Dear Mr. Hansen;
City of Rancho Palos Verdes Code Enforcement Officer Julie Peterson has recently completed
her investigation of wall construction by the owner at 5200 Middlecrest Road in Rancho Palos
Verdes. Your concern was that various walls built some time ago by your neighbor in Rancho
Palos Verdes may have required a permit and may encroach on your property. You also noted
your concern that concrete rubble and cement have been deposited by someone within the flood
hazard easement area on your property, and this may have an impact on your property due to
alteration of drainage patterns.
Ms. Peterson has advised that she has visited 5200 Middlecrest Road and viewed the walls that
were built, and concluded that these structures do not require a building permit. Therefore the
walls and their location is a civil or private property matter between you and your neighbor.
Please note that a boundary line survey certified by a licensed land surveyor would be needed
to document the location of the common property line between 6 Chestnut and 5200
Middlecrest Road and the City has no record of such for your property.
I appreciate your concern about the materials placed within the drainage course and possible
impacts to your property. Lacking any clear evidence as to the party responsible for that
activity, however, the City of Rolling Hills cannot proceed with enforcement action at this time.
One option may be for you to consult with a private civil engineer who may advise as to what
course of action, if any, is advisable to protect your property.

Dear Mr. Hansen;
I am writing as a follow-up to our meetings on November 24 and December 15, the latter also
attended by RPV Code Enforcement Officer Julie Peterson. The subject of these meetings was
your concern that work believed performed by a property owner, at 5000 Middlecrest Rd, RPV,
is partially on your property at 6 Chestnut and that the work may not be in conformance with
applicable standards. The work includes retaining walls and cementing in and placement of
fill and rocks within an area believed to be on your property and also within a designated LA
County Flood Hazard area.
Before we can proceed, it is critical to establish the location of the property line between your
and your RPV neighbors' properties. I looked for and did not locate a property survey in the
City and Rolling Hills Community Association files. To be relevant a survey must be recent and
have survey monuments on the property that correlate to the survey map. If you find that an
older survey was performed, you might request the surveyor to re -certify it for current use in
establishing the boundary. Also the survey should include the area where the work you have
reported has taken place.
Regarding the Flood Hazard area, as soon as we receive the survey we will help to coordinate a
site visit also with an appropriate representative(s) from LA County.

20.94.010 Title for citation. The ordinance codified in this chapter shall be
known as, and may be cited as, the "flood control channel ordinance." (Ord. 9746 §
I (part), 1969: Ord. 1549 § 9, 1928.)
20.94.020 Maintenance — Owner responsibilities. The owner of any natu-
ral watercourse, swale or man-made drainage channel shall maintain the same free
of any vegetation, tin cans, rubbish or other obstructions to the extent necessary so
that the natural flow will not be impeded at any time. When any such watercourse,
swale or drainage channel flows in an easement granted for such purpose and the
grantee has improved such watercourse, swale or drainage channel, then, as used in
this section, the word"owner" means the person, firm, corporation or public body
owning such easement. In other cases, the word "owner" means the owner of the
land traversed by such watercourse. swale, or drainage channel and any person in
lawful possession thereof. (Ord. 9556 § 1, 1968: Ord. 9533 § 1, 1968: Ord. 1549 § 5,
1928.)
20.94.030 Using property prohibited without permit Terms and condi-
tions. It is unlawful for any person, firm, corporation, municipality or district to
interfere with, cause damage to, destroy or use in any manner whatsoever any flood
control, storm drain or water conservation structure, facility, appurtenance, or any
other property owned constructed, maintained or controlled by or on behalf ofthe
Los Angeles County Flood Control District, a body politic and corporate created by
law for the purpose ofcontrolling and conserving the flood, storm and other waste
waters of said District, without having received a written permit therefor from the
board of supervisors of the District, which permit shall be revocable whenever, in
the opinion of the board of supervisors, the public interest and welfare require the
revocation thereof. Application for the use of any property of the District shall be
made to the chief engineer of the District, setting forth the particular use desired
and the purpose and duration thereof, and the chief engineer shall investigate such
application and make his recommendations thereon to the board of supervisors of
the District, and the board of supervisors may impose such terms and conditions as
may be necessary to insure the proper maintenance of the property for the purpose
for which it was constructed, acquired or maintained. This section does not apply to

any entry or use in the course of duty by any peace or police officer, or by a duly
authorized employee of the Los Angeles County Flood Control District. (Ord. 5468

