Attached is correspondence received requesting that the City adopt
a resolution assigning available Local Federal -Aid Urban (FAU)
funds to the City of Rolling Hills Estates for their Palos Verdes
Drive North Phase II Reconstruction Project.
As indicated in the letter in the past the City of Rolling Hills
has allocated funds to Rolling Hills Estates for projects of mutual
benefit.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 626
approving the allocation of FAU funds to the City of Rolling Hills.

In the past, the City of Rolling Hills has generously allocated their available
FAU funds to the City of Rolling Hills Estates for projects of mutual benefit
to both cities. Last fiscal year, your City contributed $13,800 of FAU funds
to the PVDN Phase II Reconstruction Project which begins near your City entrance
at Sunnyfield Drive and terminates 600 feet west of Crenshaw Boulevard.
Your current FAU local unobligated balance totals $39,843. On behalf of the City
of Rolling Hills Estates, I request that your City Council consider adopting the
enclosed resolution that would allocate these lapsing funds to our PVDN Phase
II Reconstruction Project. We believe that this reconstruction will make a
substantial roadway improvement on PVDN and contribute greatly to improving
traffic mobility.

A. RESOLUTION NO. 626: A RESOLUTION OF THE CITY OF ROLLING
HILLS, CALIFORNIA ASSIGNING TO THE CITY OF ROLLING HILLS
ESTATES, CALIFORNIA, ITS AVAILABLE LOCAL FEDERAL -AID URBAN
(FAU) FUNDS.
City Manager Nealis reported that the City of Rolling Hills
Estates has requested that the City of Rolling Hills allocate its
portion of the FAU funds to them to help pay for the improvements
to Palos Verdes Drive North, which are expected to be started in
January or February. The City Manager recommended the adoption of
this resolution.
Councilwoman Leeuwenburgh moved approval of the resolution but
suggested mentioning in the cover letter that the City of Rolling
Hills has concerns about the islands which have been approved for
this portion of Palos Verdes Drive North and would like to work
with them on the design. Councilwoman Murdock expressed concerns
regarding the ability of emergency vehicles to cross the median in
the street.
Councilwoman Murdock seconded the motion and it carried
unanimously.

During deliberation on this matter, City Council members in
attendance discussed the use of California Wildlife, Coastal and
Park Land Conservation Act Funds provided by the City of Rolling
Hills and hoped that future projects in Rolling Hills Estates might
include those designed to enhance natural, open space public
recreational uses.
We are glad to be able to assist the City of Rolling Hills Estates
with the improvements at Ernie Howlett Park and look forward to a
continued cooperative relationship of improving peninsula open
space recreational opportunities.

RESOLUTION NO. 619
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS APPROVING THE
APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA GRANT PROGRAM UNDER THE CALIFORNIA
WILDLIFE, COASTAL, AND PARK LAND CONSERVATION ACT OF 1988, FOR IMPROVEMENTS TO
ERNIE HOWLETT PARK FACILITIES.
WHEREAS, the people of the State of California have enacted the California
Wildlife, Coastal, and Park Land Conservation Act of 1988, which provides funds
to the State of California and its political subdivisions for acquiring and/or
developing facilities for public recreational and open space purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated
the responsibility for the administration of the program within the State,
setting up necessary procedures governing application by local agencies under
the program; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of
application before submission of said application to the State; and
WHEREAS, a Joint Exercise of Power Agreement between the City of Rolling
Hills Estates and the City of Rolling Hills approved and adopted on August 27,
1990, this City did declare its intent to authorize its Per Capita Grant Funds
under the California Wildlife Coastal and Park Conservation Bond Act of 1988,
to be utilized by the City of Rolling Hills Estates; and
WHEREAS, the City of Rolling Hills Estates has agreed to utilize the funds
from the City of Rolling Hills for improvements to Ernie Howlett Park facilities
which will be utilized by the City of Rolling Hills citizens; and
WHEREAS, the applicant will enter into an agreement with the State of
California for acquisition or development of the project.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF ROLLING HILLS HEREBY:
1. Approves the filing of an application for the Per Capita Grant
Program under the California Wildlife, Coastal, and Park Land Conservation Act
of 1988 State grant assistance for the above project; and
2. Certifies that said applicant understands the assurances and
certification in the application form; and
3. Has been assured that the City of Rolling Hills Estates has
sufficient funds to operate and maintain the project; and
4. Appoints Rolling Hills City Manager as agent of the City to conduct
all negotiations, execute and submit all documents including, but not limited
to, applications, agreements, amendments, payment requests and so on, which may
be necessary for the completion of the aforementioned project.

