2000 Municipal Code - Ordinance 260 - Modifying Certain Definitions & CriteriaPUBLIC HEARINGS -Continued ORDINANCE NO. 260: AN ORDINANCE OF THE CITY OF ROLLING HILLS MODIFYING CERTAIN DEFINITIONS AND CRITERIA FOR LOT DEVELOPMENT AND AMENDING PORTIONS OF TITLE 16 (SUBDIVISIONS) TO CONFORM WITH TITLE 17 (ZONING) OF THE ROLLING HILLS MUNICIPAL CODE. Councilmember Heinsheimer stated that he will abstain from consideration of Ordinance No. 260 to make sure that there is no conceivable conflict between his responsibilities and his wife's professional landscape architectural activities. City Manager Nealis presented the staff report providing extensive background on Ordinance No. 260. City Manager Nealis stated that the proposed ordinance does not amend the present Zoning Code adopted in 1993, but amends the Subdivision Ordinance to make it consistent with the Zoning Code. In response to Mayor Pernell, City Manager Nealis explained remedial grading as it relates to maximum disturbed area subject to the Net lot calculation. Councilmember Lay explained that the Subdivision Ordinance and the Zoning Code are in conflict in this regard and stated that the City would not wish to create a lot as part of a subdivision that is ultimately unbuildable because more than 40% of the Net lot area is required to be disturbed for remedial grading. Mayor Pernell opened the public hearing and called for testimony. • Mr. Doug McHattie, South Bay Engineering, expressed concern regarding the proposed Ordinance and stated that he feels that the City Council should review the impact of the Net lot calculations and maximum disturbed area more carefully. He stated that he feels that the current Zoning Code causes an undue hardship on some residents wishing to develop or add structures on their property. He stated that he feels that a typographical error was made when the Zoning Code was codified. Discussion ensued regarding the discrepancies between the Zoning Code and the Subdivision Ordinance. Councilmember Lay stated that he feels that it is of utmost importance that there be consistency in the two Sections. • Mr. McHattie further expressed concern regarding the inclusion of landscaped areas in maximum disturbed area. He used the Heinsheimer residence, 7 Johns Canyon Road, as an example of a Rolling Hills property which has been developed with landscaping beyond 40% of the Net lot area. Councilmembers discussed the inclusion of landscaped areas in maximum disturbed area and agreed that further research into the impact of this provision on properties in the City should be conducted. Councilmember Lay stated that he feels that Ordinance No. 260 should be adopted because it is important for the Zoning Code and Subdivision Ordinance to be consistent. He stated that concerns raised this evening can be researched and addressed by staff and the Planning Commission and brought back before the City Council for consideration at a future meeting. • Mr. McHattie stated that he spoke to the Manager of the RHCA who expressed concern that residents may request the RHCA to reduce their easements in order to increase their Net lot area. In response to Councilmembers regarding the concerns raised by Mr. McHattie, City Manager Nealis explained that the current Zoning Code regulations for Net lot area calculations are explained to all applicants and clearly stated in the application that is presented to and signed by all applicants. He reported that staff has reviewed past cases and determined that any Net lot miscalculations would not have a significant impact on any cases and have not violated the spirit of the Zoning Code. He further reiterated that pad coverage continues to be the most important consideration when reviewing Site Plan Review cases and that Net lot area is rarely an issue. In cases where Net lot is an issue, the applicants can request a Variance. He stated that staff will work with the Planning Commission to address the concerns raised by Mr. McHattie. • Mrs. Nancy Hoffman, 5 MIddleridge Lane, expressed concern for the proposed Ordinance as it relates to already developed properties in the City. In response to Mrs. Hoffman, City Manager Nealis explained the Site Plan Review process as it differs from the Subdivision process. Further discussion ensued regarding the inclusion of landscaped areas in the maximum disturbed area. Councilmember Lay stated that he feels that what constitutes landscape needs to be more clearly defined. • Mr. Wayne Grau, 18 Outrider Road, expressed concern for the proposed Ordinance. Assistant City Attorney Ennis explained Net lot area