for $1,250 payable to the City of Rolling Hills by September 16, 2009, so that your request may be placed before the Planning Commission at their October meeting. A Variance application and instructions are enclosed. Should you fail to remove or relocate the sheds or submit a Variance application by the above specified date, the City will have no choice but to initiate code enforcement action to correct the zoning violation. The dirt was generated when the existing soil under the house, was not adequate to provide support for the house and foundation. The contractor removed the soil to a depth of approximately 15 feet and replaced it with a slurry mix of cement that will allow the contractor to continue. This was a condition that could not be foreseen until the excavation for the basement and foundation was undertaken. The cost to export the dirt and place the slurry is very undesirable. Dear Mr. and Mrs. Patel: This letter is to notify you that the members of the City Council at the September 27, 2004 regular City Council meeting took the above -mentioned case under jurisdiction. Due to this action by the City Council, the Planning Commission's decision will be stayed until the Council completes its proceedings in accordance with the provisions of the Municipal Code. (Section 17.54.015 of the Zoning Code). Your request will be set for a public hearing before the City Council on October 25, 2004. The Notice of the Public Hearing will be forwarded to you ten days prior to the meeting and the staff report will be available, and will be mailed to you on Friday, October 22, 2004. Following the public hearing on 10/25/04, the Council will schedule a field trip to your property to view the project. You will be required to erect a silhouette for the Council to view. I would like to suggest that you obtain letters of support of this project from your neighbors. Please submit additional eight (8) sets of the site plan by October 15, 2004. You and/or your representative must be present at the hearing to answer any questions the Council may have.