JOINT EXERCISE OF POWER AGREEMENT
This is a JOINT EXERCISE OF POWER AGREEMENT entered into this 27th day of
August, 1990, by and between the CITY OF ROLLING HILLS ESTATES, hereinafter
referred to as "CITY" and the CITY OF ROLLING HILLS, hereinafter referred to as
"APPLICANT CITY."
WHEREAS, the CITY agrees to develop and maintain additions to Howlett
Park; and
WHEREAS, the APPLICANT CITY has an allocation of $20,000 from the Per
Capita Grant Program under the California Wildlife Coastal Park Land and
Conservation Bond Act of 1988, which the APPLICANT CITY wishes to be transferred
to the CITY for development of said Park; and
WHEREAS, the State of California is willing that said funds be used for
the construction of park facilities at said park upon the APPLICANT CITY
signifying its approval for said use and making the certification and appointment
as set forth in that certain Resolution No. 1634 authorizing its grant under the
California Wildlife Coastal and Park Land Conservation Bond Act of 1988 to be
utilized by the CITY; and
WHEREAS, in order to effectuate said fund use, the State of California will
require the CITY and its City Manager to execute Project Agreement in form.
NOW, THEREFORE, IT IS AGREED:
1) That in consideration of APPLICANT CITY adopting Resolution No. 1634
authorizing the use of said California Wildlife Coastal and Park Land
Conservation Bond Act of 1988 funds for the improvements of Howlett Park, the
CITY does covenant and agree as follows:
(a) That said funds will be used by CITY for the improvements of
park facilities at said park;
(b) That CITY will indemnify, hold harmless and defend APPLICANT
CITY, its officers, agents and employees against any and all
claims, demands, damages, costs, expenses or liability to the
State of California on account of the receipt , use and
disbursement of said funds and resulting from CITY's breach,
if any, of the Project Agreement or the CITY's failure, if any,
to comply with the agreements, covenants and conditions set
forth in said Project Agreement.•

Rolling Hills will allocate $20,000 in grant
funds available under the California Wildlife
Coastal and Park Land Conservation Bond Act
of 1988 to neighboring Rolling Hills Estates.
Rolling Hills, a private and gated community,
cannot use the money because it may only be
spent on public parks. The city agreed to
allocate its share of the funds toRolling Hills
Estates _because parks and recreation areas in
that city benefit Rolling Hills residents.
Rolling Hills Estates officials' have said they
will use the funds to improve Ernie Howlett
Park on Hawthorne Boulevard. The improve-
ments will consist of picnic shade shelters,
rebuilding of wooden steps, benches and tables
for the tennis area, windscreens for the tennis
courts, and bleachers for the tennis area.
At the suggestion of Councilwoman Gordana
Swanson, the Rolling Hills council agreed to
request that the city of Rolling HillsEstates
next year consider using Rolling Hills money to
improve and conserve'natural park areas rather
than concentrating on improving park facilities.

ISSUE
Should the City Council approve the allocation of the subject grant
funds to the City of Rolling Hills Estates?
BACKGROUND
In the past the City of Rolling Hills has contributed its share of
the subject funds to the City of Rolling Hills Estates for the
enhancement and development of parks and recreation areas which are
mutually beneficial to both cities.
The City of Rolling Hills Estates has identified Howlett Park
improvement as a priority capital project.
RECOMMENDATION
Approve allocation of grant funds to Rolling Hills Estates.