20.94.040 Placing obstructions, refuse and contaminating substances in
channels prohibited. A. It is unlawful for any person, corporation, municipality,
agency, or other entity to place or cause to be placed wiitin a floodway adopted
pursuant to Los Angeles County Code, Section 11.60.010 r in the channel, bed, or
on the bank of any river, stream, wash or arroyo in the county of Los Angele;/gr
within the floodplain of said river, stream. wash or arroyo if a floodway ha not
been adopted/6i within or upon any floodway or any flood -control channel.

Angeles County Flood Control District has an easement or fee title thereto for flood
and/or conservation purposes duly recorded in the office of the county recorder,
any wires, fence, building or other structure, or any refuse, rubbish, tin cans or other
matter that may impede, retard, or change the normal direction of the flow of the
flood, storm, and other waters in such river. stream, wash. arroyo. floodway,
floodplain, flood -control channel, reservoir, debris basin or spreading ground, or
that may catch or collect debris carried by such waters, or that may be carried
downstream by such waters to the damage and detriment of either private or public
property within or adjacent to said river, stream. wash, arroyo, floodway.
floodplain, flood -control channel, reservoir, debris basin, or spreading ground, nor
shall any material, either solid or liquid, be placed in said river, stream, wash,
arroyo, floodway, floodplain, flood -control channel, reservoir, debris basin, or
spreading ground that will deteriorate the quality of water flowing or stored therein
or that which is stored within the water -bearing zones underground.
B. As used herein, "floodplain" means the lowlands adjoining natural
watercourses which will be covered by water during flood events. (Ord. 86-0032 § 1,
1986: Ord. 5468 § 3, 1958: Ord. 1549 § 2, 1928.)
20.94.050 Bridges and dip crossings permitted when. This chapter does not
prohibit the construction or maintenance of dip crossings of natural drainage
courses on private property if such dip crossings:
A. Do not exceed a height of two feet above the adjacent upstream natural
stream bed; and
B. Do not change the stream flow characteristics to the detriment of
upstream, downstream or adjacent properties:,and
C. Are constructed from materials obtained in the adjacent stream bed,
except for culvert pipe and asphaltic concrete or portland cement concrete paving.

20.94.060 Chapter provisions not exclusive. This chapter does not prohibit
anything either expressly prohibited or expressly permitted by state law. (Ord. 5468
§ 5, 1950: Ord. 1549 § 4. 1928.)
20.94.070 Violation — Penalty. Any person. firm. corporation, munici-
pality or district, or any officer or agent of any firm. corporation. municipality or
district violating any of the provisions of this chapter shall be guilty of a misde-
meanor. and upon conviction thereof shall be punished by a fine not exceeding
S500.00 or by imprisonment in the County Jail fora term not exceeding 100 days, or
by both such fine and imprisonment. (Ord. 1549 § 3. 1928.)

