Please see that the Planning Commission receives this before the meeting time. I
find I must leave town unexpectedly, and will not be there, as planned.

Subject: Modification to Site Plan Review and Conditional Use Permit at 3 Poppy
Trail
I addressed the Commission on this subject at a previous meeting when this
matter was presented, and asked you to deny the request. My feelings are even
stronger now, against the proposed construction and access road.
First, the proposed building and access road are not at all compatible with the
community. What if everyone received permission to build at the most visible
location on their property? Is this what our community wants. By approving this,
do you not set precedence for others wanting to do similar construction?
Secondly, this modification most probably is requested because the hillside that
was cut into to build the road was made unstable, and will be become more so, if
you approve the completed access road. This community is already dealing with
a potential multi million dollar lawsuit caused by unstable ground, and resultant
slides, from this same property owner.
Thirdly, the potential noise level coming from such a recreation room, perched
on a hill top, with the owners admission it is for the use of his 12+ siblings and
their children and grandchildren, when visiting, is a big concern for our
immediate neighborhood, and the normally quiet environment we all sought
when we moved here.
Lastly, I would encourage you not to approve this plan, just because this
individual is the lead person in the frivolous law suit against our City, our
Association, and thus our entire community in Rolling Hills, and you might be
concerned that a denial would produce an additional law suit. I am sure you
need to be careful not to display unfavorable attitudes to this individual, but
with my concerns, and those of others that have presented their feelings, you
hopefully can deny this without concern for recrimination from this person,
based on facts presented. Our civic leaders, and our community at large, are very
• •
much disadvantaged by the previous law suit, in the countless hours spent in
having to defend against this law suit, and monies for attorney fees to protect us,
but that should be a separate issue, and your ruling should not be swayed by
concern of another law suit.
Thank you for your consideration in this matter.

RESOLUTION NO. 2009-02
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A SITE PLAN REVIEW FOR GRADING AND A
CONDITIONAL USE PERMIT (CUP) TO CONSTRUCT A RECREATION.
ROOM ON A PROPERTY DEVELOPED WITH A SINGLE FAMILY RESIDENCE
IN ZONING CASE NO. 762, AT 3 POPPY TRAIL ROAD, LOT ( 8-PT), (JONAS).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. Robert Jonas with respect
to real property located at 3 Poppy Trail (Lot 8-PT), Rolling Hills, requesting a
Site Plan Review and Conditional Use Permit for grading and construction of an
800 square foot recreation room with 320 square foot porch and an access road
thereto.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the Application on September 16, 2008, October 21, 2008
(including a field trip on that date), November 18, 2008, and December 9, 2008.
At the December 9, 2008 public hearing, a neighbor testified expressing concerns
over landslide issues and questioned the stability of the area of the property cut
for the access road. The Commission requested information from a soil and/or
geological engineer regarding the stability of the area of the cut and the proposed
walls. The Commission also discussed the compatibility of the recreation room
with the surrounding properties and its location in relation to the main
residence. The Commission then entertained a motion to approve the project,
but the motion failed by a 2-2 vote. The applicant requested continuance of the
deliberations on the project and agreed to provide additional information as
requested by the Planning Commission. The hearing was thereafter continued to
January 20, 2009. At the January 20, 2009 and February 17, 2009 meetings, the
Planning Commission continued consideration of this project due to the fact that
no additional information from the applicant was provided to the Planning
Commission. On March 17, 2009, the Planning Commission held a further public
hearing.
Section 3. The applicant was notified of the above -referenced hearings in
writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal, from all persons protesting the same, and
from members of the City staff at each of the hearings (except January 20 and
February 17, when the matter was merely continued.) The applicant and the
applicant's representatives were in attendance at the hearings.
Section 4. At the March 17, 2009 Planning Commission meeting, the
applicants' representative submitted additional information. Evidence was heard
and presented from all persons interested in affecting said proposal, from all
persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied the information.
The Planning Commission found that the additional information regarding
stability and the recreation room is satisfactory and meet the City's Site Plan
Review and Conditional Use Permit criteria based on the findings enumerated
below.
Section 5. The Planning Commission finds that the project qualifies as
a Class 1 Exemption [State CEQA Guidelines, Section 15301(e)] and is therefore
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 6. Section 17.46.020 requires a development plan to be
submitted for site plan review and approval before any grading, building or
structure may be constructed or any expansion, addition, alteration or repair to
existing buildings may be made which involve changes to grading or an increase
to the size of the building or structure by at least 1,000 square feet and has the
effect of increasing the size of the building by more than twenty-five percent
(25%) in any thirty-six (36) month period. The applicants submitted a Site Plan

