The City appreciates your pursuit of a plan to remediate the landslide, restore the original roadway and conclude the pending litigation. We too would like to see this problem resolved. While the City cannot commit in advance to any discretionary land use approvals or entitlements as identified in the December 6, 2007 letter from Bryant, Palmer, Soto, Inc., the Planning Commission and the City Council will consider your proposals, considering all of the circumstances that exist on Poppy Trail. At first glance, your proposal appears to address all the necessary planning issues; please keep in mind when planning the subdivision the City's RAS-2 zoning density. Note that the City already has a procedure that allows landowners to elect to utilize a private firm, rather than the County, to serve as building official for development projects. In its capacity as owner of a portion of the real property located in the project area, the City is willing to relinquish title to that property as may be necessary and desirable to accomplish the goal of stabilizing the area and relocating the road. We will explore your temporary use of the riding ring for soil stockpile with other involved parties. Needless to say, vehicular access to the homes on Poppy Trail will have to be maintained throughout the construction of the project. Finally, the City will certainly work with the Joint Powers Insurance Authority in order to obtain its participation in a global resolution of the landslide and the pending litigation. Li-il•i-iLC llCV December 5, 2007 TO: Tony Dahlerbruch City Manager, City of Rolling Hills RE: #1 Poppy Trail LA CAZE DEVELOPMENT COMPANY Dear Tony: The following is an outline of a letter I would like to receive from you, so that 1 could deal with my financial partners, and give them some satisfaction that we can achieve the lot split etc. I would need a letter stating that you have my preliminary plan for a lot split, as shown on the plan I gave you last week with a level pad of approximately 26,000sq/ft, and a house of approximately 8,000sq/ft. To do this we will need all of the variances etc. in Keith Palmer's letter attached' herewith. We need also the approval of the City of Rolling Hills, and the Community Association to use the existing riding ring for a period of 6 to 9 months to store access dirt while the repair work to the landslide is underway. The entire ring will be covered up to a depth of 8 to 10 ft., and when the work is finished the ring will be returned to its original condition. We would also have the right to select from the list of independent consultants, rather than use the county for the work during the .:fix". would also need the City to give me the city land in the landslide repair area which would be incorporated into the new lot. Elimination or relaxation of the traditional "future" stable/corral requirements. 4.A For Lot 1A: Either elimination of the requirement entirely with a covenant placed on the property (or) allowance to create a yard letter (or easement) on Lot 1B to allow for a "future" stable/corral to be shown on the proposed property line (the only possible location) with a minimum 35 ft. clearance from any adjacent structures to meet health department codes. 4.8 For Lot 1 B: Either elimination of the requirement entirely with a covenant placed on the property entirely (or) allowance to show a reduced "future" access drive width of approximately 10 feet (behind the proposed residence) (or) allowance to show possible "future" use the of the equestrian trail for access. 5. Building Pad Coverage and Disturbed Area Variances 2.A For Lot IA: Allow the existing #1 Poppy Trail/Residence and Pool to remain. Allow for the addition of an entrance arcade to enhance the existing entrance for the home. The existing condition exceeds current City guidelines. Recognizing that 30% building pad coverage is a City guideline, no variance is required. Planning Commission reviews building pad coverage on a case -by -case basis. 2.B For Lot 1B: Allow the proposed new residence to include approximately 10,500 S.F. of building pad coverage (which may exceed 40%). Grading plans will determine the size of the proposed building pad but the 11/16/07 Conceptual Site Plan shows approximately 40% Building Pad Coverage including 8,000 S.F. residence, 1,000 S.F. garage and 1,500 S.F. infinity pool. The code limits lot disturbance to 40%. Remediation of the landslide will require greater than 40% disturbance and thus, a variance will be necessary. Has there been a situation where no set aside for a future stable/corral was allowed: YES, several years ago a Variance was granted at 9 Packsaddle Road E. (Negri) to allow the property owner to NOT to set aside an area for a future stable/corral, due to topography. 2. The area between the existing Sheen property line and the old Poppy Trail Road is approximately 0.7 acres or 30,400 square feet. The drawing from the architect shows this area within the future lots. The area shown from Saridakis' property is approximately 1.2 to 1.5 acres. (The colored renderings we got are a reduced version of a larger plan and the scale is off. From this rendering I do not see 7 acres, possibly 6.2 to 6.5 acres, which is adequate for 2 lot subdivision). 