Sec. 308. Prohibited Uses of Building Sites
(a) Flood Hazard.
I. Buildings are not permitted in an area determined by the County Engineer
to be subject to flood hazard by reason of inundation, overflow, or erosion.
The placement of the building and other structures (including walls and
fences) on the building site shall be such that water or mud flow will not be a hazard
to the building or adjacent property. Subject to the conditions of subdivision 2 of
this subsection (a), this prohibition shall not apply when provision is made to
eliminate such hazard to the satisfaction of the Department of Public Works by
providing adequate drainage facilities, by protective walls, by suitable fill, by
raising the floor level of the building, by a combination of these methods, or by
other means. The Department of Public Works, in the application of this subsec-
tion, shall enforce, as a minimum, the current Federal Flood Plain Management
Regulations defined in Title 44, Code of Federal Regulations, Section 60.3.
2. Portions of the unincorporated territory of the County of Los Angeles
subject to severe flood hazard by reason of inundation, overflow, erosion or
deposition of debris are established as floodways by Ordinance No. 121142 of the
County of Los Angeles. Whenever, in such ordinance establishing floodways,
reference is made to any floodway, it shall be construed to mean a floodway referred
to in this Section. A person shall not perform work for which a building or grading
permit is required within the boundaries of an established floodway if such work
increases the flood hazard to adjacent properties by either increasing the capital
floodwater surface elevation. deflecting flows, or increasing bank erosion. Such
work may be performed within an established floodway, and a building or grading
permit therefor may be issued, where provisions are made to the satisfaction of the
County Engineer to avoid such an increase in the flood hazard.
3. The Los Angeles County Flood Control District shall act as a consultant to
the County Engineer in permit matters relating to flood control and flood hazard
identification, avoidance and mitigation in all areas delineated on maps furnished
to the Engineer:
The,District shall provide the County Engineer with a series of maps delineat-
ing areas subject to flood, mud and debris hazards. The maps shall be prepared by
the District, shall be based on the best currently available information, and shall be
updated at least annually.
The County Engineer shall consult with the District with respect to work
requiring a building or grading permit in the hazard areas delineated on the maps.
The District shall prepare written reports of its examination of each building
or grading permit application for work in the hazard areas delineated on the maps.
The reports shall be considered by the County Engineer in acting upon the
application. The actions upon the applications shall be supported in writing.
The District shall also act as a consultant whenever the County Engineer
proposes to establish by ordinance floodways and water surface elevations regulat-
ing the locations of such proposed work.

It was a pleasure to meet with you last Monday to try and resolve
the erosion/drainage problem at the border of our two cities.
Mrs. Brandlin of 5201 Middlecrest, Rancho Palos Verdes was kind
enough to provide us with a copy of Tract Map #24669 of the City of
Rolling Hills. The tract map indicated a natural drainage course
and a 25' wide drainage easement overlayed by a 40' wide Flood
Hazard Area designation both of which are located in the City of
Rolling Hills.
Mr. Hannson of r6 Chestnut, Rolling Hills, indicated that over the
course of several years, he has graded out and into the natural
drainage course to create additional flat area for landscaping. In
addition, Mr Hannson has built a railroad tie retaining wall to
support the fill placed in the drainage course.
This trading and construction is a violation of the Los Angeles
county Building Code, Section 308 which states in part, "A person
shall not perform work for which a building or grading permit is
required within the boundaries of an established floodway if such
work increases the flood hazard to adjacent properties by either
increasing the capital flood water surface elevation, deflecting
flows or increasing bank erosion".
Mr. Hannson's grading and retaining wall has increased the rate of
flow, deflected the flow and increased bank erosion on lot 6 and
7. Q-2(73 iddlecrest and 5201 Middlecrest, Rancho Palos Verdes).

As the Flood Hazard Zone is entirely within the City of Rolling
Hills and as Mr. Hannson's lot on which the grading/retaining wall
work was done is also entirely within the City of Rolling Rills,
the City of Rancho Palos Verdes hereby requests that the City'of
Rolling Hills take whatever action necessary to restore the
drainage course to its original condition and that any erosion at
lots 6 and 7 that resulted from the grading/retaining wall work be
corrected.
Although my principal responsibility lies in ensuring that the•
citizens of Rancho Palos Verdes and their property are protected,
feel free to call on me if I can be of any assistance in this •
matter.
As the rainy season will soon be upon us, I feel that time is of
the essence in this matter and look forward to hearing from you

The Division of Building and Safety is referring a grading and
drainage violation to your office for further disposition.
We received several complaints from Ms. Rachel Caldera who lives
at 5203 Middlecrest Road, City of Rancho Palos Verdes, Ca. Her
complaint is that the owner of the property at *6 Chestnut Lane,
City of Rolling Hills, Ca. has dumped rocks, boulders, and debris into
the storm water drainage course that abuts the rear of both
properties thereby endangering her property from flooding.
Several investigations were made of the allegations and it was
found that Mr. G. Hansen, owner of *6 Chestnut Lane has illegally
graded a corral area and placed rocks and debris into the natural
drainage course in violation of Building Code Sections 7003 and 7004.
He has thus created a potential flood hazard by damming the drain
and diverting the flow of water possibly into the neighboring
property.

