DATE:November 23, 2020 BACKGROUND: Ordinance No. 365 was introduced for first reading at the November 9, 2020 City Council Meeting. After consideration by the City Council, the proposed ordinance was approved for second reading adoption. DISCUSSION: The Federal Fair Housing Amendments Act of 1988 and California Fair Employment and Housing Act require local jurisdictions to establish a process by which persons with disabilities can request reasonable accommodations to the jurisdiction’s codes, rules, policies, practices or services, necessary to afford persons with disabilities an equal opportunity to use or enjoy a dwelling. Pursuant to Government Code Section 65583, each city must analyze in its housing element the special needs of disabled persons. Each housing element also must analyze governmental constraints to the development and maintenance of housing for disabled persons, and include a program to provide reasonable accommodations from zoning and land use regulations to allow for the development of housing for disabled persons. In order to comply with State and Federal law, and as specified under Program 25 of the current Housing Element, staff prepared a draft Ordinance to amend Title 17 (Zoning) of the Rolling Hills Municipal Code procedures for granting reasonable accommodations. The Federal Fair Housing Amendments Act of 1988 and California Fair Employment and Housing Act require local jurisdictions to establish a process by which persons with disabilities can request reasonable accommodations to the jurisdiction’s codes, rules, policies, practices or services, necessary to afford persons with disabilities an equal opportunity to use or enjoy a dwelling; B. Pursuant to Government Code Section 65583, each city must analyze in its housing element the special needs of disabled persons. Each housing element also must analyze governmental constraints to the development and maintenance of housing for disabled persons, and include a program to provide reasonable accommodations from zoning and land use regulations to allow for the development of housing for disabled persons. Although the City currently accommodates accessibly needs on a case-by-case basis, the City does not have a formal process for requesting reasonable accommodations from the City’s zoning and land use regulations; C. The City desires to amend its municipal code to establish a process by which persons with disabilities can request reasonable accommodations, necessary to afford such persons an equal opportunity to use or enjoy a dwelling; D. Staff and the City Attorney prepared the proposed ordinance, including the proposed language and terminology, and any additional information and documents deemed necessary for the Planning Commission to take action; E. On October 9, 2020, the City gave public notice of the October 20, 2020 public hearing to be held by the Planning Commission on the proposed ordinance by publishing notice in the Torrance Daily Breeze a newspaper of general circulation; G. On October 29, 2020, the City gave public notice of the November 9, 2020 public hearing to be held by the City Council on the proposed ordinance to be considered by publishing notice in the Torrance Daily Breeze a newspaper of general circulation; 17 65277.00001\33367195.1 Page 2 of 6 F. On October 20, 2020, the Planning Commission held a duly-noticed public hearing and considered the staff report, recommendations by staff, and public testimony concerning the proposed ordinance. It adopted a resolution recommending that the City Council adopt the proposed ordinance; and G. On November 9, 2020, the City Council held a duly-noticed public hearing and considered the staff report, recommendations by staff, and public testimony concerning the proposed ordinance. THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Title 17 (Zoning) of the Rolling Hills Municipal Code is amended to add Chapter 17.60 (Housing Accessibility for the Disabled – Reasonable Accommodation Permit) to read as follows: Chapter 17.60 Housing Accessibility for the Disabled – Reasonable Accommodation Permit 17.60.010 – Purpose. The purpose of this chapter is to establish a procedure for requesting reasonable accommodation for persons with disabilities seeking equal access to housing under the Federal Fair Housing Act and the California Fair Employment and Housing Act (the “Acts”) in the application of zoning and building laws and other land use regulations, policies, and procedures. 