and maximum disturbed area. • Dr. Ramon Cuckingnan, 16 Pine Tree Lane, expressed concern for the proposed Ordinance. Hearing no further public testimony, Mayor Pernell closed the public hearing. Councilmember Hill suggested that consideration of Ordinance No. 260 be continued to allow further study. Councilmember Lay stated that he feels that it would be better to make the Zoning Code and Subdivision Ordinance consistent at this time. He stated that staff could then research concerns raised this evening and present them to the Planning Commission for consideration. Councilmember Lay suggested when revisions are made to the Zoning Code that related sections in the Subdivision Ordinance be made at the same time. Mayor Pro Tem Murdock stated that she agrees with Councilmember Lay that the inconsistencies should be addressed at this time. Councilmember Lay moved that the City Council waive further reading and adopt Ordinance No. 260. Staff was directed to research the provisions of the current Zoning Minutes City Council Meeting 03/27/% -3- Code discussed at the hearing (net lot calculation, 40% maximum disturbed area and the inclusion/definition of landscaping within the 40% maximum), study these matters with the Planning Commission, and report back to the City Council any possible modifications to the Municipal Code. Paragraph (H) of Section 16.12.050 of Chapter 16.12 (Tentative Maps) of Title 16 of the Rolling Hills Municipal Code is amended to read: "H. The lot layout and the dimensions of each lot with: (i) a proposed twelve thousand (12,000) square foot graded building pad that has an average slope of 10% or less and is within allowable setbacks; (ii) a minimum four hundred fifty (450) square foot stable area; and (iii) a five hundred fifty (550) square foot corral area. The grade of access to the building pad shall not be greater than twelve percent (12%), and to the stable area not greater than twenty-five percent (25%)." Section 2. Paragraphs (B) and (C) of Section 16.16.010 of Chapter 16.16 (Design) of Title 16 of the Rolling Hills Municipal Code is amended to read: "B. Each lot in any subdivision located in the RA -S-1 zone shall have a net lot area of not less than forty-three thousand, five hundred sixty (43,560) square feet. Each lot in any subdivision located in the RA -S-2 zone shall have a net lot area of not less than eighty-seven thousand, one hundred twenty (87,120) square feet. C. For the purposes of this section "net lot area" shall be the total area included within the lot lines of a property, exclusive of: (a) any and all perimeter easements measured to a minimum lineal distance of ten feet perpendicular to the property lines; (b) any portion of the lot or parcel of land. used for roadway purposes; (c) any private drive or driveway which provides access to any other lot or parcel; of land; and (d) the access strip portion of a flag lot." Section 3. Paragraph (D) of Section 16.16.040 of Chapter 16.16 (Design) of Title 16 of the Rolling Hills Municipal Code is amended to read: "D. All lots shall have a depth equal to or greater than the lot width abutting the front street easement and a slope less than or equal to twenty-nine (29) degrees." Section 4. Chapter 16.16 (Design) of Title 16 is hereby amended to add a new Section 16.16.170 to read: "Each lot layout shall include (i) a proposed twelve thousand (12,000) square foot graded building pad that has an average slope of 10% or less and is within allowable setbacks; (ii) a minimum four hundred fifty (450) square foot stable area; and (iii) a five hundred fifty (550) square foot corral area. The grade of access to the building pad shall not be greater than twelve percent (12%), and to the stable area not greater than twenty-five percent (25%)." Section 5. Section 16.20.210 of Chapter 16.20 (Improvements) of Title 16 is hereby amended to read: "Grading Prohibitions. A. No building site shall be graded by the subdivider until such time as a building permit has been issued pursuant to the Building Code of the City, for the erection of a structure on the lot to be graded. B. Maximum Disturbed Area. Disturbance shall be limited to forty percent of the net lot or parcel of land area. DATE: MARCH 28, 1996 At the Adjourned Regular Meeting of the City Council held Wednesday, March 27, 1996, the City Council adopted Ordinance No. 260 bringing the Subdivision Code into conformance with the current Zoning Code. Specifically, Ordinance No. 260 makes the Subdivision Code consistent with the Zoning Code regarding setbacks, buildable areas, required stable areas, grade of