On behalf of the City Council of the City of Rolling Hills Estates, I am
requesting that the City of Rolling Hills consider allocating their Per Capita
Grant Funds. available under the California Wildlife Coastal and Park Land
Conservation Bond Act of 1988 to the City of Rolling Hills Estates.
Since these Per Capita grant funds cannot be utilized in the City of Rolling
Hills, traditionally you have contributed your share for the development or
enhancement of park and recreation areas in Rolling Hills Estates mutually
beneficial to both cities. This year the City Council has identified Howlett
Park improvements as a priority capital project. These improvements would
consist of picnic shade shelters, reconstruction of wooden steps, benches and
tables for the tennis area, windscreens for the tennis courts, and bleachers for
the tennis area.
I have enclosed a Joint Powers Agreement, Resolution and Grant Application for
your review. This will enable the City of Rolling Hills Estates to utilize your
current Per Capita Grant allocation from the California Wildlife Coastal and Park
Land Conservation Bond Act. The application deadline for this grant is September
15, 1990. Therefore, your immediate consideration of this matter will be greatly
appreciated.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING HILLS APPROVING THE
APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA GRANT PROGRAM UNDER THE CALIFORNIA
WILDLIFE, COASTAL, AND PARK LAND CONSERVATION ACT OF 1988, FOR IMPROVEMENTS TO
ERNIE HOWLETT PARK FACILITIES.
WHEREAS, the people of the State of California have enacted the California
Wildlife, Coastal, and Park Land Conservation Act of 1988, which provides funds
to the State of California and its political subdivisions for acquiring and/or
developing facilities for public recreational and open space purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated
the responsibility for the administration of the program within the State,
setting up necessary procedures governing application by local agencies under
the program; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of
application before submission of said application to the State; and
WHEREAS, a Joint Exercise of Power Agreement between the City of Rolling
Hills Estates and the City of Rolling Hills approved and adopted on August 27,
1990, this City did declare its intent to authorize its Per Capita Grant Funds
under the California Wildlife Coastal and Park Conservation Bond Act of 1988,
to be utilized by the City of Rolling Hills Estates; and
WHEREAS, the City of Rolling Hills Estates has agreed to utilize the funds
from the City of Rolling Hills for improvements to Ernie Howlett Park facilities
which will be utilized by the City of Rolling Hills citizens; and
WHEREAS, the applicant will enter into an agreement with the State of
California for acquisition or development of the project.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF ROLLING HILLS HEREBY:
1. Approves the filing of an application for the Per Capita Grant
Program under the California Wildlife, Coastal, and Park Land Conservation -Act
of 1988 State grant assistance for the above project; and
2. Certifies that said applicant understands the assurances and
certification in the application form; and
3. Has been assured that the City of Rolling Hills Estates has
sufficient funds to operate and maintain the project; and
4. Appoints Rolling Hills City Manager as agent of the City to conduct
all negotiations, execute and submit all documents including, but not limited
to, applications, agreements, amendments, payment requests and so on, which may
be necessary for the completion of the aforementioned project.