17.60.020 Applicability. A. Definition of Disability. Under the Acts, an individual with a disability is someone who has a physical or mental impairment that limits one or more major life activities; anyone who is regarded as having such impairment; or anyone with a record of such impairment. Individuals in recovery from drug or alcohol abuse are protected by federal and state fair housing laws although individuals currently using illegal substances are not protected under the law unless they have a separate disability. This chapter is intended to apply to those persons who are defined as disabled under the Acts. B. Scope of Accommodation. A request for a reasonable accommodation may include a modification or exception to the rules, standards, and practices for the siting, development, and use of housing or housing-related facilities that would eliminate regulatory barriers and provide an individual with a disability equal opportunity to housing of their choice. Requests for reasonable accommodation shall be made in the manner prescribed by Section 17.60.040 (Application Contents and Submittal), and shall not require a fundamental alteration to the City’s zoning or building laws, policies, or procedures, as defined under the Acts. A modification approved under this chapter is considered a personal accommodation for the individual applicant and does not run with the land. C. Eligibility to Request Accommodation. A request for reasonable accommodation may be made by any individual with a disability, his or her representative, or a 18 65277.00001\33367195.1 Page 3 of 6 developer or provider of housing for individuals with disabilities, when the application of a land use, zoning, or building regulation, policy, practice, or procedure acts as a barrier to fair housing opportunities. 17.60.030 Notice to the Public of Availability of Accommodation Process Notice of the availability of reasonable accommodation shall be displayed at the public information counter in the Planning and Community Services Department advising the public of the availability of the procedure for eligible individuals. Forms for requesting reasonable accommodation shall also be made available. 17.60.040 Application Contents and Submittal Requests for reasonable accommodation shall be submitted on an application form provided by the Planning and Community Services Department and shall contain the following information: A. The applicant’s name, address, and telephone number. B. Address of the property for which the request is being made and the name, address, and telephone number of the property owner. C. The current existing use of the property. D. The basis for the claim that the individual is considered disabled under the Acts. E. The zoning code provision, regulation, or policy from which reasonable accommodation is being requested. F. Reason the requested accommodation may be necessary to make the specific property accessible to the individual. 17.60.050 Authority A. City Manager. Requests for reasonable accommodation shall be reviewed by the City Manager, or his/her designee (“City Manager”), if no approval is sought other than the request for reasonable accommodation. B. Other Review Authority. Requests for reasonable accommodation submitted for concurrent review with another discretionary land use application shall be reviewed by the authority reviewing the discretionary land use application. 17.60.060 Review Procedure. A. City Manager Review. The City Manager, or his/her designee (“City Manager”), shall make a written determination within 45 days of submittal of a complete application and either grant, grant with modifications, or deny a request for reasonable accommodation in accordance with Section G (Findings and Decision). The City Manager shall mail a notice of a request for reasonable accommodation to contiguous owners of property, as shown on the latest equalized Los Angeles County assessment roll, but may include other property owners as determined by the City Manager. Said notice shall be mailed at least ten days prior to making a determination. B. Other Reviewing Authority. Written determinations on requests for reasonable accommodation submitted for concurrent review with another discretionary land use application shall be made by the authority responsible for reviewing the discretionary land use application. The written determination to grant or deny the 19 65277.00001\33367195.1 Page 4 of 6 request for reasonable accommodation shall be made in accordance with Section 17.60.070 (Findings and Decision). C. Additional Information. If necessary to reach a determination on the request for reasonable accommodation, the reviewing authority may request further information from the applicant consistent with the Acts, specifying in detail the information that is required. In the event that a request for additional information is made, the 45 day period to issue a decision is stayed until the applicant responds to the request. D. The reviewing authority may approve an alternative reasonable accommodation that provides the applicant an opportunity to use and enjoy a dwelling equivalent to that provided by the specific accommodation requested, where such an alternative accommodation would: 1. Reduce impacts to neighboring properties or the surrounding area; or 2. Not require a deviation from the provisions of Title 15 or Title 17 of the Municipal Code or would require less of a deviation than the requested accommodation. 17.60.070 Findings and Decision. A. Findings. The reasonable accommodation shall be approved, with or without conditions, if the reviewing authority finds, based upon all of the evidence presented, that all of the following findings can be made: 1. The housing, which is the subject of the request, will be occupied by an individual considered disabled under the Acts. 2. The requested accommodation is necessary to provide a disabled individual with an equal opportunity to use and enjoy a dwelling. 