Mr. Hansen was notified on three separate occasions to stop all
illegal grading work and to clean up the drainage course. The first
notice was sent on June 8, 1987, the second on August 18, 1987, and
the third • on October 5, 1987. He was given 30 and 10 days
respectively to comply with the orders but he has failed to do so,
therefore we are now referring the case to your office.
Inspection of the violations were made by Sr. Building Inspector Bill
Magill, Drainage Engineer Jim Sykes, and the undersigned.

I live at 5203 Middlecrest Road, Rancho Palos Verdes,
CA., and the back of my property abutts on the back of the real
property owned by a Mr. and Mrs. Gary Hanson located at
6•Chestnut Lane Road, Rolling Hills, CA. There is a natural
drainage course on the Hanson property.
The purpose of this letter is to have a written record
of what I told your Department about the Hansons raising and
extending their stable area by grading (without a permit),
•1 pushing dirt, grass and rock onto my property resulting in the
obstruction of the natural drainage course.
On or about March 23, 1987, Mrs. Peggy Minor of the
Rolling Hills' Community Association spoke to Mr. Kondo on my
behalf about the grading of the Hanson stable area.
On or about May 28, 1987, I spoke to Mr. Kondo and told
him that the natural drainage had been changed and obstructed by
the Hansons. On about June 3, Mr. Kondo and James J. Sykes
personally inspected and observed the drainage obstruction and

and how the location of the ditch was moved toward my property.
Mr. Sykes issued a "Drainage Violation Notification" to Mr.
Hanson, dated June 8, 1987. The notification directed Hanson to
remove the obstructions in the natural drainage course, restore
it to its original capacity and alignment and remove the recently
constructed drainage facilities and/or submit plans to the
Department of Public Works for upgrading the drainage facilities.
As usual, Mr. Hanson did nothing. Mr. Sykes issued another
"Drainage Violation Notification" dated August 18, 1987, to Mr.
Hanson, giving him 10 days to remove the obstruction in the
natural drainage course and to restore the drainage course to its
original capacity and alignment. As usual, Mr. Hanson did
nothing.
On or about September 9, Mr. McGill personally viewed
the obstruction and change of the natural drainage course and
took photographs of the area.
I hired the South Bay Engineering Company to survey the
property line so that I could erect a fence and conclusively
established that the Hansons had pushed dirt, rock and debris on
my property. On September 23, 1987„ the survey was completed
resulting in the installation of several survey markers which
established that the dirt and debis was placed on my property by
the Hansons.
On or about September 27, the Hansons constructed what
can be laughingly referred to as a wall. This "wall" is
constructed partially on my property. This wall, dirt, rock and
debris further changes the location and obstructs the natural
drainage ditch and prevents me from installing a fence on my
property.
On September 28, James Sykes and Jim Concourse, at my
request, personaly viewed the dam, slope, obstructed drainage
course, changed location of the ditch and the surrounding area.
(For your information, Mr. Terrance Belanger, City
Manager for Rolling Hills, personally viewed the area on
September 30 at which time*he said the Hansons had no right to
change or obstruct the natural drainage course and that he was
going to consult with the City Attorney regarding this.)

I further complained to the Department of Public Works
and as .a result of this call Mr. Kondo and Mr. mcGill again
personally viewed the area and Mr. Kondo said he would contract
the District Attorney, tell him of the situation and turn the
matter over to him.
The Hansons have unlawfully and illegally raised the
level of their lot, moved the drainage ditch toward my property,
raised the level of the ditch so the water will flow over my
property and damned the ditch thereby obstructing and changing
the course and depth of the natural drainage.
I have implored your department to do whatever must be
done to correct this situation and stop the Hansons from
continuing (which they are) their wrongful acts. If they are
not stopped the water will flow over my property and through my
house.
WHEN THE HEAVY RAINS ARRIVE, SERIOUS DAMAGE WILL BE
DONE TO MY PROPERTY BECAUSE OF WHAT THE HANSONS DID AND ARE DOING
AND BECAUSE YOUR DEPARTMENT FAILED TO DO ITS DUTY TO COMPEL THEM
TO CORRECT THE SITUATION AND LOS ANGELES COUNTY AND ANY OTHER
GOVERNMENTAL AGENCY THAT IS RESPONSIBLE FOR PERMITTING THIS
SITUATION TO EXIST WILL BE LIABLE FOR ALL DAMAGE TO MY PROPERTY
AND ME.