access, net lot area definition, lot depth and maximum disturbed area. Current Zoning Code standards were adopted in May, 1993, with related portions (40% maximum disturbed area) in 1995. At the meeting, South Bay Engineering representative Doug McHattie and several Rolling Hills residents expressed concern regarding the definition of net lot area, maximum disturbed area and what constitutes planned landscaping which is included in the maximum disturbed area calculation. To summarize, the Zoning Code, as amended in 1993, excluded all perimeter easements in determining the net lot area. The Subdivision Code, however, excluded a maximum of 10 feet of perimeter easements in determining the net lot area. The current Zoning Code limits the maximum disturbed area to 40% of a net lot area in conjunction with new development. Disturbance does include planned landscape areas. The Subdivision Code, as amended on March 27, 1996, now matches these existing Zoning Code requirements. However, members of the City Council have directed staff to study several example applications of these Zoning Code provisions to consider whether any amendments to the existing Zoning Code, and subsequently the Subdivision Code, should be considered. As a normal course of this review, this matter will be submitted to the -1- Printed on Recycled Paper. 4• - Planning Commission. We will provide you copies of that report when it is completed. The residents that participated in the public hearing on March 27, 1996, will be invited to the Planning Commission to consider this matter as well. It is worth noting that when considering development in this City under the Zoning Code Standards as adopted in 1993, the Site Plan Review Ordinance as it relates to pad coverage is a major factor in evaluating the suitability of a project. The threshold of exceeding the net lot area is very rarely, if at all, an issue. We only have one case, so far, where a person has requested a Variance to exceed the 20% net lot coverage standard. However, it is also clear that with the new net lot definition from 1993, . the more recent 40% maximum disturbed area requirement and with the pad coverage calculation under Site Plan Review, that a review of all of these •standards is appropriate. The Ordinance makes changes to the Subdivision Code to conform with Title 17, the City's Zoning Code. Specifically, the ordinance makes modifications regarding setbacks, buildable areas, required stable area, grade of access, net lot area, lot depth and maximum disturbed area. BACKGROUND The Planning Commission requested that staff modify the Subdivision Ordinance to conform with the Zoning Ordinance because certain definitions and criteria were inconsistent and not updated when the Zoning Ordinance was updated in May, 1994. Attached is a proposed resolution (additions are underlined) recommending that the City Council modify the Subdivision Ordinance to conform with the Zoning Ordinance. LOT SIZE According to the Subdivision Ordinance and the Zoning Code, there are two residential zones in the City. The RA -S-1 Zone requires a minimum net lot area of 1 acre or 43,560 square feet and the RA -S-2 Zone requires a minimum net lot area of 2 acres or 87,120 square feet. These dimensions apply to the creation of new lots. EASEMENTS When property in Rolling Hills is subdivided, all lots are subject to perimeter easements varying in width around each lot. In some instances, roadway easements are granted by the property owner. These easements are granted to the Community Association for the purpose of construction and/or maintenance and use of streets, driveways, trails, utilities, drainage facilities, sewers, open space, and/or a combination of these uses. The City's Subdivision Ordinance requires boundary line easements for bridle trail and utility purposes of ten feet within and abutting sidelines and rear of each lot plus 60 foot street easements, usually 30 feet from centerline for each lot. (In recent years, the Community Association has required a minimum easement of 25 feet for the sidelines and rear of each lot). Easement widths have varied. There are some existing properties in the City that have easements only at certain perimeters of the property and some with only 10 foot easements. Following are the changes proposed for the Subdivision Ordinance., SETBACKS Staff proposes to add to the Subdivision Ordinance the requirement that each lot have a proposed 12,000 square foot graded building pad that is "within allowable setbacks" to conform with the Zoning Ordinance that defines a "setback line" to mean a