3. The requested accommodation would not impose an undue financial or administrative burden on the City, as defined under the Acts. 4. The requested accommodation would not require a fundamental alteration to the City’s zoning or building laws, policies, or procedures, as defined under the Acts. In considering whether the accommodation would require such a fundamental alteration, the reviewing authority may consider, among other factors: i. Whether the requested accommodation would fundamentally alter the character of the neighborhood; and ii. Whether the requested accommodation would substantially undermine any express purpose of either the City’s General Plan or any applicable specific plan. 5. There are no other reasonable accommodation(s) that would allow the applicant to use and enjoy the dwelling which would: i. Be less impactful to neighboring properties or the surrounding area; or ii. Not require a deviation from the provisions of Title 15 or Title 17 of the Municipal Code or require less of deviation than the requested accommodation. 20 65277.00001\33367195.1 Page 5 of 6 17.60.080 Conditions of Approval In granting a request for reasonable accommodation, the reviewing authority may impose any conditions of approval deemed reasonable and necessary to ensure that the reasonable accommodation would comply with the findings required by Section 17.60.070 above, including but not limited to the following: A. Inspection of the property periodically, as specified, to verify compliance with this section and any conditions of approval. B. Recordation of a deed restriction requiring removal of the improvements when the need for which the accommodation was granted no longer exists, except where the City Manager finds that removal would constitute an unreasonable financial burden or is physically integrated with the structure and cannot feasibly be removed. C. Time limits or expiration of the approval if the need for which the accommodation was granted no longer exists. D. Measures to reduce the impact on surrounding uses. E. Measures in consideration of the physical attributes of the property and structures. F. Other conditions necessary to protect the public health, safety and welfare. 17.60.090 Written Decision The written decision on the request for reasonable accommodation shall explain in detail the basis of the decision, including the reviewing authority’s findings required by Section 17.60.070 (Findings and Decision) above. All written decisions shall give notice of the applicant’s right to appeal and to request reasonable accommodation in the appeals process as set forth below. 17.60.090 Appeals A determination by the reviewing authority to grant or deny a request for reasonable accommodation may be appealed in compliance with Chapter 17.54 (Appeals of Decision of the Planning Commission) and Chapter 17.55 (Appeals of Decision of the City Manager) of the Rolling Hills Municipal Code. Appeals shall be submitted on an application form provided by the Planning and Community Services Department. If an individual needs assistance in filing an appeal on an adverse decision, the City will provide assistance to ensure the appeals process is accessible. Section 2. The project is categorically exempt from California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines which exempts minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density and Section 15061.b.3 of the CEQA Guidelines because adoption of the zoning ordinance amendment is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and this project does not have the potential for causing a significant effect on the environment. Section 3. This ordinance shall take effect thirty days after its passage and adoption pursuant to California Government Code section 36937. Section 4. He has adopted a habit of picking up the cigarette butts. Included with this staff report is a photograph of the remains he has collected. DISCUSSION: The City Council directed staff to research and draft an ordinance that would eliminate smoking in the community. The City Attorney drafted Ordinance 365 proposed to ban smoking in public places and on private easements, roads, and trails by adding Chapter 9.40 Smoking Prohibited to Title 9 Public Pease, Morals and Welfare of the city's municipal code. FISCAL IMPACT: The fee for the City Attorney to prepare Ordinance 365 is funded using the FY 2020-2021 approved budget line item for legal expenses. RECOMMENDATION: Approve Ordinance 365 and direct staff to prepare ordinance for adoption. Some human-caused fires result from campfires left unattended, downed power lines, and negligently discarded cigarettes; and B.The City of Rolling Hills has been designated a “Very High Fire Severity Zone”; and C.The City has already taken actions to reduce and address the risk of fires within the City, such as adopting a Fire Fuel Abatement