application for grading and construction of an 800 square foot recreation room
with 320 square foot porch, access road to the recreation room and grading
quantities of 232 cubic yards of cut and 232 cubic yards of fill.
With respect to the Site Plan Review application to construct a recreation room
and grading, the Planning Commission makes the following findings of fact:
A. The proposed development is compatible with the General Plan,
the Zoning Ordinance and surrounding uses because the proposed structure
complies with the General Plan requirement of low profile, low -density
residential development with sufficient open space between surrounding
structures. The project conforms to Zoning Code lot coverage requirements and
disturbed area. The net lot area of the lot for development purposes is 96,160
square feet. The proposed recreation room with porch and the existing structures
constitute 7.4% of the net lot, which is within the maximum 20% structural lot
coverage requirement. The total lot coverage including all structures, paved
areas and driveway will be 12.3% of the net lot, which is within the 35%
maximum overall net lot coverage requirement. The proposed project will be
screened from the road so as to reduce the visual impact of the development. The
disturbed area of the lot will be 30.9%, which does not exceeds the 40%
maximum permitted, and includes the stable.
B. The development plan preserves the natural and undeveloped state
of the lot by minimizing building coverage because the new structure will not
cause the lot to look overdeveloped. Significant portions of the lot will be left
undeveloped so as to maintain open space on the property. The project will be
'screened from the street and neighbors by trees and shrubs. The nature,
condition, and development of adjacent uses, buildings, and structures and the
topography of the lot have been considered, and the construction of the
recreation room will not adversely affect or be materially detrimental to the
adjacent uses, buildings, or structures because the proposed structure will be
constructed on a portion of the lot which is least intrusive to surrounding
properties, will be screened and landscaped with trees and shrubs, is a sufficient
distance from nearby residences so that the proposed structures will not impact
the view or privacy of surrounding neighbors, and will substantially utilize the
existing building pad for the new construction.
C. The proposed development, as conditioned, is harmonious in scale
and mass with the site, the natural terrain and surrounding residences. As
indicated in Paragraph A, the lot coverage maximum set forth in the Zoning
Code will not be exceeded. The existing residence is relatively small in
comparison to adjacent parcels and is located in the front of the lot, in front
setback. The proposed recreation room will be located some distance from the
residence and the lot will not look impacted by structures.
D. The access road to the recreation room will have pervious surface,
such as grass Crete, and the walls along the east side, (up slope), of the path will
be obscured by the three rail fence to be installed on the lower portion of the path
(west side).
E. The development plan does not create large amounts of grading.
Grading for this project will involve 232 cubic yards of cut and 232 cubic yards of
fill and will be balanced on site. Majority of the grading was generated from the
access road created in order to access the development site above the road
F. The project conforms to the requirements of the California
Environmental Quality Act and is exempt.
Section 7. Section 17.16.210(A)(2) of the Rolling Hills Municipal Code
permits approval of a recreation room under certain conditions, provided the
Planning Commission approves a Conditional Use Permit. With respect to this
request for a Conditional Use Permit, the Planning Commission finds as follows:
A. The granting of a Conditional Use Permit for the recreation room
would be consistent with the purposes and objectives of the Zoning Ordinance and
Z.C. NO. 762 2
• •
General Plan because the use is consistent with similar uses in the community,
meets all the applicable development standards of the Zoning Ordinance and no
deviations from the development standards are requested.
B. The nature, condition, and development of adjacent uses, buildings,
and structures have been considered, and the construction of a recreation room will
not adversely affect or be materially detrimental to these adjacent uses, buildings,
or structures because the recreation room is of sufficient distance from nearby
residences so that the recreation room will not impact the view or privacy of
surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the recreation room complies with the
low profile residential development pattern of the community and will be screened
from neighbors' view.
D. The proposed conditional use complies with all applicable
development standards of the zone district because the 800 square foot size of the
recreation room does not exceed the maximum permitted under the Municipal
Code and the recreation room does not encroach into any setback areas and is not
located in the front.
F. The proposed conditional use is consistent with the portions of the
Los Angeles County Hazardous Waste Management Plan relating to siting criteria
for hazardous waste facilities because the project site is not listed on the current
State of California Hazardous Waste and Substances Sites List.
F. The proposed conditional use observes the spirit and intent of Title 17
of the Zoning Code becau e the proposed project meets all of the development
standards of the Zoning Regulations and has an existing stable, corral and access.
Proposed grading is minimal for this project. and the structure will be screened
from adjacent properties and is not obtrusive to neighbors.
Section 8. Based upon the foregoing findings and the evidence in the
record, the Planning Commission hereby approves a Site Plan Review and
Conditional Use Permit for an 800 square foot recreation room with 320 square
foot porch and 232 cubic yards of cut and 232 cubic yards of fill in accordance
with the development plan dated March 16, 2009 and in Zoning Case No. 762.