3. Battered profile crib walls (per Roy Itani) are crib walls that have sections that are set back into the slope and are utilized to add overall stability of the wall. Crib walls are open grid like walls that encase a slope. The wall in itself is not a retaining wall, however, the entire assembly (geograde system) is retaining. We discussed three things that maybe you can assist with. First, he wanted to know if there has ever been a situation where a property was permitted not to have an area set -aside for a stable. We discussed that there are properties that are not suitable to have a stable (e.g. I mentioned Williamburg Lane and referenced the discussions we are having with the Lin property) but, has the City ever said that a property can be without one? Second, do you have an estimate of how much City property LaCaze wants for his project? Can you tell from the drawing? I don't think we have anything in writing as to an amount. Since I have not noticed any work going on, I went down to the property (the gate was standing wide open) this past weekend to see if anyone was living there. I am very concerned because of the high fire danger of weeds that should be removed and the possibility of someone starting a fire at the property endangering not only my property but the surrounding area. There is also a health risk due to mosquitoes in the pool, pond and fountains. To my surprise, the front door was standing open, there were some sandals out in front and it appeared that someone might be spending evenings at the property. I would like to strongly recommend that both the gate and the front door be locked to be sure that no one can gain access and possibly cause harm to your property and/or mine or other adjacent owners. I would also recommend weed abatement to prevent possible fire damage as well as a cleaning of the pool and fountain area. Additionally, I am concerned that I have not seen any other repair work done other than plastic on the slope for the past few months. Naturally, if there were further slippage, my property would be damaged. Unfortunately, the any of these events occurred, we would have to look to the bank for liability. Rather than go in that direction, I would like to propose that I buy the property from you. I would invest the dollars to remedy the above situation and relieve the bank of further liability. Property shall be restored to the condition that existed prior to excavations, to the maximum extent practicable, following exploratory excavations and within the time period, if any, specified by the City Manager or designee. (Municipal Code Section 15.04.120) Grading for caissons does not require Site Plan Review by the City unless the area around the work area needs to be graded for access to the location of excavation. However, engineering plans will be necessary for the caissons and building permits are required. At this time, the County provides plan review and permits for the City. For approval, it is necessary that plans be submitted to the City and RHCA for review. City staff will review the plans for walls that are over 3 -feet in setbacks and grading. He told me he has been working 6 to 8 hours a day for the last couple of weeks because the calculations on this project were one of the most difficult he has ever encountered. It now appears that the cost of this analysis will be over $30,000, He is now sending all of the information off to be drafted in CAD so that we will have completed documents in a few weeks. I'm scheduled to meet with him sometime the first week of October when he comes into Town to go over the final solutions for this property. The overall amount of yardage (to be moved) has only gone up slightly but there are some additional items that have come into play that will affect the cost. But first is that he has to go up almost to the edge of my tennis court, and I probably will suffer movement cracks etc. in my tennis court. I should be able to repair these and this is more of a matter of dollars, than panic. He also said that the entire pool and pool deck of #1 Poppy Trail may have been built on some old landslide material which will require some additional excavation and recompactlon near and around the pool In addition to caissons previously mentioned. 09/24/2007 16:49 3105342521 • LACAZE DEV PAGE 03 This probably will affect the resale ability of this property. The grading section in the middle of the property (close to my tennis court) will probably be deeper and wider than originally thought and the section on the lower North end maybe slightly smaller. He assured me that it is definitely all fixable and if we don't fix it it could slide more. He also thinks he discovered an older slide down the new road that also can be fixed with our work. When we have our meeting and I get a copy of the final report I will get back to you with a formal proposal that will request some help from your carriers.