Ordinance (Rolling Hills Municipal Code Chapter 8.30) to reduce the amount of dead vegetation within the City and adopting a Community Wildfire Protection Plan; and D.Still, in 2020 alone, six of the top twenty largest California wildlife fires have occurred, according to CalFire. Strong wind conditions, dry weather, and dry and dense vegetation contributed to the fire and loss of approximately 115,796 acres in the Bobcat Fire in Los Angeles County, 33,424 acres in the Apple Fire in Riverside County, and 22,744 acres in the El Dorado Fire in San Bernardino County; and E.These fires have resulted in tragic loss of life along with enormous property losses; and F.The City Council finds that smoke-free public property and smoke-free private easements, roads, and trails will reduce fire hazards within the City; it will reduce the risk that lit, heated, or ignited cigars, cigarettes, cigarillos, pipes, hookahs, electronic smoking devices, or any plant products will be used, discarded, or left unattended by persons on such property; and G.The City Council wishes to amend the Municipal Code to address the fire hazards by identifying areas within the City where smoking is prohibited. 25 SECTION 2. Title 9 (Public Peace, Morals and Welfare) is hereby amended by adding Chapter 9.40 (Smoking Prohibited) to Subdivision IV (Offenses Against Public Peace) to read as follows: CHAPTER 9.40 SMOKING PROHIBITED. 9.40.010 Definitions For purposes of this chapter, the following terms shall have the following meanings: "Electronic smoking device" means an electronic device that can be used to deliver an inhaled dose of nicotine, or other substances, including any component, part, or accessory of such device, whether or not sold separately. This definition includes any such device, whether manufactured, distributed, marketed, or sold as an electronic cigarette, an electronic cigar, an electronic cigarillo, an electronic pipe, an electronic hookah, or any other product name or descriptor, including any component, part, or accessory of such device, whether or not sold separately. "Electronic smoking device" does not include any product specifically approved by the United States Food and Drug Administration for use in the mitigation, treatment, or prevention of disease, where such product is marketed and sold solely for such an approved purpose. "Public property" means any indoor or outdoor public property, including, but not limited to, any publicly owned buildings, parking lots, riding rings, tennis courts, parks, roads, streets, and sidewalks. “Smoking” means the release of gases, particles, or vapors into the air as the result of combustion, electrical ignition, or vaporization and/or inhaling, exhaling, burning, or carrying any lighted, heated, or ignited cigar, cigarette, cigarillo, pipe, hookah, electronic smoking device, or any plant product intended for human inhalation. 9.40.020 Smoking in and on public property prohibited. In addition to all places where smoking is prohibited under state or federal law, in which case those laws apply, no person shall smoke in or on any public property. Such prohibition extends to smoking in vehicles on public property. 9.40.030 Smoking in and on private easements, roads, and trails prohibited. In addition to all places where smoking is prohibited under state or federal law, in which case those laws apply, no person shall smoke in or on any private easement, road, or trail. The City Attorney noted that the City does not have jurisdiction over the gates or the gate attendants and that the sections of the code speaking to them should be eliminated. Mr. Hawkins requested additional review of the code relating to trespassing. During the discussion, the City Council decided to table the item in order for legal counsel to conduct further research on trespass regulations. DISCUSSION: The proposed ordinance proposes to repeal Sections 10.12.050 and 10.12.060 of Chapter 10.12 (Traffic Enforcement Authority) of Title 10 (Vehicles and Traffic) and amends Chapter 9.40 (Trespass) and Chapter 9.44 (Entering Private Property Under False Pretenses of Title 9 (Public Peace, Morals and Welfare) of the Rolling Hills Municipal Code. It was determined by legal counsel that majority of Mr. Hawkin's proposed changes to the Municipal Code are already addressed by Penal Code Section 602. The attached ordinance, for the City Council's consideration, is the proposed changes by legal counsel that address the concerns that the City's Trespass provisions are insufficient. 