conditions thereof are violated, this approval shall he suspended and the
privileges granted hereunder shall lapse; provided that the applicants have been

Dear Mr. Jonas:
This letter shall serve to notify you that the Planning Commission at their regular

This letter shall serve to notify you that the Planning Commission at their regular
meeting on February 17, 2009 continued your case to their March 17, 2009 meeting.
At the December 2008 meeting, the Commission requested that you conduct additional
soils and geology studies for the entire proiect, including the cut road and areas adjacent
thereto and the walls proposed for the road, and submit them together with a grading
plan and preliminary structural plans for the recreation room, drainage and walls to the
appropriate Divisions within the Los Angeles County Public Works Department or
Willdan Associates for their preliminary review and comments. This has not been done
and therefore, the Commission could not consider your case at last nights' meeting.
As you know you have agreed to a 3 months extension of the review by the Planning
Commission, which will expire on March 21, 2009. Therefore, pursuant to the California
Streamlining Act, it will be required that the Planning Commission take an action on
your project at the March 17 meeting. The Commission may either approve or deny the
project at that meeting. The Commission's decision is appealable to the City Council.
Due to the fact that an action by the Commission is necessary at the March meeting, staff
will prepare two resolutions for their consideration; one, a resolution of approval and
second, resolution of denial of this case.
If additional information, as requested by the Planning Commission, is not submitted to
this office by March 5, 2009, so that staff has time to prepare a report and resolutions for
the March 17, 2009 meeting, the Planning Commission will have no choice, but to deny
your case.

Subject: Addendum - Report of Soils Engineering Investigation
Proposed Residential Development
#3 Poppy Trail
Rolling Hills, California
Project Ref. 4726-07
Ref. Report of Soils Engineering Investigation dated December 30, 2007
Dear Mr. Jonas:
In accordance with the request of Mr. Doug McHattie, this addendum is submitted to
comment on a Site Plan dated November 12, 2008, prepared by Bolton Engineering.
PROPOSED CONSTRUCTION
The proposed construction is shown on the Site Plan dated November 12, 2008,
prepared by Bolton Engineering. We understand that the proposed development will
include a recreation room. A building pad will be created for the proposed recreation
room by grading of the slope that rises southerly above the existing residence. The
grading will result in a cut slope of no higher than 10 feet and no steeper than 2:1
(Horizontal to Vertical). A retaining wall of about 5 feet high will be placed at the toe
of the cut slope.
The Site Plan shows an access path from Poppy Trail to the proposed recreation room
pad. The proposed path will be constructed as a grasscrete system. Grading and
retaining walls of up to 3 feet high are planned to create the proposed path.
The design loads of the proposed structures are not available at the time of this report.
Specific construction plans shall be reviewed by this facility, when available, so as to
determine the need for further soils engineering study and revised recommendations
pertinent to the proposed development. Further geotechnical study may include
additional field exploration, laboratory testing and engineering analysis.

CONCLUSIONS
The geologic investigation by Coast Geotechnical has found favorable geologic
conditions at the subject site. Gross failure of the bedrock is unlikely under normal
circumstances. The potential for gross instability that may affect the proposed
development is considered low if the site is improved and maintained in accordance
with our recommendations presented in this addendum and the referenced report.
STATEMENT OF COMPLIANCE WITH BUILDING CODE SECTION 111
It is our opinion, based upon tests conducted as described in this report, copies of test
results being available for review, that the proposed recreation room and retaining
walls, as well as the proposed grading, at the subject site will not be affected by
hazards from landslide, settlement, or slippage, and that the proposed development
will have no adverse effect on the geologic stability of properties outside of the
subject site, provided it is constructed and maintained in accordance with
recommendations presented in this addendum and the referenced report.
The nature and extent of tests conducted for purposes of this declaration are, in our
opinion, in conformance with generally accepted practice in the area. Test findings
and statements of professional opinion do not constitute a guarantee or warranty,
expressed or implied.
RECOMMENDATIONS
Subdrain
A subdrain system is recommended underneath the proposed path. Details are shown
below:
Lateral non -perforated pipes, spaced
about 40 ft. on -centers,
min. 5% gradient to outlet
1
Outlet 6" non -perforated pipes,
draining to Poppy Trail
4" perforated pipes, with perforations
facing down and surrounded by min.
one ft3 of gravels per ft. of drain, along
downslope edge of proposed path
