This letter shall serve to notify you that earlier today I stamped plans for your
project for your representative to be able to apply to the Building and Safety
Department for building permits. However, to date we have not received a
notarized and recorded Affidavit of Acceptance Form and Resolution No. 2006-
06. Instructions for recordation were mailed to you on April 25, 2006, which are
attached together with the Affidavit and Resolution.
Please assure that this last step in the approval process is completed as soon as
possible.
Please also note all of the conditions of approval in the Resolution and assure
that your contractor is aware of them. Specifically, you are reauired to
underground the utility lines from the closest pole to your property (condition
item H), if not already undergrounded; you are required to meet the
requirements for roofing material for the entire house, not just the addition,
(Class A assembly and Class A construction), (condition item G). The Rolling
Hills Community Association must approve the roofing material.
Additionally, prior to finaling the project, you must submit the necessary
plans and specifications for the storage shed, which you constructed near the
sports court, to the County for their review and obtain building permits for
this structure, (condition item I).

SUBJECT: Request for a Variance to permit construction of an addition

single family residence at 11 Chuckwagon Road (Lot 4-CRB), Rolling Hills, CA.
Dear Dr. and Mrs. Delman:
This letter shall serve to notify you that the City Council at their regular meeting
on April 24, 2006, received and filed the Planning Commission's resolution
granting your request in Zoning Case No. 723.
The decision shall become effective thirty days after the adoption of the
resolution by the Planning Commission, unless an appeal has been filed or the
City Council takes jurisdiction of the case within that thirty (30) day appeal
period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there
be an appeal, the Commission's decision will be stayed until the Council
completes its proceedings in accordance with the provisions of the Municipal
Code. Before this case takes effect you are required to cause to be recorded an
Affidavit of Acceptance Form together with the subject resolution in the Office of
the County Recorder.
I have enclosed a copy of RESOLUTION NO. 2006-06, specifying the conditions
of approval set forth by the Planning Commission and the approved
Development Plan to keep for your files. Please complete the enclosed

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROLLING HILLS GRANTING APPROVAL FOR A
VARIANCE TO ENCROACH WITH A PORTION OF AN
ADDITION INTO THE FRONT SETBACK AND DUE TO EXISTING
STRUCTURAL DEVELOPMENT RESTRICTION ON SUBJECT
PROPERTY THIS PROJECT REQUIRES PLANNING COMMISSION
REVIEW, AT AN EXISTING SINGLE FAMILY RESIDENCE IN
ZONING CASE NO. 723, AT 11 CHUCKWAGON ROAD (LOT 4-
CRB), (DELMAN).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Dr. and Mrs. Allan Delman
with respect to real property located at 11 Chuckwagon Road, Rolling Hills (Lot
4-CRB) requesting a Variance to construct a 666 square foot addition, twelve
square feet of which would encroach into the front setback and a Site Plan
Review due existing structural development restriction, which requires Planning
Commission review of all development on the lot. When completed, the
residence will be 3,626 square feet with a 462 square foot garage.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application at their regular meetings on February 21,
2006, March 21, 2006 and at a field trip on March 21, 2006. The applicants were
notified of the public hearings in writing by first class mail. Evidence was heard
and presented from all persons interested in affecting said proposal and from
members of the City staff and the Planning Commission having reviewed,
analyzed and studied said proposal. The applicants' representative was in
attendance at the hearings.
Section 3. In October 2001, the Planning Commission approved a 612
square foot detached recreation room and a sports court on the property. The
recreation room was not constructed. However, a 192 square foot pre -fabricated
storage shed was installed in the approximate location of the approved
recreation room without the benefit of building permits. As part of this approval
a building permit would be required for the storage shed.
Section 4. The October 2001 approval contains a restrictive
development condition, requiring that the Planning Commission review any
future development on the lot, regardless if such construction would ordinarily
require a Site Plan review by the Planning Commission. The proposed addition
of 666 square feet would not trigger a Site Plan Review application. In this case,
however, the development necessitates a Variance, which automatically requires
Planning Commission review, and therefore a Site Plan Review application is not
necessary in order to assure Planning Commission review of the proposed
development.

which is enclosed, on April 18, 2006 granting your request for a Variance in Zoning Case
No. 723. That action, accompanied by the record of the proceedings before the
Commission will be reported to the City Council on April 24, 2006 at their regular
meeting beginning at 7:30 PM. You or your representative must be present to,
answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (301 day appeal period.

Property development in Rolling Hills is governed by ordinances of the CITY OF ROLLING
HILLS ("City") and by private deed restrictions enforced by the ROLLING HILLS COMMUNITY