29 FISCAL IMPACT: The fees for legal counsel to review and address the resident's request for municipal code changes and the drafting of ordinances are funded using FY 2020-2021 approved budget for legal services. DISCUSSION: Upon further review of the proposed changes to the code, the City's legal counsel determined that a repeal of the sections stated above is necessary. The City does not have the authority to oversee the Rolling Hills Community Association's operations and its staff and the Los Angeles County Sheriff's Department. FISCAL IMPACT: None. In an addendum to the COVEREDSIX RHCA Security Assessment July 2019 (“Assessment”), on the ninth page is an interlineated comment by RHCA Association Manager, Kristen Raig, that states: “(t)he RHCA Board is aware that the current gate staff are not trained security officers and do not expect their training or the RHCA gates to meet the standards of 47 City Council City of Rolling Hills February 10, 2020 Page 2 state licensed security operations.” (See enclosed Ninth page of the Assessment, i.e., “*** RHCA note.”) Also, RHCA staff has counseled that the Association employs gate attendants, not guards to work the gates and reminds that we should not give people the impression or advise residents that the Association employs “guards” to work the gates. The Association’s Gate Operations Manual 2020 describes these attendants as “gate representatives,” and, elsewhere, the Association uses the terms, “gate attendants” and “gate representatives,” interchangeably. (Emphasis added.) To correct how these gate represented are identified in these Ordinances on the off chance a violation is ever prosecuted, to correctly identify their job title, kindly place this request on your Council’s agenda and consider editing the Ordinance to read “gate representative, instead of “guard or security officer,” as it now reads. And, it would help to eliminate the phrase “employed by” so any gate representative, whether working as an employee of the Association or for a contractor hired by the Association, would be covered by the Ordinance. The substitution of the word “authorization” for the word “permission” is recommended to reflect the current practice of gate representatives to verify that a person seeking entrance to the City has the permission of a resident or other authorized person, before such gate representative allows the visitor to enter. The City was awarded a grant fund allocation in the amount of $177,952 from the "Per Capita Program" and is required to approve a resolution accepting these grant funds. At the September 28, 2020 City Council meeting, the requirements listed in the resolution to accept the funds would be resource intensive and the Council concluded that the requirements cannot be met. The City Council directed staff to explore the following: 1. Can the funds be sold to another agency as with the Los Angeles County Proposition A allocation for transit programs? 2. Can the funds be used fire fuel abatement in the Nature Preserve? The Prop 68 Per Capita grant funds cannot be sold to another agency but can be transferred to another agency. Per Capita funds can only be used for capital improvement. Maintenance and projects relating to maintenance of past projects or facilities is not eligible. Fire fuel abatement is considered 55 maintenance, not capital improvement therefore ineligible for Per Capita program funds. At the September 28, 2020 meeting, staff presented an eligible project on the Peninsula for the Prop 68 Per Capita funding: redesign of the George F. Canyon Nature Center in the City of Rolling Hills Estates. In August 2020, Rolling Hills Estates inquired about Rolling Hills' Per Capita program allocation and requested the allocation to be transferred to support capital improvements to the George F. Canyon Nature Center. Upon approval of the resolution to accept the grant funds, the City Council is requested to approve a resolution to transfer the City of Rolling Hills Per Capita Grant Fund allocation of $177,952 to Rolling Hills Estates. DISCUSSION: The grant funds must be used for eligible projects / project costs outlined in the Procedural Guide for the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018 PER CAPITA PROGRAM June 2020. The City is required to submit an application packet for projects and project costs the City proposes to use these grants funds for must to OGALS for approval. Grant funds for eligible projects must be in addition to existing funding. Eligible projects using the grant funds must be completed and open to the public by June 30, 2024. All or part of the grants fund allocation can be transferred to an eligible City upon passing a resolution authorizing the transfer. The City of Rolling Hills proposes to accept the Per Capita Program as stipulated in the Per Capita Program Procedural Guide and stated in Resolution No. 1263. Conferring with OGALS and with the City Attorney, since the City of Rolling Hills will be transferring their Per Capita Program Grants funds to Rolling Hills Estates, the requirements to accept these funds will also transfer to Rolling Hills Estates, i.e., Rolling Hills Estates must certify they will meet the requirements of the program. FISCAL IMPACT: Passing a resolution to accepting the Per Capita Program Grant Fund allocation and subsequently passing a resolution to transfer the Per Capita Program Grant Fund allocation to an eligible city will not have any fiscal impact on the City. RECOMMENDATION: Staff recommends that the City Council approve Resolution No. 1263 accepting the Per Capita Program Grant Fund allocation in the amount of $177,952; and recommends that the City Council approve