, Garage & Stable in Front Yard, Resolutions & Approval Conditions 411 I MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION CITY OF ROLLING HILLS June 21, 1983 . A regular meeting of the Planning Commission of the City of Rolling Hills was called to order at the Administration Building, 2 Portuguese Bend Road, Rolling Hills , California by Chairman Roberts at 7 : 30 P .M. Tuesday, June 21, 1983 . ROLL CALL PRESENT: Commissioners Bundy, Field, Frost, Hankins Chairman Roberts ABSENT : None ALSO PRESENT : Ronald L. Smith City Manager Douglas McHattie South Bay Engineering Fred Calhoun Resident Mr. & Mrs . N. Zuehlke Residents INTRODUCTION OF NEW PLANNING COMMISSIONER Chairman Roberts introduced Mr. Roger Frost who was appointed to the Planning Commission to fill the unexpired term of Mr. Kenneth Watts who recently resigned from the Planning Commission. APPROVAL OF MINUTES The minutes of the meetings of May 17 and May 19 , 1983 were ap- proved and accepted as presented on a motion made by. Commissioner ns , seconded by Commissioner Bundy and carried unanimously. PUBLIC HEARING, ZONING CASE NO. 284, MR. & MRS . N. ZUEHLKE Chairman Roberts opened a meeting of a public hearing to consider a request by Mr. and Mrs . Neil Zuehlke for a variance of front yard requirements to permit an encroachment of twenty seven feet into the J front yard for a future garage and an encroachment of twenty feet into the front yard for construction of a stable on their poperty, Lot. 25B Rolling Hills tract, located at 1 Acacia Lane. The Clerk reported } that the hearing was duly noticed as required by law, and that no com- ment, written or verbal, was received in favor of or in opposition to the request. The City Manager displayed a plot plan showing existing structures and proposed improvements , and noted that Mr. Zuehlke was present to answer questions . Mr. Zuehlke explained that the entrance to the pro posed garage would be from the side, and the garage door opening would not face onto the road. Members of the Planning Commission discussed the application, and Commissioner Field said it was his opinion that it should be evaluated with respect to the intent of the zoning ordi- nance. Commissioner Bundy said he had a problem with the garage. so close to the road. Since other Commissioners agreed, he suggested that the request for a variance for a garage be separated from the request for a variance for a stable and corral so they could be con- sidered separately. Mr. Zuehlke said that since he does not intend to have the garage built in the immediate future. he wished to delete that portion of the application, and the Manager advised him that if he wished to re-file at a future date there would not be an additional charge for filing for a front yard variance for a garage. Chairman . Roberts thereafter closed the public hearing. In discussing the request Commissioner Field said the Planning Commission should review the showing of hardship as required for a request for a variance from requirements of the Zoning Ordinance. Chairman Roberts noted that the request is to construct a stable in an area in which horses have been kept on the property, and if moved to the rear of the property the stable would be in close proximity to the City' s tennis courts and barbecue area. Commissioner Bundy said the property has an irregular shape, and the location of the horses on the property and the way all items being considered fit together should be considered. r y; i I June 21 , 1983 Commissioner Bundy moved that a variance of front yard setback requirements for construction of a corral and stable encroaching twenty feet into the required setback be approved on Lot 25-B, Rolling Hills tract located at 1 Acacia Road as shown on Exhibit A, amended by the applicant, Neil Zuehlke to eliminate the proposed garage. The motion was seconded by Commissioner Hankins and carried by the following roll call vote: AYES : Commissioners Bundy, Field, Hankins , Chairman Roberts NOES : None ABSENT : None ABSTAINED:Commissioner Frost Commissioner Frost said he abstained from voting because he did not make the field trip with other members of the Commission and was not familiar with the property, and this was his first meeting. CONTINUED REVIEW OF BUILDING HEIGHT RESTRICTIONS Chairman Roberts opened discussion of review of building height restrictions which was continued from the previous meeting, and he said various wordings for zoning were submitted for review. Commissioner Field said two options were available to the Planning Commission; they could hold hearings on the proposed new wording, or could ask the City Council whether the Planning Commission should proceed and develop the new wording. Commissioner Field said he is concerned about specific wording proposed regarding structure space, stating that it is his opin- ion that it should be "living" space, instead of "structure" space; and whether 15 feet is the exact height footage to be used. Members of the Commission agreed that this could be determined when hearings are held.' Following discussion Chairman Roberts asked that each member of the Planning Commission submit their comments on the proposed and the alternate wording to City staff by Wednesday, July 13, 1983 so a compilation of the comments can be presented : to the Planning Commis- sion for further discussion at the next regular meeting on July 19 . The Chairman ordered the matter held on the agenda to give members of the Commission an opportunity to provide comments to City staff. CONSIDERATION OF ESTABLISHING USAGE AND GUIDELINES FOR SATELLITE ANTENNAS AND SOLAR PANELS IN CITY OF ROLLING HILLS Chairman. Roberts opened discussion of satellite antennas and solar panels in the City of Rolling Hills held on the agenda follow- ing a demonstration of television reception via satellite antenna at the last meeting. The City Manager presented a list of proposed standards developed from recommendations in the Satellite. Earth Station Zoning Book and from an ordinance adopted by the City of Torrance, noting that the book and ordinance were previously supplied to members of the Planning Commission. The Manager outlined six proposed stand- ards relating to basic screening from view of satellite antennas and free standing solar panels, and he said it would be easy to enforce the requirements , since any such structure which could be seen would be in violation. Mr. Smith said there are alternatives for the Com- mission to consider for insertion into the City' s Zoning Ordinance; a Conditional Use Permit could be required, which the Manager said is an involved and costly process, or installation of antennas or free standing solar panels subject to specific standards could be made an accessory use and inserted as such in the Zoning Ordinance. Mr. Fred Calhoun, 2860 Palos Verdes Drive North, asked about the procedure for having a satellite antenna installed at the present time, and he was advised that it is necessary to submit a plan to the Architectural Committee of the Rolling Hills Community Association. Mr. Calhoun was advised of the requirement for screening, and that the structure must be of a color to blend with the earth and vegetation; further, if he wished to have an antenna installed on a canyon floor it would be visible from properties above, which would not be in compliance with requirements that it not be visible from surrounding properties . -2
