A RESOLUTION.OF THE CITY COUNCIL OF THE
CITY OF ROLLING HILLS AUTHORIZING EXECUTION
OF AN AGREEMENT WITH THE CALIFORNIA DISASTER
OFFICE OF THE STATE OF CALIFORNIA PROVIDING
FOR THE PAYMENT OF A SERVICE CHARGE IN
CONNECTION WITH THE PURCHASE OF SURPLUS
PROPERTY.
WHEREAS, the City of Rolling Hills has signified its
intention to participate in the Civil Defense Surplus
Property Program; and
WHEREAS, the California Disaster Office of the State of
California finds it necessary to make a service charge in
connection with. the purchase of any surplus property by the
City of Rolling Hills; and
WHEREAS, the City of Rolling Hills is agreeable to paying. -
the service charge on any surplus property purchased by it
through the California Disaster,Office; and
WHEREAS, a written form of agreement to this effect has
been submitted to the City Council of the City of Rolling
Hills,
and
that
said agreement is acceptable to the City
Council
of
said
City;
NOW, THEREFORE, BE IT RESOLVED that the Mayor of the
City of Rolling Hills, or the Clerk thereof, be and they are
hereby authorized, empowered and directed for and on behalf
of the City of Rolling Hills to enter into an agreement in
the form submitted to this Council, providing for the.payment
of a ten (10%) percent service charge to the California
Disaster Office on any surplus property purchased by the
City of Rolling Hills.
BE IT FURTHER RESOLVED that the Mayor shall sign this
Resolution, and the City Clerk shall attest and certify to
the passage and adoption thereof, and that there shall be
attached to the permanent file copy of this Resolution a
copy of the form of agreement above referred to.

A G R E E M E N T
THIS AGREEMENT entered into this 10th day of August, 1959,
by and between the STATE OF CALIFORNIA, acting by and through
its duly appointed, qualified and acting Director of the Califor-
nia Disaster Office, hereinafter called CDO, and the CITY OF
ROLLING HILLS, State of California, a Municipal Corporation,
hereinafter called Agency;
W I T N E S' S E T'! _H:
WHEREAS, pursuant to Resolution No. 82 of the City Council
of the City of Rolling Hills, State of California, passed and
adopted on the 10th day of August, 1959; and
WHEREAS, Agency signified its intention to participate in
the civil defense surplus property program and desires to con-
tinue to participate; and
SEAS, CDO finds it necessary to employ additional per-
sonnel in order to render adequate service to the cities and
counties in connection with the civil defense surplus property
program;
NOW, THEREFORE, IT IS MUTUALLY AGREED between the parties
hereto as follows:
1. CDO agrees to provide technical and clerical assistance
to Agency at the three surplus property warehouses lo-
cated in North Sacramento, San Leandro and Los Angeles.
In order to compensate State for this additional ser-
vice, CDO will invoice Agency, not less often than
quarterly, for 10% of the service and handling charges
assessed by the Educational Agency for Surplus Property
on any items purchased, and Agenc agrees to pay CDO
for such charges within sixty (60) days of date of
each invoice.
2. This Agreement shall commence on the 10th day of
August, 1959, and shall terminate on the 31st day
of December, 1962, subject to the right of either
party to terminate the Agreement by giving the other
party written notice at least 30 days prior to such
termination.
IN WITNESS WHEREOF, this Agreement has been executed by
and on behalf of the parties hereto, on the day and year first
above written.