Resolution No. 1265 transferring the Per Capita Program Grant Fund allocation in the amount of $177,952 to Rolling Hills Estates. The $4 billion "Parks, Environment, and Water Bond Act of 2018" through budget acts for 2018/2019 and 2019/2020 set aside $185,000,000 for the Per Capita Program. In this program, funds are available for local park rehabilitation, creation, and improvement grants to local governments. The City's allocation is $177,952 per the attached allocation table from the State. To use the allocation, agencies must do the following in the order listed: 1. Attend mandatory workshop 2. Pass resolution 3. Identify project(s) 4. Submit application package by December 2021 5. Execute contract by June 2022 6. Project completion by December 2023 7. Submit completion package by March 2024 In mid-August, the City's Project Manager Alan Palermo Consulting (API) attended the mandatory workshop on behalf of the City. The next step is to have Authorization Resolution approved by the City Council. Per the Procedural Guide for the Per Capita Program, the Authorization Resolution may be formatted but the language provided in the resolution must remain unchanged. The Authorization Resolution serves two purposes: (1) It is the means by which the Grantee's Governing Body agrees to the terms of the contract; it provides confirmation that the Grantee has the funding to complete, operate and maintain projects associated with the contract. (2) Designates a position title to represent the Governing Body on all matters regarding projects associated with the contract. The incumbent in this position is referred to as the Authorized Representative. 57 Based on criteria for eligible projects under the Per Capita Program allocation, the City Hall campus/open space could be improved to serve the community. Upon a closer reading of the commitments outlined in the Authorizing Resolution, staff evaluated that items 7 and 8 required additional discussions with the City Council. DISCUSSION: Item 7 of the Authorizing Resolution requires the grantee to promote, expand access, increase awareness for diverse populations. Item 8 of the Authorizing Resolution requires the grantee to provide workforce education and training, contractor and job opportunities for disadvantage communities. Being a private community, and with limited staffing, staff is concerned that the City may not be able to meet the commitments outlined in the Authorizing Resolution. The Procedural Guide for the Per Capita Program discusses that entities that receive an allocation per the program may transfer all or part of the allocation to another eligible entity, provided that the following requirements are met: A. All required documentation must be submitted no later than six months from the end of the encumbrance period; B. The transferring agency must submit a resolution authorizing the transfer of the allocation. The resolution must name the recipient entity and the transferred amount; C. The recipient must be eligible to receive Per Capita funds; D. The recipient must have submitted the Authorizing Resolution; and E. The recipient must submit a resolution authorizing the receipt of funds; the resolution must state the donor and the transferred amount. Located adjacent to the 36-acre preserve at Palos Verdes Drive North and Palos Verdes Drive East, the George F. Canyon Nature Center is maintained by the City of Rolling Hills Estates. Education and recreational programs at the Nature Center are provided by the Palos Verdes Peninsula Land Conservancy. The Nature Center provides an opportunity for the Palos Verdes Peninsula Community to learn more about the nature and wildlife of the George F. Canyon. Current exhibits at the Nature Center feature local flora and fauna, including live animals. In partnership with the Palos Verdes Unified School District, the Nature Center provides an active education program. The City of Rolling Hills Estates has been researching the feasibility of replacing its George F. Canyon Nature Center. Over the past two years, the City of Rolling Hills Estates engaged an architect and held community meetings to seek input on a redesign of the Center. A final design concept was estimated to cost $1.7 million and slated to be presented to their City Council this fall. Rolling Hills Estates is seeking opportunities to fund the project. In late August 2020, Rolling Hills Estates inquired about Rolling Hills' Per Capita Program allocation. If the City Council should decide not to accept the Per Capita Program allocation, staff recommends that the allocation be transferred to the City of Rolling Hills Estates to improve the George F. Canyon Nature Center. FISCAL IMPACT: Should the City Council decide to pursue the Per Capita Program allocation, the City will need to 58 Should the City Council decide to pursue the Per Capita Program allocation, the City will need to provide a match of $44,500, assuming the entire allocation amount is used. The match funds can be a combination of city staff time, local funds and or other State and County grant funds. There would be other costs