of the City of Rolling.Hills, California will hold a hearing
at 7:30 P.M. Monday, June 28, 1976 in the Council Chambers
of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills to consider an appeal by Dr. and Mrs. Gordon
Bernstein of the decision of the Planning Commission of the
City of Rolling Hills at the meeting on May 18, 1976 to

construction of a tennis court which would result in 26.46%

RE: APPEAL OF ZONING CASE #155
LADIES AND GENTLEMEN,
The Planning Commission met on May 18, 1976 and denied my request for a
conditional Use Permit in -regard to Ordinance #137, lot coverage. My plans
call for construction of a tennis court which would mean development of 26.5%
of my property, as opposed to the ordinance limit of 25.,.
I am appealing their decision to the City Council for the following reasons,
as well as for the reasons stated in my original application.
A. In their report, but not at the meeting, the Planning Commission states
that I have not shown a "legal" area for actual placement of the barn
which is required by the ordinance, even though the required 200 sq. ft.
are included in my calculations. This objection is apparently an
afterthought and why did the Commission not request that new plans be
submitted? I assure you I can.
B. I again submit that this project is not detrimental to the public welfare
or to other property in the area. There would be no major grading,
infringement on bridal trails, loss of trees, or obstruction of any
ones view.
The Commission was very impressed by a petitionsigned by seven opposing
residents, even though three of those seven were not present, and even
though most of them live so far away that I must consider their objections
absurd and perhaps malitious. The one immediate neightbor, John Link,
has already moved and his motives are suspect. A tennis court is not
noisey and since when do four players in two cars constitute a traffic
problem?
C. The ruling has needlessly deprived me of a valuable property right.
I think it is significant of the attitude of Commission that they would
act without the obligation or courtesy to inspect the sites.
D. The Commission strongly defends ordinance #137, (which they helped to
write), and the figure of 25% as being absolute and sacred. I would
remind them that the 25% limit is the result of considerable discussion,
controversy, and compromise.
Mr. Reigal, Chairman of the committee, said at the meeting that a
tennis court was acceptable provided it did not have a fence,i.e.,
tennis courst are included under a 25% limit while other cement and
asphalt surfaces are included under a 50e limit. This logic is absurd,
as are the artificial distinctions made by the ordinance.
E. Mr. Reigal has stated both publically and privately that he simply does nc
believe the measurement of 26.5% submitted by Roger Muerer, a reputable
and licensed engineer and resident of our city, who is very familiar
with our zoning laws.
F. Members of the committee reportedly discussed this case previously with
its opponantsand I believe, failed to conduct a fair hearing or render a
fair decision.

For these reasons, I feel that the dtcision of the Planning Commission should
be overturned. If you choose not to do so, I hereby request a "de nova" hearing
so that the following new evidence can be submitted.
1. New plans confirming a "Legal" location for a barn.
2. Detailed calculations showing how the 26.5% was arrived at, plus an
offer to pay the cities cost if their engineer can find.an error.
3.. A new petition signed by a large number of my neighbors (on Ringbit)
who are both in close proximity to my court and approve of it.