JOINT EXERCISE OF POWER AGREEMENT
This is a JOINT EXERCISE OF POWER AGREEMENT entered into this 27th day of
August, 1990, by and between the CITY OF ROLLING HILLS ESTATES, hereinafter
referred to as "CITY" and the CITY OF ROLLING HILLS, hereinafter referred to as
"APPLICANT CITY."
WHEREAS, the CITY agrees to develop and maintain additions to Howlett
Park; and
WHEREAS, the APPLICANT CITY has an allocation of $20,000 from the Per
Capita Grant Program under the California Wildlife Coastal Park Land and
Conservation Bond Act of 1988, which the APPLICANT CITY wishes to be transferred
to the CITY for development of said Park; and
WHEREAS, the State of California is willing that said funds be used for
the construction of park facilities at said park upon the APPLICANT CITY
signifying its approval for said use and making the certification and appointment
as set forth in that certain Resolution No. 1634 authorizing its grant under the
California Wildlife Coastal and Park Land Conservation Bond Act of 1988 to be
utilized by the CITY; and
WHEREAS, in order to effectuate said fund use, the State of California will
require the CITY and its City Manager to execute Project Agreement in form.
NOW, THEREFORE, IT IS AGREED:
1) That in consideration of APPLICANT CITY adopting Resolution No. 1634
authorizing the use of said California Wildlife Coastal and Park Land
Conservation Bond Act of 1988 funds for the improvements of Howlett Park, the
CITY does covenant and agree as follows:
(a) That said funds will be used by CITY for the improvements of
park facilities at said park;
(b) That CITY will indemnify, hold harmless and defend APPLICANT
CITY, its officers, agents and employees against any and all
claims, demands, damages, costs, expenses or liability to the
State of California on account of the receipt , use and
disbursement of said funds and resulting from CITY's breach,
if any, of the Project Agreement or the CITY's failure, if any,
to comply with the agreements, covenants and conditions set
forth in said Project Agreement.
IN WITNESS WHEREOF, the APPLICANT CITY and the CITY have caused this Joint
Exercise of Powers Agreement to be executed by their duly authorized officers

IMPORTANT
Before you incur costs against the grant, the funds must be appropriated by the Legislature. All State requirements
must be met and an agreement signed before any funds will be disbursed.
An audit may be performed before or after final payment.
An Application for grant funds consists of one copy each of the following:
1. Application Form.
2. Authorizing Resolution from governing body.
3. Environmental Impact Report or Negative Declaration along with a response from the State Clearinghouse; and a copy
of the Notice of Determination filed with, and stamped by. the County Clerk; or if applicable, a copy of the Notice of
Exemption on file with the County Clerk if the project is categorically exempt.
4. Project location map (city or county) with enough detail to allow a person unfamiliar with the area to locate the
project.
5. Evidence of adequate land tenure (lease, joint powers agreement, etc.).
6. Acquisition map showing exterior boundaries and parcel numbers.
7. Site plan (development projects).
8. Acquisition Schedule (acquisition projects).
9. Cost Estimate (development projects).
10. Indication of amount, type and source of funds above grant provided by applicant.
11. Permit or comments from the following, if applicable:
State Lands Commission
San Francisco Bay Conservation and Development Commission (BCDC)
Regional Coastal Zone Protection Commission
Corps of Engineers
12. All leases, agreements, etc., affecting project lands or the operation and maintenance thereof.
13. Completed project proposal for Special District and Trails Programs.
14. Photos of project site if Special District or Trails Program.
15. Articles of incorporation if nonprofit applicant.
ASSURANCES
Applicant possesses legal authority to apply for the grant, and to finance. acquire, and construct the proposed project; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body authorizing
the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the person
identified as the official representative of the applicant to act in connection with the application and to provide such additional
information as may be required.
Applicant will maintain and operate the property acquired, developed, rehabilitated, or restored with the funds in perpetuity. With
the approval of the granting agency, the applicant or its successors in interest in the property may transfer the responsibility to
maintain and operate the property In accordance with section 5919 of the Public Resources Code.
Applicant will use the property only for the purposes of the Wildlife, Coastal, & Park Land Conservation Act and to make no other
use, sale, or other disposition of the property except as authorized by specific act of the Legislature.
Applicant will give the State's authorized representative access to and the right to examine all records, books, papers, or documents
related to the grant.
Applicant will cause work on the project to be commenced within a reasonable time after receipt of notification from the State that
funds have been approved and that the project will be prosecuted to completion with reasonable diligence.
Applicant will comply where applicable with provisions of the California Environmental Quality Act and the California Relocation
Assistance Act, and any other state. and/or local laws, rules and/or regulations.