associated with actions obligated by the State to accept the Per Capita Program. Costs associated with these other actions are unknown at this time. DATE:November 23, 2020 BACKGROUND: As a component of the Community Wildfire Protection Plan (CWPP), staff has been working with the Block Captain Program, and the First Responders to provide evacuation strategies to the community. In the aftermath of the Woolsey Fire from November 2018, the City of Malibu advertised a Request for Proposal for a traffic consultant to assist with evacuation strategies in an effort to be more prepared for future emergency events requiring evacuation. Lead Block Captains and staff shared the RPF with the First Responders and the Los Angeles County Fire Department (LACFD) offered to serve as the city's experts and to work with the city in developing strategies. Since then, the Los Angeles County Sheriff's Department (LASD) and the LACFD conducted frequent meetings with the city, almost on a monthly basis to listen to community concerns, discuss lessons learned from previous fires in Rolling Hills, educate city staff and volunteers on response protocols as well as the Fire Code. In July 2020, staff requested LACFD to conduct an assessment of the evacuation routes in Rolling Hills: Portuguese Bend Road, Crest Road and Eastfield Drive. LACFD commenced the effort by conducting a ride along on the evacuation routes with city staff. LACFD recommended the City Council and the RHCA participate in the ride along. On the ride along, LACFD operations and brush clearance unit personnel educated participants on their protocols for observing the routes with respect to fire safety. In August, September and October, LACFD personnel were pulled to address wildfires in LA County. During this time, with the assistance of the Block Captain Program, staff released an evacuation route survey to solicit the community's perspective on the state of the main roads in the community and concerns relating to the roads for evacuation. The evacuation route survey was open for 67 approximately one month and closed on November 13, 2020. A total of 146 responses were received. When the wildfires were mostly contained, LACFD returned to the City's request for an assessment and provided a report of their findings in early November. DISCUSSION: Participants of the ride along in July and Captain Powers from LASD met with the LACFD to discuss the assessment report for a complete understanding of the findings. Based on LACFD's assessment, in general the evacuation routes in Rolling Hills are in good condition. There are a number of areas that need to be addressed and improvements should be made along Eastfield Drive to achieve more travel width for emergency vehicles and personnel. LACFD called out locations for tree removal, tree trimming and cutting back vegetation. As a part of the assessment exercise, the LACFD reiterate their commitment to ensuring safe evacuation conditions. The LACFD will follow up with enforcement actions on the locations identified as a part of the assessment. Also, effectively immediately, LACFD will commence year-round patrols to continuously assess all roads in the community to ensure safe evacuation conditions through the use of the 410B inspection reports. Inspection reports will be addressed to property owners as with the 410B inspection reports generated during the annual brush clearance inspections that typically take place between June 1 and July 15. The LACFD provided a plan to the city to bring the roads in the community to an acceptable safe evacuation conditions over a four year period through the year-round patrols and the annual brush clearance inspections. The evacuation routes survey closed on Friday, November 13, 2020. The survey is comprised of open- ended questions and binary questions. Additional analysis is needed on the open-ended responses to gain insight and to determine appropriate action items. Lead Block Captains Arlene and Gene Honbo preliminarily summarized the responses to the open-ended questions and the summary is included as a part of this report. One of the binary questions of the survey was "Do you support the LA County Fire Department to have a more active enforcement role to support fire mitigation in the community?" Response choices were "yes" or "no". For this question, 86.62% responded "yes" and 14.08% responded "no". Based on the responses to this question, the community would be supportive of the LACFD's year round patrol. FISCAL IMPACT: With the involvement of the LASD and the LACFD, the City did not have to expend funds to hire experts in the field of fire safety to evaluate the state of the evacuation routes in the community. The City also did not have to pay for experts to educate staff on evacuation strategies. There was no fiscal impact to the City's General Fund for the evacuation routes fire safety assessment. City Manager 2 Portuguese Bend Road City of Rolling Hills, CA 90274 Dear Ms. Jeng: On July 29, 2020, the Los Angeles County Fire Department (Department) personnel along with Rolling Hills staff and community members