line within a lot that is parallel to and measured from a corresponding lot line .or easement line, forming any and all perimeter easements measured to a minimum lineal distance of 10 feet perpendicular to the property lines. (Section 1) BUILDABLE AREA Staff proposes to add to the Subdivision Ordinance the requirement that new lot building pads "have an average slope of 10% or less" to conform with the Zoning Ordinance definition of buildable area as "the portion of a lot that constitutes the existing or proposed building pad and any other contiguous portion of the lot within allowable setbacks that has an average slope of 10% or less." (Section 1) STABLE AREA Staff proposes to change the Subdivision Ordinance requirement from a 200 square foot stable area to conform with the Zoning Ordinance requirement of a "minimum 450 square foot stable area and 550 square foot corral area." (Section 1) GRADE OF ACCESS Staff proposes to change the Subdivision Ordinance requirement from a maximum 20% grade of access to a building pad to the Zoning Ordinance requirement of a "maximum 12% grade of access to a building pad." (Section 1) MODIFY SUBDIVISION ORDINANCE PAGE2 NET LOT AREA We suggest a change to the Subdivision Ordinance term "net area" to the Zoning Code "net 1Qt area." We also recommend a change to the definition of net lot area from "exclude all perimeter easements to a maximum of 10 feet and that portion of the lot or parcel of land which is used for roadway purposes, and shall also exclude any private drive or driveway which provides ingress and egress to any other lot or parcel of land and the access strip portion of any flag lot" to conform with the Zoning Code requirement for net lot area as "the total area included within the lot • ini • portion of the lot or parcel of land used for roadway poses; (c) any private drive gr driveway which provides access to any other lot or parcel of land and td) the Access strip portion of a flag lot." (Section 2) Attached is a drawing of the differences between "net lot area" described in the existing Subdivision Ordinance and the proposed changes that conform with the Zoning Ordinance. The net lot area is the area that is shaded. Note that the shaded net lot area of the Subdivision Ordinance is somewhat larger than the net lot area of the Zoning Code. LQT DEPTH Change the definition of "lot depth" in the Subdivision Ordinance from "All lots shall have a depth with a slope less than thirty degrees at least equal to or greater than the lot width abutting the front street easement" to conform with the Zoning Ordinance requirement that "All lots are required to have a depth with a maximum slope of twenty-nine degrees equal to or greater than the lot width abutting the front street easement." Both are somewhat similar. (Section 3) MAXIMUM DISTURBED AREA Add the requirement of "Maximum Disturbed Area" to the Subdivision Ordinance that is already in the Zoning Ordinance, "Maximum Disturbed Area. Disturbance shall be limited to forty percent of the net lot or parcel of land area. Disturbance shall include any remedial grading (temporary disturbances any graded slopes and building pad areas, any nongraded area where impervious surfaces exist and any planned landscaped areas." (Section 4) Also attached is a table comparing the criteria discussed in the Subdivision Ordinance and the Zoning Ordinance. RECOMMENDATIONS It is recommended that the Planning Commission review the report, the resolution, take public testimony and approve the proposed resolution. BACKGROUND The Planning Commission requested that staff modify the Subdivision Ordinance to conform with the Zoning Ordinance because certain definitions and criteria were inconsistent and not updated when the Zoning Ordinance was updated in May, 1994. Attached is a proposed resolution (additions are underlined) recommending that the City Council modify the Subdivision Ordinance to conform with the Zoning Ordinance. LOT SIZE According to the Subdivision Ordinance and the Zoning Code, there are two residential zones in the. City. The RA -S-1 Zone requires a minimum net lot area of 1 acre or 43,560 square feet and the RA -S-2 Zone requires a minimum net lot area of 2 acres or 87,120 square feet. These dimensions apply to the creation of new lots. EASEMENTS When property in Rolling Hills is subdivided, all lots are subject to perimeter easements varying in width around each lot. In some instances, roadway easements are granted by the property owner. These easements are granted to the Community Association for the purpose of construction and/or maintenance