conducted a survey along established evacuation routes throughout the city for compliance with roadside clearance of vegetation, as specified in Title 32 of the Los Angeles County Fire Code (Code). The following is a summary of the hazards identified and recommended mitigation measures. (Please refer to the attached maps for specific locations). Crest Road - Hazards identified along Crest Road are pepper trees that can be trimmed back from the roadway and meet the 10' requirement. The easement on the main road allows for the 10' without impinging on adjacent properties. There is one large pine tree at Crest and Quail Ridge Rd., on the north side, that is leaning into the roadway and should be removed. Portuguese Rd. (North) - Hazards identified on Portuguese Rd. (North) survey were pepper trees that should be trimmed back from the roadway to not obstruct traffic or impede the ability for civilian or emergency vehicles to move onto the shoulder. The 10' requirement is not feasible as most areas have less than 10' to the property line fencing, canyon, or hill. Two areas noted as "Tree", on the attached map, have large pines leaning into the roadway and we recommend removal. The pines are identified at 100 yards down from Crest Rd. and at 100 yards up from City Hall/ Portuguese gate. Portuguese Rd. (South) - Hazards identified on this section of Portuguese Rd. are pepper trees that should be trimmed back from the roadway to not obstruct traffic or impede the 69 Ms. Elaine Jeng, P.E. October 2, 2020 Page 2 ability for civilian or emergency vehicles to move onto the shoulder. The focus of the pepper tree pruning should be on the lower segment of this route. It appears there has been recent brush clearance on the upper portion of Portuguese Rd. (South) and it’s looking great. There is one large eucalyptus tree in front of new construction, (200 yards south of Crest), that is leaning into the roadway and should be trimmed. Eastfield Road – There were no specific hazards documented in the initial survey of Eastfield Road, and most sections appear adequate as an egress route to Portuguese Bend North. However, there are areas of pepper trees, (Open Brand Rd, Roundup Rd), that should be trimmed back away from the roadway, allowing for unobstructed traffic flow and vehicle use of the shoulder areas. In addition, large pines leaning over this roadway at #3 Eastfield should be trimmed to meet the 10' setback. Section 325.10 of the Code states, "The fire code official or commissioner MAY require removal and clearance of all flammable or other combustible growth for a minimum of 10 feet on each side of the roadway whether public or private." In most cases along the city’s three main evacuation routes, it is not feasible or warranted, for strict adherence of the 10' Code requirement. Discretion by the fire code official is supported in Section 326.14 of the Code that states, “If the fire code official determines in any specific case that difficult terrain, danger of erosion, or other unusual circumstances make strict compliance with the provisions of this code undesirable or impractical, the fire code official may suspend enforcement thereof and require reasonable alternative measures”. In addition to the fire code, the Rolling Hills Community Association, (RHCA) has the governing authority, as set forth in the original agreement and declaration with the Rancho Palos Verdes Corporation, to set standards and maintain dedicated easements for public access. The attached roadway detail outlines recommended standards for roadways within the city limits of Rolling Hills. The Department is committed to ensuring safe evacuation conditions for all resident in the event of an extreme wildland fire event. It is our recommendation that the roadside hazards identified in our earlier of evacuation route field survey be corrected this year and follow-up enforcement by the Department of hazardous vegetation along the remainder of roadways in the city be removed over a four-year period. For the balance of roadside vegetation falling outside the jurisdiction of the fire code, it is our hope that coordinated follow-up enforcement actions by the RHCA to eliminate vegetation in the roadside easements will greatly mitigate potential emergency ingress and egress concerns. These updates include: revisions to the 5 th Cycle Housing Element Report; Initial Study/Negative Declaration; and related General Plan Amendment and Zoning Amendment. The City must submit these documents to HCD in the 4th quarter of 2020, and no later than December 31, 2020. As a result, City Council approval is necessary prior to HCD submission. DISCUSSION: In order to meet the Housing Element submission deadline by the end of the calendar year 2020, staff recommends that the City Council convene a regular meeting on December 28, 2020. FISCAL IMPACT: Preparation of the revised 5th Cycle Housing Element is expected to be offset by the SB2 grant ($160,000) from HCD. The award of the grant is contingent upon the timely submittal of the revised 5th Cycle Housing Element by the end of the calendar year 2020.