and use of streets, driveways, trails, utilities, drainage facilities, sewers, open space, and/or a combination of these uses. The Community MODIFY SUBDIVISION ORDINANCE PAGE 1 ®Prince•] on Rec-,,:Igd Association requires that all easements must be kept free of buildings, fences, plantings or other obstructions. The City's Subdivision Ordinance requires boundary line easements for bridle trail and utility purposes of ten feet within and abutting sidelines and rear of each lot plus 60 foot street easements, usually 30 feet from centerline for each lot. (In recent years, the Community Association has required a minimum easement of 25 feet for the sidelines and rear of each lot). Easement widths have varied. There are some existing properties in the City that have easements only at certain perimeters of the property and some with only 10 foot easements. Following are the changes proposed for the Subdivision Ordinance: SETBACKS Staff proposes to add to the Subdivision Ordinance the requirement that each lot have a proposed 12,000 square foot graded building pad that is "within allowable setbacks" to conform with the Zoning Ordinance that defines a "setback line" to mean a line within a lot that is parallel to and measured from a corresponding lot line or easement line, forming any and all perimeter easements measured to a minimum lineal distance of 10 feet perpendicular to the property lines. (Section 1) BUILDABLE AREA Staff proposes to add to the Subdivision Ordinance the requirement that new lot building pads "have an average slope of 10% or less" to conform with the Zoning Ordinance definition of buildable area as "the portion of a lot that constitutes the existing or proposed building pad and any other contiguous portion of the lot within allowable setbacks that has an average slope of 10% or less." (Section 1) STABLE AREA Staff proposes to change the Subdivision Ordinance requirement from a 200 square foot stable area to conform with the Zoning Ordinance requirement of a "minimum 450 square foot stable area and 550 square foot corral area." (Section 1) GRADE OF ACCESS Staff proposes to change the Subdivision Ordinance requirement from a maximum 20% grade of access to a building pad to the Zoning Ordinance requirement of a "maximum 12% grade of access to a building pad." (Section 1) MODIFY SUBDIVISION ORDINANCE PAGE 2 NET LOT AREA We suggest a change to the Subdivision Ordinance term "net area" to the Zoning Code "net lot area." We also recommend a change to the definition of net lot area from "exclude all perimeter easements to a maximum of 10 feet and that portion of the lot or parcel of land which is used for roadway purposes, and shall also exclude any private drive or driveway which provides ingress and egress to any other lot or parcel of land and the access strip portion of any flag lot" to conform with the Zoning Code requirement for net lot area as "the total area included within the lot lines of a property exclusive of: (a) any and all perimeter easements measured to a minimum lineal distance of ten feet perpendicular to the property lines; (b) any portion of the lot or parcel of land used for roadway purposes; (c) any private drive or driveway which provides access to any other lot or parcel of land and (d) the access strip portion of a flag lot." (Section 2) Attached is a drawing of the differences between "net lot area" described in the existing Subdivision Ordinance and the proposed changes that conform with the Zoning Ordinance. The net lot area is the area that is shaded. Note that the shaded net lot area of the Subdivision Ordinance is somewhat larger than the net lot area of the Zoning Code. LOT DEPTH Change the definition of "lot depth" in the Subdivision Ordinance from "All lots shall have a depth with a slope less than thirty degrees at least equal to or greater than the lot width abutting the front street easement" to conform with the Zoning Ordinance requirement that "All lots are required to have a depth with a maximum slope of twenty-nine degrees equal to or greater than the lot width abutting the front street easement." Both are somewhat similar. (Section 3) MAXIMUM DISTURBED AREA Add the requirement of "Maximum Disturbed Area" to the Subdivision Ordinance that is already in the Zoning Ordinance, "Maximum Disturbed Area. Disturbance shall be limited to forty percent of the net lot or parcel of land area. Disturbance shall include any remedial grading (temporary disturbance), any graded slopes and building pad areas, any nongraded area where impervious surfaces exist and any planned landscaped areas."
